Terms and Conditions for the Samsung Customers Exclusive Offer “HK$600 Octopus Top-up Value for Galaxy S9 / S9+ Customers Promotion”
  1. The “HK$600 Octopus Top-up Value for Galaxy S9 / S9+ Customers Promotion” (this “Promotion”) is organized by Samsung Electronics Hong Kong Co. Ltd (“Samsung”) and is open to customers who enrolled Samsung’s Samsung Pay pursuant to Samsung’s Samsung Pay Terms of Service (collectively, “Samsung Pay Customers”, each, “Samsung Pay Customer”).
  2. The promotion period of this Promotion (the “Promotion Period”) is between 19 August 2018 and 31 December 2018 (both dates inclusive).
  3. By participating in this Promotion, each Samsung Pay Customer agrees to be bound by these Terms and Conditions set out herein. Samsung reserves the right to amend these Terms and Conditions, suspend or terminate this Promotion, in whole or in part, at any time, without prior notice.
  4. Smart Octopus is issued by Octopus Cards Limited (“OCL”) subject to the Conditions of Issue of Octopus published by OCL.
  5. OCL’s Privacy Policy, Conditions of Issue of Octopus, Terms of Use of Octopus Mobile App and other terms and conditions of use, published by OCL at www.octopus.com.hk as amended from time to time, shall apply to this Promotion.
  6. The $600 Octopus Top-up Value (the “Reward”) is only applicable to the first 15,000 customers (“Winner”) who have satisfied the requirements set out in this clause,
    (i) Customers should, during the Promotion Period, purchase a new Samsung Galaxy S9 / S9+ from an authorized dealer in Hong Kong (“Eligible Device”);
    (ii) Customer should install and register Samsung Pay to his/her Eligible Device, and successfully add a valid Smart Octopus (the “Eligible Smart Octopus”) in Samsung Pay of his/her Eligible Device;
    (iii) Customers must complete registration on designated reward registration website within 14 days from the date of purchase of Eligible Device, and upload the receipt issued by a designated retailer. No re-submission will be accepted thereafter; and
    (iv) During the registration, Customer must input the model or IMEI of the Eligible Device, and provide the number of his/her Eligible Smart Octopus on designated reward registration website. All Eligible Devices must be genuine products purchased from Hong Kong authorized dealers or mobile telecommunication network providers.
  7. Any Smart Octopus which is added to any Eligible Device without using Samsung Pay, or any unsuccessful addition of Smart Octopus shall not be considered as an Eligible Smart Octopus.
  8. Each Smart Octopus can only register for the rewards twice. If the same Smart Octopus registers more than two times, only the two earliest registered smartphones will be treated as valid (subject to time of registration).
  9. Each Eligible Device can be registered on the designated reward registration website for the Reward for only once. Registration will be deemed as invalid and forfeited in the event of failing to register on the designated reward registration website within the specified period, or any registered information is incorrect or missing for whatever reason.
  10. To collect the Reward, each Winner is required to register his/her Eligible Smart Octopus in the Octopus App, a mobile application operated by OCL. Winners will be notified by push notification through the Octopus App between 12 November 2018 and 30 January 2019 (both dates inclusive) that the Reward will be available for collection through the Octopus App onto his/her said Eligible Smart Octopus.
  11. The Reward will be available for collection starting from 12 November 2018. The Reward will be forfeited automatically without notice if the Winner fails to collect the Reward on or before the collection deadline on 31 Jan 2019, or the said Eligible Smart Octopus of the Winner has been suspended, cancelled or terminated or is no longer valid for whatever reason(s), which, under no circumstance shall any claim be made against Samsung and/or OCL whatsoever. Neither Samsung nor OCL shall bear any liability whatsoever if any Winner fails or is unable to collect the Reward under whatever circumstances, including, but not limited to, reset of Samsung Pay application, Eligible Smart Octopus has been transferred to device other than the Eligible Device, suspension, cancellation or termination of Eligible Smart Octopus for whatever reason, lost Eligible Device, or device reset due to factory data reset or Find My Mobile service.
  12. Only one Winner of each Eligible Device is entitled to the Reward and for once only.
  13. Samsung makes no guarantee of the availability of its web services or Samsung Pay application and will not be held responsible for interruption of service that may interfere with the ability to participate in this Promotion. OCL makes no guarantee of the availability of the Octopus App and will not be held responsible for interruption of service that may interfere with the ability to participate in this Promotion.
  14. Samsung reserves the right to disqualify any Samsung Pay Customer suspected of fraud, or if Samsung believes that Samsung Pay Customer’s participation of this Promotion have been manipulated in any way by machines or computers.
  15. By participating in this Promotion, each Samsung Pay Customer understands and agrees that any personal information provided in connection with this Promotion and/or the Reward (including but not limited to the number of the Eligible Smart Octopus, his/her mobile number and the copy of the official sales receipt and credit card or other electronic payment slips (if applicable) as proof of purchase of his/her Eligible Device) will be collected, used and retained by Samsung for the purpose of (i) verifying his/her eligibility and identity, (ii) notifying Samsung Pay Customer of the redemption of the Reward, and (iii) carrying out any enquiries or resolving any disputes in relation to this Promotion, and such personal information will not be disclosed to any other party or used for any other purposes without his/her consent. Samsung Pay Customer further acknowledges that Samsung will collect and use his/her personal information in accordance with the requirements of Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong) and Samsung’s Privacy Policy.   16. By participating in this Promotion, each Samsung Pay Customer further agrees that Samsung shall be entitled to transfer the number of his/her Eligible Smart Octopus to OCL who may use the information for the purpose of fulfillment of the Reward (including sending of push notification to his/her Eligible Device regarding collection of the Reward under this Promotion).
  17. Information collected or received as aforesaid by Samsung solely for the purpose of this Promotion and by OCL solely for the purpose of fulfillment of the Reward under this Promotion will be retained for 6 months after the end of the Promotion Period (“retention period”) and will be destroyed on expiry of the retention period.
  18. This Promotion only applies to Hong Kong.
  19. The Reward cannot be exchanged for cash, other products, services or discounts.
  20. Samsung reserves the right to amend these Terms and Conditions at any time without prior notice. In the event of any dispute arising from this Promotion, the decision of Samsung shall be final.
  21. We have provided a Chinese language translation of these Terms and Conditions for reference. If there is any inconsistency between the English and Chinese versions, the English version shall prevail.
  22. No person other than Samsung Pay Customers, Samsung and OCL will have any right under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefit of any of the provision of these Terms and Conditions.

'Galaxy S9 | S9+ Accidental Screen Damage Protection' Terms and Conditions
  1. This 'Galaxy S9 | S9+ Accidental Screen Damage Protection Plan' ('this protection') is organized by Samsung Electronics Hong Kong Co, Ltd ('Samsung Electronics') and is only avalible to customers who purchased a new Samsung Galaxy S9 / S9+ from an authorized dealer in Hong Kong before 30 April 2018 23:59. This protection is an insurance plan to protect your Galaxy S9 | S9+ against accidental screen damage and provided by Samsung’s business partners The Tokio Marine and Fire Insurance Co (HK) Ltd (“Tokio Marine”). Under the terms of the cover, if the screen of your Galaxy S9 | S9+ is damaged by accident within 1 year of purchase, Tokio Marine shall (on your behalf) cover the costs of having Samsung Electronics to replace or repair or the screen. All you have to pay is a service fee of HKD300. For details, please click and read 'Warranty Terms and Conditions' and 'Accidental Screen Damage Protection Plan's FAQs' carefully.
  2. Customers are required to register in the designated registration website and purchase Galaxy S9 | S9+ original dealer products before 30 April 2018 23:59 (based on product purchase receipt date) from authorized retailers or distributors (please refer to list of authorized retailers or distributors). During the registration customers are required to input the IMEI of their existing Galaxy Note or Galaxy S series mobile phone, such mobile phone must be a genuine Samsung mobile phone from Hong Kong authorized dealers. Customers are required to purchase genuine Samsung Galaxy S9 | S9+ from Hong Kong authorized dealers and complete the registration process on the designated registration website within 14 days from their date of purchase. Upon successful registration, customers will receive an email within 7 working days, enclosed with:
    1. 「Accidental Screen Damage Protection Plan Confirmation Letter」
      So long as customers fulfill the following 'Warranty Terms and Conditions', they will be offered protection against accidental screen damage for 1 year from date of purchase (based on product purchase receipt date).
  3. Every eligible member can register for Accidental Screen Damage Protection for a limited number of Galaxy S9 | S9+ devices (based on IMEI), registration is limited to a maximum five devices. If the same member has made registrations exceeding the quota stipulated, only the five Galaxy S9 | S9+ earliest registered (based on registration time) will be entitled to accidental screen damage protection.
  4. This offer is only available in Hong Kong.
Warranty Terms and Conditions
  1. COVERAGE
    The Tokio Marine and Fire Insurance Co. (HK) Ltd. (hereinafter referred to as the Tokio Marine) will repair or replace Covered Property that has incurred direct physical loss or direct physical damage caused by or resulting from any covered cause of loss during coverage period.
    1. Covered Property
      An accidental screen damage of Samsung Galaxy S9/S9+ owned by individual subscribers who is registered under ClubS and completed the designated product registration process for your S9/S9+.
    2. Coverage Period
      Tokio Marine cover “Once” loss or damage for a length of 12 months from the date of purchase.
    3. Coverage Territory
      Tokio Marine insure the Covered Property wherever it is located in Hong Kong SAR

  2. MAJOR EXCLUSIONS
    1. This Insurance does not apply to loss or damage caused directly or indirectly by any of the following:
      1. Nuclear Hazard
        Nuclear reaction or radiation, or radioactive contamination, however caused. If physical loss or damage by fire ensues, we will pay only for such ensuing loss loss or damage.
      2. War
        1. (i) War including undeclared or civil war;
        2. (ii) Warlike action by a military force; or
        3. (iii) Insurrection, rebellion, revolution, usurped power or action taken by governmental authority in hindering or defending against any of these.
      3. Strike, lock-out, riot, civil commotion or terrorist attacks
      4. Dishonest, Intentional, or Criminal Acts
        Dishonest, intentional or criminal acts by individual subscribers or by any person entrusted with Covered Property, whether acting alone or in collusion with others, with respect to his or her coverage
      5. Wear, Deterioration, Latent Defect
        1. (i) Wear and tear, deterioration; or
        2. (ii) Hidden or latent defect, including equipment design defect, or any quality in the property that causes it to damage or destroy itself.
      6. Willful Acts
        Willful act on the part of the individual subscribers or one of his representatives

  3. INDIVIDUAL SUBSCRIBERS' DUTIES IN EVENT OF LOSS
    In the event of loss or damage to Covered Property, the individual subscribers and his or her designee requesting the repairing service must cooperate with us and see that the following are done;
    1. Notify Authorized Repair Center
      Upon discovery of loss, notify the Authorized Repair Center within 14 Days
      1. How, when and where the loss or damage occurred.
      2. The individual subscribers must provide other information and records, such as a bill of sale; as requested.
    2. Protect
      Take all reasonable steps to protect the Covered Property from further damage.
    3. Servicing Charge
      You are required to pay a Servicing Charge of HK$300 to the Authorized Repairing Center to entitle this Coverage.

  4. OUR DUTY IN EVENT OF LOSS
    Claim Authorization and Loss Payment
    If an accidental screen damage claim is made, Tokio Marine will make loss payment to the Samsung Electronic H.K. Company Limited directly.

(HK) Ltd. in email address of SamsungS9@tokiomarine.com.hk This cover is automatically provided to your Samsung Galaxy S9/S9+ by Tokio Marine once you completed the designated product registration process for your S9/S9+ at Samsung promotion website. Under no circumstance shall Samsung Electronic H.K. Company Limited or its affiliates, or any of their employees, agents, service providers, suppliers, sub-contractors, directors, officers or shareholders be liable for indirect, incidental or consequential loss or damage, including but not limited to loss of profit or loss of business, caused by the failure of the Product, loss of use of the Product or the repair, faulty repair or replacement of the Product, even if such loss or damage are attributable to or caused by the fault or negligence of Samsung Electronic H.K. Company Limited or its affiliates or any of their employees, agents, service providers, suppliers or subcontractors. Should there be any discrepancy between the English and Chinese version of this document, the English shall be prevail.   1. What is Accidental Screen Damage Coverage?
    Mobile Phone screen damage coverage is an insurance offered by Samsung Electronics Hong Kong Limited (hereinafter referred to as Samsung HK) to its customers. And The Tokio Marine and Fire Insurance (Hong Kong) Limited (hereinafter referred to as the Tokio Marine) as underwriter.
    As long as your mobile phone screen was damaged due to an accident, you can enjoy a screen replacement or repair service in Samsung HK authorised repair center. (accident refers to the unforeseeable and unintentional damage to screen).
  2. Eligible Subscriber
    This offer is only eligible to the subscriber who upgrades any product of Note series or S series phones to Galaxy S9/S9+
  3. Coverage Period
    The effective date of this coverage is 12 months from the date of purchases and is successfully registered with ClubS. Please visit Samsung HK authorised repair center for screen replacement or repair services within 14 days after an accident, overdue will not be dealt with.
  4. Do I need to pay premium and how to claim?
    The insurance premium has been paid by Samsung HK, the customer is not required to pay any insurance premium and no need to submit the claim to Tokio Marine at their own expense. Customers are entitled to a screen replacement or repair service by paying a service charge of HK $ 300.
  5. How do I make a phone screen replacement or repair service?
    Customers only need to bring the screen damaged mobile phone, purchase invoice and ClubS notice, to Samsung HK authorised repair center for screen replacement or repair services

    Only one-time protection on accidental screen damage is being offered during the coverage period.

    Nuclear hazards, war, riots, strikes, civil commotion, terrorism, deliberate, dishonesty and natural wear & tear.
  9. Will my personal data be transferred for other purposes?
    No. The customer's personal data including name, mobile phone number and identity card number, will not be transferred for other purposes.   12. The Reward will be available for collection starting from 26 July 2018. The Reward will be forfeited automatically without notice if the Winner fails to collect the Reward on or before the collection deadline, (i) the collection deadline will be 31 October 2018 for those registered on or before 14 September 2018, (ii) the collection deadline will be 31 December 2018 for those registered on or before 30 November 2018, (iii) the collection deadline will be 28 February 2019 for those registered on or after 1 December 2018, or the said Eligible Smart Octopus of the Winner has been suspended, cancelled or terminated or is no longer valid for whatever reason(s), which, under no circumstance shall any claim be made against Samsung and/or OCL whatsoever.
