LOYALTY PROGRAM REWARD SCHEME SAMSUNG BUSINESS REWARD SCHEME TERMS
Effective 1 May 2017 (Last Updated 18 April 2018)

1. Introduction

1.1 This Loyalty Program Reward Scheme ("Samsung Business Reward Scheme") is an offer to Members to earn 3 Qantas Points for every dollar spent by that Member on Eligible Products. The Reward Scheme is governed by:
1.1.1 the Qantas Business Rewards Program Terms and Conditions, which are available at www.qantasbusinessrewards.com/terms ("Qantas Business Rewards Terms"); and
1.1.2 these Loyalty Program Reward Scheme Terms and Conditions ("Samsung Business Reward Scheme Terms").
1.2 Participation in this Reward Scheme constitutes acceptance of these Samsung Business Reward Scheme Terms.
1.3 In the event of any inconsistency between the Qantas Business Rewards Terms and Conditions and these Samsung Business Reward Scheme Terms, the Qantas Business Rewards Terms prevail.
1.4 The Reward Scheme commences at 5:00am (AEST) on Monday, 1 May 2017 and continues until the earlier of (i) 60 days after the Program Partner gives notice to Members that the Reward Scheme is terminating; or (ii) the Qantas Business Rewards Program terminates, in which case the Reward Scheme terminates immediately.

2. Definitions
2.1 For the purposes of these terms and conditions:
(a) "C Grade Product" means a product that is refurbished for sale after prior use;
(b) "Eligible Product" means a new Samsung branded product supplied by Samsung in Australia and sold directly by Samsung or by an Australian retailer or a retailer that delivers to Australia (either online or in store), which is authorised by Samsung to sell products, but excludes:
i. a Samsung phone purchased as part of a mobile phone plan;
ii. a Samsung product purchased through a retailer selling non-Australian Samsung stock; and
iii. C Grade Products or "seconds" product, second-hand, refurbished or demonstration products;
iv. installation, insurance, warranty or extended warranty, financing, delivery or any other product which is, at the determination of the Program Partner in its absolute discretion, additional or ancillary to the purchase;
v. any products not purchased by the end user, meaning the purchaser must purchase the product for their own use and not for resale, resupply, rental or hire-purchase including distribution or sale to end users, or which are later resold as new stock.
(c) "Member" means a business that is a member of Qantas Business Rewards;
(d) “Missing Qantas Points” means Qantas Points that have not been received by a Member after the successful validation of an Eligible Claim in accordance with Clause 6;
(e) "Program Partner" or "Samsung" means Samsung Electronics Australia Pty Ltd ABN 63 002 915 648 of 3 Murray Rose Avenue, Sydney Olympic Park, NSW 2127;
(f) "Qantas Business Rewards" means the loyalty program described on the website www.qantasbusinessrewards.com (also accessible by qantas.com/business) and known as Qantas Business Rewards, or any replacement program;
(g) "Qantas Business Rewards Membership Account" means the account held by a Member in respect of their Qantas Business Rewards membership;
(h) "Qantas Business Rewards Membership Number" means the business’ ABN nominated in respect of a Qantas Business Rewards Membership Account;
(i) "Qantas Frequent Flyer Program Terms and Conditions" means the terms and conditions of the Qantas Frequent Flyer program issued by Qantas and as amended by Qantas from time to time, available at qantas.com/terms.
(j) "Qantas Points" means Qantas Points for business which may be accrued by a Member, held to the credit of their Qantas Business Rewards Membership Account and transferred in accordance with the Qantas Business Rewards Terms; and
2.2 Unless the context requires otherwise, terms used but not defined in these Samsung Business Reward Scheme Terms have the meaning given to those terms in the Qantas Business Rewards Program Terms and the Qantas Frequent Flyer Program Terms and Conditions.

3. Privacy
Samsung and its agents collect personal information in order to conduct the Reward Scheme and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, offer suppliers and, as required, to Australian regulatory authorities. Validity of an Eligible Claim (as defined in Clause 5.1) is conditional on providing this information. Samsung and its agents may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning a claimant. Claimants acknowledge that the information they provide will be collected by or on behalf of Samsung and may be disclosed to other group companies and to third parties that help Samsung deliver its products and services (including suppliers, contractors, dealers, agents and business partners) or as required by law. Some of these parties may be located outside of Australia, including in Singapore, Korea and the Philippines. Claimants acknowledge that by giving consent to the disclosure of personal information to the overseas recipients, Samsung will not have an obligation to take reasonable steps to ensure that these overseas recipients do not breach Australian privacy law in relation to that information. In particular, claimants acknowledge that in providing consent, Samsung will not be accountable under the Privacy Act 1988 (Cth) and the claimant will not be able to seek redress under the Privacy Act 1988 (Cth). However, where practicable in the circumstances, Samsung will take reasonable steps to ensure that overseas recipients use and disclose such information in a manner consistent with Samsung’s privacy policy. Claimants should direct any request to access, update or correct information to Samsung’s Privacy Officer at the details provided below. These Samsung Business Reward Scheme Terms are deemed to incorporate Samsung's privacy policy and by claiming under the Reward Scheme (whether or not as an Eligible Claimant), each claimant accepts the terms and conditions of Samsung's privacy policy. 4. Changes to Reward Scheme
4.1 The Program Partner may amend the Samsung Business Reward Scheme Terms and/or the Qantas Points offered in relation to Eligible Products from time to time, by providing notice to Members by email.

5. Earning Qantas Business Rewards Benefits
5.1 To be eligible to claim Qantas Points, a claimant must:
5.1.1 be a current Member and have an active Qantas Business Rewards Membership Account, subject to clause 9.2;
5.1.2 purchase an Eligible Product and retain the original tax invoice in respect of that purchase; and
5.1.3 within 6 months of purchasing an Eligible Product, visit https://samsung-redemption.com/au or any other website, app or portal that Samsung directs the claimant to ("Website") and follow all Samsung’s prompts and instructions which may include asking the claimant to do any of the following:
(a) In the first instance, register an account in their business capacity;
(b) follow the prompts on the Website and to the online claim form ("Online Claim Form") and input the all requested details which may include, without limitation, the claimant’s full name, contact telephone number, ABN, email address, business address and Qantas Business Rewards Membership Number;
(c) upload a copy of the original tax invoice obtained in respect of the Eligible Product, in the form and manner specified by Samsung ;
(d) input or upload the serial or other identifying number of the Eligible Product in the manner specified by Samsung, which may include uploading a photo or screenshot of that serial or other identifying number; and
(e) submit the completed Online Claim Form,
(each eligible claim, an "Eligible Claim" and each eligible claimant, an "Eligible Claimant").
5.2 A Member is not an Eligible Claimant and may not participate in this Samsung Business Reward Scheme if the business:
(a) has its principal place of business outside Australia;
(b) is a re-seller (which includes a retailer) of Samsung products; or
(c) purchases Eligible Products through an enterprise agreement.
5.3 It is the responsibility of the Member to check whether a product or other activity is eligible to earn Qantas Points through Qantas Business Rewards, and if so how many Qantas Points or which other Qantas Business Rewards benefits will be earned, before making a purchase or undertaking the relevant activity.

6. Validation of claims
6.1 The Program Partner will, to the extent it believes necessary in its sole discretion, ensure that information provided in accordance with 5.1.3 is valid.
6.2 Samsung may require a claimant to provide further information or documents to validate a claim, including where a claimant has provided invalid or illegible information such as a serial number or tax invoice. Samsung will inform claimant of this requirement by email. The claimant will have until fourteen (14) days after notification to provide this information in the manner specified by Samsung. Samsung may at its absolute discretion invalidate a claim if the claimant fails to provide the required information within the fourteen (14) day period.
6.3 Once a claimant’s claim has been validated in accordance with clause 6.1, the Program Partner will contact the Eligible Claimant by email to confirm that their Eligible Claim was successful. Qantas will then, within 30 days of that notification email, credit the Membership Account of the Eligible Claimant with the Qantas Points earned in respect of the Eligible Product purchased
6.4 Qantas Points will not be awarded in respect of any costs, fees, expenses or liability of any description to pay any amount for installation, insurance, warranty or extended warranty, financing, delivery or any other product or cost which is, at the determination of the Program Partner in its absolute discretion, additional or ancillary to the purchase of the Eligible Product.

7. General
7.1 If an Eligible Product submitted as part of a claim is returned for a refund or exchange, that claim is disqualified from this Reward Scheme and the claimant who made that claim is not entitled to receive Qantas Points. If the Eligible Product submitted as part of a claim is returned for a refund or exchange and the claimant has already received Qantas Points as part of their Eligible Claim, Qantas may reclaim those Qantas Points from the claimant without compensation to the claimant.
7.2 If a claimant is not a Member at the time of purchasing an Eligible Product, that claimant may become a Member by visiting www.qantasbusinessrewards.com/samsungfree and following the prompts.
7.3 Claims for the crediting of Missing Qantas Points in Qantas Business Rewards retrospectively must be made by the Member to the Program Partner within 60 days of the confirmation of a successful Eligible Claim. Unless otherwise specified by Qantas Business Rewards, claims for the crediting of Missing Qantas Points cannot be made if the Membership is not current or if the Membership Account was not active at the time the Eligible Claim was submitted.
7.4 The Program Partner may, at any time, verify the validity of claims and claimants and disqualify any claimant who does not comply with the Qantas Business Rewards Terms and/or these Samsung Business Reward Scheme Terms, who tampers with the claim process, or who is not otherwise an Eligible Claimant. Errors or omissions may be accepted in the Program Partner's absolute discretion.
7.5 The Program Partner may offer additional opportunities to earn Qantas Points in Qantas Business Rewards under a special promotion from time to time.
7.6 Qantas Points will be credited only to the Qantas Business Rewards Membership Account of the Member that purchased the Eligible Product in respect of which an Eligible Claim is made.
7.7 Failure by the Program Partner to enforce any of its rights at any stage does not constitute a waiver of those rights.
7.8 Any cost associated with this Reward Scheme and with making a claim is each claimant’s responsibility. The Program Partner makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with a claimant’s ability to participate in this Reward Scheme.
7.9 Subject to clause 9.11, each claimant releases the Program Partner (including its officers, employees and agents) from all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Reward Scheme, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Program Partner’s control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Program Partner) due to any reason beyond the reasonable control of the Program Partner; (d) any changes (whether material or otherwise) to Qantas Frequent Flyer redemption rates ; (e) any claim, loss, cost or expense in connection with Qantas Points or any tax liability incurred by a claimant; or (f) any use of Qantas Points.
7.10 Nothing in these Samsung Business Reward Scheme Terms is intended to exclude, restrict or modify any consumer rights under the Competition and Consumer Act 2010 (Cth) ("CCA") or any other legislation which may not be excluded, restricted or modified by agreement. If the CCA or any other legislation implies a condition, warranty or term into the Samsung Business Reward Scheme Terms or provides statutory guarantees in connection with these Samsung Business Reward Scheme Terms, in respect of goods and services supplied (if any), the Program Partner's liability for breach of such a condition, warranty, other term or guarantee is limited (at the Program Partner's election) to the extent it is able to do so: (a) in the case of supply of goods, the Program Partner doing any one or more of the following: (i) replacing the goods or supplying equivalent goods; (ii) repairing the goods; (iii) paying the cost of replacing the goods or of acquiring equivalent goods; and/or (iv) paying the cost of having the goods repaired; or (b) in the case of supply of services, the Program Partner doing either or both of the following: (i) supplying the services again; and/or (ii) paying the cost of having the services supplied again.
7.11 These Samsung Business Reward Scheme Terms are governed by the laws of New South Wales. Claimants submit to the non-exclusive jurisdiction of the courts of New South Wales.
7.12 The Program Partner recommends that claimants consult their accountant or tax adviser to ensure that they understand possible tax (including fringe benefits tax) implications, if any, related to their earning and use of Qantas Points.

Qantas Business Rewards Bonus Points Offer


~A business must be a Qantas Business Rewards Member to earn Qantas Points for business. A one-off join fee of $89.50 including GST normally applies but will be waived for Samsung customers that join before 30 August 2018. Membership and Qantas Points are subject to Qantas Business Rewards Terms and Conditions. Qantas Points for business are offered under the Samsung Terms and Conditions. To earn 5,000 bonus Qantas Points, a business must (a) join Qantas Business Rewards by 11:59pm (AEST) 30 August 2018 (b) spend with any Qantas Business Rewards program partner for the first time between 1 August 2018 and 11:59pm (AEST) 30 September 2018 and have a minimum of 500 Qantas Points credited to your Qantas Business Rewards account before 11:59pm (AEST) 31 December 2018. Members earn 3 Qantas Points per every $1 spent with Samsung therefore if $167 is spent, 500 Qantas Points will be earned. Qantas Points will be credited to the Members' Qantas Business Rewards account within 30 days of the email notifying Eligible Claimants of a successful Eligible Claim. Bonus Qantas Points may take up to 12 weeks to be credited to your Qantas Business Rewards account up to a maximum of 5,000 bonus points per Qantas Business Rewards account.
