Instructions on how to claim and the offer form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
Claims are only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to claim.
Offer commences on 17/10/08 and closes at 5pm AEDST on 31/01/09 ("Offer Period").
To be eligible to claim, eligible claimants must purchase, a selected Samsung TV (models detailed below) from any participating Australian retail store (This offer excludes TV models purchased through any discount online, online bidding or auction websites.) during the Offer Period. For the purposes of the Terms and Conditions ‘purchase’ means payment in full of the participating product. To claim, claimants must then visit www.samsung.com.au/promotions, follow the prompts to the claim form page, input the requested details including the serial number of participating product purchased & their VISA or MasterCard credit card details to be debited for the $30 postage, handling & administration fee and submit the fully completed online claim form. If the claimant is unable to provide the serial number of participating product purchased at time of submitting online claim form, their claim will be accepted for consideration however the serial number must be received by the promoter within 28 days of product purchased. Claims must be submitted within 14 days of the purchase being made and must be submitted no later than 5pm AEDST on 14/02/09. Once the claim form has been submitted claimants will be instructed online to send their original purchase receipt in a stamped envelope to "CTV Christmas" Promotion PO Box 381, Brookvale, NSW 2100 for validation. All purchase receipts must be received by the Promoter within 14 days of submitting their online claim form. Original purchase receipts will be returned to the claimant at the time of receiving the gift. The Promoter recommends that claimants retain a photocopy of their original purchase receipts for their records. All claims must be carried out by the actual purchaser of the LCD or Plasma screen. Claims or registrations by any other person will not be accepted.
The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant's identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible claims will be deemed invalid.
Only one (1) claim permitted per household.
Every valid claim received will be awarded the gift of a Samsung Blu-Ray Player (model No. BDP1500) valued at $499. To redeem and receive the Samsung Blu Ray BDP1500 player, claimants must pay the postage, handling & administration fee of $30 (covering postage, handling and other costs incurred by the Promoter in providing this Promotion) with payment to be made via Mastercard or Visa Card online This charge will appear on your credit card statement as "Handling Matters". Handling Matters is an affiliated partner of Samsung.
Claimants should allow at least 28 days from the date their claim form and original purchase documentation is received by the Promoter, to receive their gift. The Promoter's decision is final and no correspondence will be entered into.
The Promoter reserves the right to reclaim from any claimant, the gift, if the initially purchased selected Samsung TV is returned after the claim has been processed and fulfilled. This clause does not limit or affect the claimant's rights with regards to warranties on the product either from the manufacturer or implied by legislation.
If any gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the gift with a gift to the equal value and/or specification.
Gifts are not transferable or exchangeable and cannot be taken as cash.
If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the offer, as appropriate.
Any cost associated with accessing the offer website is the claimant's responsibility and is dependent on the Internet service provider used. The Promoter makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Promotion.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any claim, original purchase documentation or gift that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a gift.
The Promoter collects personal information in order to conduct the offer and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required, to Australian regulatory authorities. Claim is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. Claimants should direct any request to access, update or correct information to the Promoter. All claims become the property of the Promoter.
