PROMOTION TERMS & CONDITIONS


Please read these Promotion terms and conditions (“Terms and Conditions”) carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate in this Promotion.


These Terms and Conditions will govern the redemption of your Gift Card. Please refer to this website for the current Terms and Conditions for this Promotion: http://www.samsung.com/za/offer.


All participants during the term of this Promotion agree to be bound by the following terms and conditions:


  1. Promotion:
    The Samsung QLED TV Launch Offer (“Promotion”) .The promoter of the Promotion is Samsung Electronics South Africa (Proprietary) Limited, Registration number: 1994/003872/07 and/or its agencies ("Organiser").

  2. Promotion Period:
    • 2.1
      The Promotion will run from Monday 22nd May 2017 [00h01] to Sunday 2nd July 2017 [23.59] whilst stocks last (“the Promotion Period”).
    • 2.2
      The duration of the Promotion may be extended or curtailed at the discretion of the Organiser.
    • 2.3
      Promotion is valid while stock lasts.

  3. Who may enter:
    • 3.1
      All participants must:
      1. be citizens of the Republic of South Africa and/or a legal resident of the aforesaid country,
      2. be currently residing in the Republic of South Africa at the date of the commencement of the Promotion Period,
      3. be a natural person and be at least 18(eighteen) years old at the date of the commencement of the Promotion Period,
      4. have a valid South African TV license.

  4. How to qualify for the Promotion:
    • 4.1
      The Promotion will afford the participant to receive these 3 (three) value adds and the participant needs to do the following to redeem these offers as also described in clause 6:
      1. For the Gift Card pre-loaded up to the value of R 7,500 for the purchase of any QLED TV during the promotional period according to these Gift Amounts per model:

        Step 1:
        Purchase any QLED TV model through any participating retailer during the promotional period.
        Step 2:
        (1) For non-Samsung mobile users: Participant enters www.samsungqled.awards.co.za and registers in the following details (these details need to be fully uploaded and received by the Organiser’s third party by 23.59 on Saturday 15 July 2017):
        - Participant’s Name
        - Participant’s Email Address
        - Participant’s Contact Number
        - Participant’s Delivery Address
        - Participant’s ID Number
        - TV Serial Number/s
        - TV Model Number/s
        - Quantity of each model purchased
        - Upload Proof of Purchase image
        - Upload Serial Number image
        (2) For Samsung mobile users not with S8/S8+ either enter the website above or participant enters Samsung Rewards to register the same details as requested above in Step 2 (1) on the web portal provided therein (these details need to be fully uploaded and received by the Organiser’s third party by 23.59 on Saturday 15 July 2017). The participant must have downloaded the Samsung Rewards application from the Google Play Store and be a registered subscriber of the Samsung Rewards service managed by the Organiser.
        Step 3:
        The Organiser’s third party call centre then verifies the participant’s proof of purchase and serial number against the participating retailer list and the Organiser’s serial number database within 5 working days of the participant uploading onto the website. Should the participant need to contact the Organiser’s third party call centre, the participant can call 0860 739 273. Should there be a legibility problem or any other information requirement that is not fully uploaded, the Organiser’s third party call centre will contact the participant during office hours by the very latest, close of business on Saturday, 15 July 2017.
        Step 4:
        The participant will be sent an email notification of the successful validation to notify that the Gift Card will be couriered to their delivery address within 5 days of the validation email notification.

      2. For the second Gift Card pre-loaded up to the value of R 7,500 for the purchase of any Samsung Galaxy S8 or S8+ on prepaid or contract through any Samsung Galaxy S8 or S8+ retailer / dealer / network, purchased in South Africa between the 22nd of May and on or before 23.59 on Sunday 2 July 2017 with the simultaneous purchase of any QLED TV during this promotional period according to these Gift Amounts per model:

        Therefore for both Gift Cards, the following total amount will be provided to the participant based on successful fulfilment:

        Step 1:
        Participant purchases any QLED TV during the promotional period and enters Samsung Rewards or www.samsungqled.awards.co.za register the following details on the web portal provided therein (these details need to be fully uploaded and received by the Organiser’s third party by 23.59 on Saturday 15 July 2017):

        - Participant’s IMEI Number
        - Quantity of phones
        - TV Serial Number/s

        - Upload Serial Number image
        The participant must have downloaded the Samsung Rewards application from the Google Play Store and be a registered subscriber of the Samsung Rewards service managed by the Organiser. No claims for any S8/S8+ Devices purchased after 2 July 2017 will be accepted or processed.
        Step 2:
        The Organiser’s third party call centre then verifies the participant’s proof of purchase and serial number against the participating retailer list and the Organiser’s serial number database within 5 working days of the participant uploading onto the website. Should the participant need to contact the Organiser’s third party call centre, the participant can call 0860 739 273. Should there be a legibility problem or any other information requirement that is not fully uploaded, the Organiser’s third party call centre will contact the participant during office hours by the very latest, close of business Saturday, 15 July 2017.
        Step 3:
        The participant will be sent an email notification of the successful validation to notify that the Gift Card will be couriered to their delivery address within 5 days of the validation email notification.
        Note: The double Gift Card is based on 1 (one) applicable mobile phone per TV purchased and will be based on the higher valued TV purchased [for example, if the participant chooses 5 QLED TVs and purchases these 5 with the 1 (one) applicable mobile device during the promotional period, the Gift Card amount correlating to the highest valued TV will be paid out].

      3. For the exclusive retailer-specific gift in-store / online, this Samsung product will be provided by the retailer, directly to the participant upon purchase of the QLED TV during the promotional period.

  5. Can I qualify more than once for the Promotion:
    • 5.1
      The Promotion is limited to 1 (one) Gift Card per valid QLED TV purchased and 1 (one) Double Gift Card per valid S8/S8+ device purchased (unique IMEI) if both products are purchased during the Promotional Period; should there be any dispute in this regard, the Organiser shall be sole adjudicator of the dispute and the Organiser’s decision shall be final.

  6. Offer:
    • 6.1
      The Promotion will afford the participant the opportunity to receive these 3 (three) value adds should each value add’s requirements be met:
      1. A Gift Card which is a Mastercard with a Gift amount pre-loaded up to the value of R 7,500 for the purchase of any QLED TV during the promotional period – this Gift Card will be delivered to the participant following the compulsory verification and fulfillment process as outlined in clause 4 above.
      2. Another Gift Card which is a Mastercard with a Gift amount pre-loaded up to the value of R 7,500 for the purchase of any Samsung Galaxy S8 or S8+ on prepaid or contract through any Samsung Galaxy S8 or S8+ retailer / dealer / network, purchased in South Africa between Monday 22nd May and before 23.59 on Sunday 2 July – this Gift Card will be delivered to the participant following the compulsory verification and fulfillment process as outlined in clause 4 above.
      3. The exclusive retailer-specific gift in-store / online which will be provided by the retailer, directly to the participant upon purchase of the QLED TV during the Promotional Period.
    • 6.2
      The Gift Card and the exclusive retailer-specific gift in-store are not transferable. No substitution, cash redemption, or assignments of the Gift Card or product provided are permitted.

  7. Terms of Delivery:
    • 7.1
      Delivery of the Gift Card will occur within 5 (five) working days of the purchase being verified, to the participant’s delivery address specified by the participant through the Samsung redemption website or Rewards application.
    • 7.2
      If the verification process is unsuccessful (relating to information not provided / vague proof of purchase / serial number visibility etc.), the participant will be contacted on the contact number provided during the verification process by the Organiser’s outsourced third party’s contact centre to request further information needed if required. In the event that the participant is unreachable after 3 (three) attempts to contact the participant on the contact number provided over a period of 10 (ten) working days, the Gift Card shall be forfeited.
    • 7.3
      Delivery of the Gift Card will occur by way of courier and the Organiser does not accept any responsibility for late/non arrivals.
    • 7.4
      In the event that the participant is unreachable or fails to claim the Gift Card after 3 (three) attempts to deliver over a period of 10 (ten) working days, the Gift Card shall be forfeited.
    • 7.5
      The Participant needs to present a valid identity document at the time of delivery of the Gift Card.
    • 7.6
      Deliveries will only be made within the borders of the Republic of South Africa.
    • 7.7
      Deliveries will occur from Monday to Friday during regular office hours (08h00 to 17h00) and no deliveries will be made on public holidays or over the weekends.

  8. Limitation of Liability:
    • 8.1
      To the extent permitted by Consumer Protection Act and any other applicable law:
      1. The participant(s) hereby indemnifies the Organiser against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participant’s entrance to the Promotion.
      2. The Organiser excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).

  9. General:
    • 9.1
      In accordance with the confidentiality policies and practices of the Organiser, none of the entry details of any participant in this Promotion will be disclosed or used by the Organiser for any purposes other than for entry into the Promotion and in accordance with clause 9.3 below.
    • 9.2
      The participant is bound by the Samsung Rewards Application Terms and Conditions, where more specifically, only one account per device is permitted to be registered for use of the Samsung Rewards Application. Should there be any dispute in this regard, the Organisers shall be sole adjudicator of the dispute and the Organisers decision shall be final.
    • 9.3
      The Samsung Rewards Application is downloadable from Google Play Store and it is supported on the following Samsung smartphones, of which may be updated from time to time;

    • 9.5
      Participants acknowledge and accept that the Organiser shall utilise a third party (the “Organiser’s authorized agent/s”) to contact the participant to arrange delivery of the Gift Card. In order to affect the contacting and delivery process, the Organiser’s shall provide the participant’s information to such third party.
    • 9.6
      Details of participants will not be used by the Organiser for Samsung related communication should the participants opt-out to receive further communication from the Organiser.
    • 9.7
      Information regarding the Promotion that is published on authorized advertising material will also form part of the terms and conditions of the Promotion.
    • 9.8
      The Organiser’s may in their sole discretion amend these terms and conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised terms and conditions on the Organiser’s website http://www.samsung.com/za/offer. The onus rests on the participant to constantly check the website for updates to the terms and conditions.
    • 9.9
      The Organisers reserve the right, at any time, to verify the validity of participants (including a participant’s identity, age and place of residence) and to reject any participant who has not agreed to these Terms and Conditions. Errors and omission may be accepted at the Organiser's discretion. Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights.
    • 9.10
      If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organiser, including but not limited to technical difficulties, unauthorized intervention or fraud, the Organiser reserve the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion as appropriate, subject to the approval of relevant regulatory authorities.
    • 9.11
      Save as permitted by Law, the Organiser reserves the right to cancel, suspend or terminate this Promotion, without notice at any time, and such cancellation, termination or termination shall be deemed to have taken effect from the date of publication on the Organiser’s website http://www.samsung.com/za/offer. No liability shall lie against the Organiser in favour of any participant, winner(s) and/ or third party arising from such cancellation, suspension or termination. Therefore the participant waives his/her right which they may have against the Organiser and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Organiser.
    • 9.12
      This Promotion is governed by these terms and conditions, as well as those of the relevant authorized participating stores, associated with this Promotion.
    • 9.13
      Any dispute or claim arising out of or in connection with the Promotion shall be governed by and construed in accordance with the laws of South Africa.
    • 9.14
      To the extent that these terms and conditions conflict with the terms and conditions of Samsung Rewards application, these terms and conditions will take precedence.
    • 9.15
      The Organiser accepts no liability or responsibility, whether occasioned by any circumstance not foreseeable and not within its reasonable control for late or delayed delivery of the Gift Card owing to, but not limited to, stock unavailability, strike, lock out, destruction of the Gift Card on route by any means, any civil commotion or disorder, riot, threat of war, any action taken by governmental authority or public authority of any kind, fire, explosion, storm, flood, earth quake or other acts of God.
    • 9.16
      If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable:
      1. It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;
      2. It will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
