Terms and Conditions for “HK$600 Octopus Top-up Value Promotion”(Applicable to customer who purchase Galaxy Note9 from Feb 1. to Feb 28. 2019):

  1. The “HK$600 Octopus Top-up Value for Galaxy Note9 Customers Promotion” (this “Promotion”) is organized by Samsung Electronics Hong Kong Co. Ltd (“Samsung”) and is open to customers who enrolled Samsung’s Samsung Pay pursuant to Samsung’s Samsung Pay Terms of Service (collectively, “Samsung Pay Customers”, each, “Samsung Pay Customer”).
  2. The promotion period of this Promotion (the “Promotion Period”) is between 1 February 2019 and 28 February 2019 (both dates inclusive).
  3. By participating in this Promotion, each Samsung Pay Customer agrees to be bound by these Terms and Conditions set out herein. Samsung reserves the right to amend these Terms and Conditions, suspend or terminate this Promotion, in whole or in part, at any time, without prior notice.
  4. Smart Octopus is issued by Octopus Cards Limited (“OCL”) subject to the Conditions of Issue of Octopus published by OCL.
  5. OCL’s Privacy Policy, Conditions of Issue of Octopus, Terms of Use of Octopus Mobile App and other terms and conditions of use, published by OCL at www.octopus.com.hk as amended from time to time, shall apply to this Promotion.
  6. The $600 Octopus Top-up Value (“Reward”) is only applicable to the first 5,000 customers who have satisfied the requirements set out in this clause,
    (i) Customers should, during the Promotion Period, purchase a new Samsung Galaxy Note9 from an authorized dealer in Hong Kong (“Eligible Device”);
    (ii) Customer should install and register Samsung Pay to his/her Eligible Device, and successfully add a valid Smart Octopus (the “Eligible Smart Octopus”) in Samsung Pay of his/her Eligible Device;
    (iii) Customers must complete registration on designated reward registration website within 14 days of purchase with uploading a receipt issued by a designated retailer. No re-submission will be accepted thereafter; and
    (iv) During the registration, customer must input the model or IMEI of the Eligible Device, and provide the number of his/her Eligible Smart Octopus on designated reward registration website. Eligible Device must be genuine product purchased from Hong Kong authorized dealers or mobile telecommunication network providers.
  7. Samsung Pay Customer, who has never registered for “Cathay Pacific Round-Trip Osaka Air Ticket Promotion”, can either select this Reward or “Premier Set Menu (2 persons) at Café ÉPURE / DALLOYAU Promotion” from the registration webpage. No amendments or cancellations will be accepted once the registration is completed.
  8. Samsung Pay Customer who has already registered for “Premier Set Menu (2 persons) at Café ÉPURE / DALLOYAU Promotion” will not be eligible to select this Reward.
  9. Any Smart Octopus which is added to any Eligible Device without using Samsung Pay, or any unsuccessful addition of Smart Octopus shall not be considered as an Eligible Smart Octopus.
  10. Each Samsung Pay Customer can only register for the Rewards twice. If the same Samsung Pay Customer has registered for more than two times, only the two earliest registered smartphones will be treated as valid (subject to time of registration).
  11. Each Eligible Device can be registered on the designated reward registration website for the Rewards for only once. Registration will be deemed as invalid and forfeited in the event of failing to register on the designated reward registration website within the specified period, or any registered information is incorrect or missing for whatever reason.
  12. To collect the Rewards, each Winner is required to register his/her Eligible Smart Octopus in the Octopus App, a mobile application operated by OCL. Winners will be notified by push notification through the Octopus App between 29 January 2019 and 29 March 2019 (both dates inclusive) that the Rewards will be available for collection in two parts each with HK$300 Octopus Top-up Value through the Octopus App onto his/her said Eligible Smart Octopus.
  13. Each Winner is required to collect the Rewards on or before 30 April 2019. The Rewards will be forfeited automatically without notice if the Winner fails to collect the Rewards on or before the aforesaid date, or the said Eligible Smart Octopus of the Winner has been suspended, cancelled or terminated or is no longer valid for whatever reason(s), which, under no circumstance shall any claim be made against Samsung and/or OCL whatsoever. Neither Samsung nor OCL shall bear any liability whatsoever if any Winner fails or is unable to collect the Rewards under whatever circumstances, including, but not limited to, reset of Samsung Pay application, Eligible Smart Octopus has been transferred to device other than the Eligible Device, suspension, cancellation or termination of Eligible Smart Octopus for whatever reason, lost Eligible Device, or device reset due to factory data reset or Find My Mobile service.
  14. Only one Winner of each Eligible Device is entitled to the Rewards and for once only.
  15. Samsung makes no guarantee of the availability of its web services or Samsung Pay application and will not be held responsible for interruption of service that may interfere with the ability to participate in this Promotion. OCL makes no guarantee of the availability of the Octopus App and will not be held responsible for interruption of service that may interfere with the ability to participate in this Promotion.
  16. Samsung reserves the right to disqualify any Samsung Pay Customer suspected of fraud, or if Samsung believes that Samsung Pay Customer’s participation of this Promotion have been manipulated in any way by machines or computers.
  17. By participating in this Promotion, each Samsung Pay Customer understands and agrees that any personal information provided in connection with this Promotion and/or the Rewards (including but not limited to the number of the Eligible Smart Octopus, his/her mobile number and the copy of the official sales receipt and credit card or other electronic payment slips (if applicable) as proof of purchase of his/her Eligible Device) will be collected, used and retained by Samsung for the purpose of (i) verifying his/her eligibility and identity, (ii) notifying Samsung Pay Customer of the redemption of the Rewards, and (iii) carrying out any enquiries or resolving any disputes in relation to this Promotion, and such personal information will not be disclosed to any other party or used for any other purposes without his/her consent. Samsung Pay Customer further acknowledges that Samsung will collect and use his/her personal information in accordance with the requirements of Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong) and Samsung’s Privacy Policy.   18. By participating in this Promotion, each Samsung Pay Customer further agrees that Samsung shall be entitled to transfer the number of his/her Eligible Smart Octopus to OCL who may use the information for the purpose of fulfillment of the Rewards (including sending of push notification to his/her Eligible Device regarding collection of the Rewards under this Promotion).
  19. Information collected or received as aforesaid by Samsung solely for the purpose of this Promotion and by OCL solely for the purpose of fulfillment of the Rewards under this Promotion will be retained for 6 months after the end of the Promotion Period (“retention period”) and will be destroyed on expiry of the retention period.
  20. The Rewards cannot be exchanged for cash, other products, services or discounts.
  21. Samsung reserves the right to amend these Terms and Conditions at any time without prior notice. In the event of any dispute arising from this Promotion, the decision of Samsung shall be final.
  22. We have provided a Chinese language translation of these Terms and Conditions for reference. If there is any inconsistency between the English and Chinese versions, the English version shall prevail.
  23. No person other than Samsung Pay Customers, Samsung and OCL will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provision of these Terms and Conditions.

  1. Premier Set Menu (2 persons) at Café ÉPURE / DALLOYAU Promotion (this “Promotion”) is organized by Samsung Electronics Hong Kong Co, Ltd (“Samsung”) and is available to each customer who purchased a Samsung Galaxy Note9 between 1 February 2019 and 28 February 2019 (“Promotion Period”) from any authorized dealer in Hong Kong (each an “Eligible Customer”)
  2. By participating in this Promotion, each Eligible Customer agrees to be bound by these Terms and Conditions. Samsung reserve the right to amend these Terms and Conditions at any time, with or without prior notice.
  3. Each Eligible Customer must complete the registration on a designated website to get a voucher of Premier Set Menu (2 persons) at Café ÉPURE / DALLOYAU (“Voucher”). The Voucher is provided by Gourmet Dining Group (“Gourmet”) and its relevant terms and conditions apply.
  4. Each Eligible Customer must complete the registration on a designated website within 14 days from the purchase date of Galaxy Note9. Eligible Customer must provide the IMEI number of the newly purchased Galaxy Note9 and upload a receipt issued by a designated retailer to the designated registration website. Eligible Customer who completed the registration will receive a Voucher from his/her registered email
  5. Eligible Customer, who has never registered for “HK$600 Octopus Top-up Value for Galaxy Note9 Customers Promotion”, can either select this Voucher or “HK$600 Octopus Top-up Value for Galaxy Note9 Customers Promotion” from the registration webpage. No amendments or cancellations will be accepted once the registration is completed.
  6. Eligible Customer who has already registered for “HK$600 Octopus Top-up Value for Galaxy Note9 Customers Promotion” will not be eligible to select this Voucher.
  7. Eligible Customer can only be registered for redemption of the Voucher once. If the same Eligible Customer has registered for more than one time, only the earliest registered smartphone will be treated as valid (subject to time of registration).
  8. Only 600 quotas are available on a first come, first served basis while stocks last.
  9. Eligible Customer is required to ensure that all information provided on the registration website is true and correct. The Voucher will be forfeited without any compensation if, such information is incomplete or incorrect, or Eligible Customer fails or unable to complete registration within the designated period for whatever reason. Eligible Customer shall, under no circumstance, make any claim against Samsung or Gourmet whatsoever, and Samsung and Gourmet shall not bear any liability whatsoever.
  10. The Voucher is valid between 1 February 2019 and 31 May 2019 for lunch and dinner period at Café ÉPURE, as well as lunch (weekend and public holidays only) and dinner period at DALLOYAU Pacific Place.
  11. The Voucher is not applicable on the following dates, 5-7, 14 February, and 12 May 2019.
  12. Please refer to Voucher to make reservation at least three days in advance. Please indicate the use of this Voucher along with the reference number on the Voucher when reserving via +852 3185 8331 (Café ÉPURE) or +852 3185 8391 (DALLOYAU Pacific Place).
  13. The Voucher is applicable for the designated 3-course set menu for two persons only. The Voucher does not include the 10% service charge; Eligible Customers are required to pay the 10% service charge of the 3-course set menu at their own costs (HK$128net per set) at the restaurant.
  14. Samsung reserves the right to disqualify any Eligible Customer for the Voucher where it has reasonable grounds to believe that Eligible Customer has violated any of these Terms and Conditions or any instructions and/or requirements of this Promotion, or that Eligible Customer may have gained an unfair advantage by participating in this Promotion or redeemed the Voucher using fraudulent means.
  15. The Voucher cannot be transferred or sold, cannot be exchanged for cash or other offers, and cannot be used in conjunction with other promotions. Samsung reserve the right to change or substitute the Voucher with other offer(s) of a comparable or equivalent value as it deems fit.
  16. Except where expressly provided herein, Eligible Customer shall bear his/her own costs and expenses incurred in relation to or resulting from this Promotion and/or the Voucher, including but not limited to, food and beverage charge out of designated 3-course set menu for two persons, 10% service charge, and no reimbursement may be sought from Samsung.
  17. Samsung is not supplier of Voucher. Under no circumstance shall Samsung bear any liability relating to any aspect of the Voucher whatsoever, including but not limited to, the quality, supply or the description of the Voucher.
  18. Samsung makes no guarantee of the availability of this Promotion registration website or its web services; Samsung will not be held responsible for interruption of service that may interfere with the ability to participate in this Promotion and/or the Voucher.
  19. Samsung and hutchgo.com reserve the right in its sole discretion to take any action that is deemed appropriate if, for whatever reasons, Samsung is not capable of performing this Promotion and/or Voucher redemption, including but not limited to computer system defects, virus infection, hacking, technical failure and/or any force majeure reason.
  20. To the extent permitted by law, Samsung shall not be liable for any and all loss, including but not limited to any liability (including negligence), any personal injury, or any loss or damage (including loss of income, profit, loss of opportunity, etc.), whether direct, indirect, special, consequential or otherwise, arising in any way out of or relating to this Promotion.

  23. These Terms and Conditions and any claim or dispute arising in connection with these Terms and Conditions, the Promotion and the Voucher shall be governed by and construed in accordance with the laws of the Hong Kong SAR, without regard to its conflict or choice of law provisions; and the parties agree to the exclusive jurisdiction of the courts of the Hong Kong SAR.
  24. A Chinese version of these Terms and Conditions is provided for reference only. If there is any inconsistency between the English and Chinese versions, the English version shall prevail.
  25. The names of all other companies and products may be the trademarks owned by the various related companies.
  26. In the event of any dispute, Samsung’s decision shall be final.

Winners will be notified by push notification through the Octopus App between 29 January 2019 and 29 March 2019 (both dates inclusive) that the Rewards will be available for collection in two parts each with HK$300 Octopus Top-up Value through the Octopus App onto his/her said Eligible Smart Octopus.
  11. Each Winner is required to collect the Rewards on or before 30 April 2019. The Rewards will be forfeited automatically without notice if the Winner fails to collect the Rewards on or before the aforesaid date, or the said Eligible Smart Octopus of the Winner has been suspended, cancelled or terminated or is no longer valid for whatever reason(s), which, under no circumstance shall any claim be made against Samsung and/or OCL whatsoever. Neither Samsung nor OCL shall bear any liability whatsoever if any Winner fails or is unable to collect the Rewards under whatever circumstances, including, but not limited to, reset of Samsung Pay application, Eligible Smart Octopus has been transferred to device other than the Eligible Device, suspension, cancellation or termination of Eligible Smart Octopus for whatever reason, lost Eligible Device, or device reset due to factory data reset or Find My Mobile service.
  12. Only one Winner of each Eligible Device is entitled to the Rewards and for once only.
  13. Samsung makes no guarantee of the availability of its web services or Samsung Pay application and will not be held responsible for interruption of service that may interfere with the ability to participate in this Promotion. OCL makes no guarantee of the availability of the Octopus App and will not be held responsible for interruption of service that may interfere with the ability to participate in this Promotion.
  14. Samsung reserves the right to disqualify any Samsung Pay Customer suspected of fraud, or if Samsung believes that Samsung Pay Customer’s participation of this Promotion have been manipulated in any way by machines or computers.
  15. By participating in this Promotion, each Samsung Pay Customer understands and agrees that any personal information provided in connection with this Promotion and/or the Rewards (including but not limited to the number of the Eligible Smart Octopus, his/her mobile number and the copy of the official sales receipt and credit card or other electronic payment slips (if applicable) as proof of purchase of his/her Eligible Device) will be collected, used and retained by Samsung for the purpose of (i) verifying his/her eligibility and identity, (ii) notifying Samsung Pay Customer of the redemption of the Rewards, and (iii) carrying out any enquiries or resolving any disputes in relation to this Promotion, and such personal information will not be disclosed to any other party or used for any other purposes without his/her consent. Samsung Pay Customer further acknowledges that Samsung will collect and use his/her personal information in accordance with the requirements of Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong) and Samsung’s Privacy Policy.   16. By participating in this Promotion, each Samsung Pay Customer further agrees that Samsung shall be entitled to transfer the number of his/her Eligible Smart Octopus to OCL who may use the information for the purpose of fulfillment of the Rewards (including sending of push notification to his/her Eligible Device regarding collection of the Rewards under this Promotion).
  17. Information collected or received as aforesaid by Samsung solely for the purpose of this Promotion and by OCL solely for the purpose of fulfillment of the Rewards under this Promotion will be retained for 6 months after the end of the Promotion Period (“retention period”) and will be destroyed on expiry of the retention period.
  18. The Rewards cannot be exchanged for cash, other products, services or discounts.
  19. Samsung reserves the right to amend these Terms and Conditions at any time without prior notice. In the event of any dispute arising from this Promotion, the decision of Samsung shall be final.
  20. We have provided a Chinese language translation of these Terms and Conditions for reference. If there is any inconsistency between the English and Chinese versions, the English version shall prevail.
  21. No person other than Samsung Pay Customers, Samsung and OCL will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provision of these Terms and Conditions.
  22. Each Samsung Pay Customer can only register for the rewards twice. If the same Samsung Pay Customer has registered for more than two times, only the two earliest registered smartphones will be treated as valid (subject to time of registration).
