REFER A FRIEND PROMOTION
TERMS AND CONDITIONS
Participants agree to be bound by these terms and conditions (the “Terms and Conditions”). Any information or instructions published by the Promoter about the Promotion at UK: https://www.samsung.com/uk/refer-a-friend-qled-tv-deal/ or ROI https://www.samsung.com/ie/refer-a-friend-qled-tv-deal/ form part of the Terms and Conditions.
1. The Promoter is Samsung Electronics (UK) Limited, Samsung House, 1000 Hillswood Drive, Chertsey, Surrey, KT16 0PS (the “Promoter”).
2. The Promotion will commence on the 26th October 2020 (00:01 – GMT) and continue until the 31st January 2021 (23:59 – GMT) (“Promotion Period”).
3. To be eligible to participate in the Promotion you must be a resident (aged 18+) of either the United Kingdom, Isle of Man, Channel Islands or Republic of Ireland (“Participant”).
4. Employees or agents of the Promoter that are involved in the operation of this Promotion or anyone professionally connected to this Promotion are not eligible to enter.
5. Network providers, retailers, distributors, resellers and any person who purchases a Promotion Product (defined below) for resale or otherwise not as the user of the Promotion Product, may not participate in this Promotion and is specifically excluded as a Participant.
6. The Promotion is only available to consumers (e.g. not to any business or reseller).
7. Rewards shall be paid by way of bank transfer in the local currency to the Participant or Friend (as applicable) and therefore both must have a valid UK, Channel Islands, Isle of Man or ROI bank account in the country in which they reside in order to receive their Reward.
8. The Promoter is offering the Promotion whereby a Participant who purchases a new (i.e not second hand, refurbished or ex-display) Samsung 55” or larger QLED television as listed in Table 1 below (“Promotion Product”) from a retailer listed HERE within the Promotion Period shall be eligible to refer another individual who meets the requirements to be a Participant (“Friend”) and provided that the Friend purchases a Promotion Product from the same Participating Retailer the Participant made their purchase within ninety (90) days of such purchase (“Referral Period”) and otherwise in full compliance with these Promotion Terms, both the Participant and Friend shall be entitled to receive a cashback payment of £100.00/€100.00 each (“Reward”), also subject to full compliance with the Promotion Terms.

10. Purchases from auction websites (e.g. eBay) or from third party sellers on online retailers’ websites (e.g. Amazon Marketplace) are specifically excluded from this Promotion.
11. Participants may make one (1) Referral per Promotion Product purchased up to two (2) separate Referrals using two (2) corresponding but unique purchases of Promotion Products. For the avoidance of doubt, Friends taking part in the Promotion may not use the same purchase of a Promotion Product to make a Referral (i.e. as a Participant) of their own.
12. After purchasing a Promotion Product in accordance with Condition 8 above, Participants must visit https://20201.samsungpromotions.claims/referafriend and complete the presented referral form with their name, contact information, other requested information including but not limited to the Promotion Product serial number, delivery address and submit it together with a scanned copy of their proof of purchase (a “Referral”).
13. Referrals must be submitted within thirty (30) days of the date of purchase of the Promotion Product meaning that the last date to submit a Referral for a product purchased on the 31st January 2021 is the 1st March 2021 (23:59 - GMT) (the “End Date”). Referrals received after the End Date or otherwise not within the 30 days will not be eligible. For the avoidance of doubt, the date of purchase as stated on the applicable proof of purchase counts as day one (1).
14. Following submission of the Referral, the applicable Friend shall be provided with a singular use referral code via email (“Referral Code”) that such Friend my use to make a Claim in accordance with Condition 16 (providing they meet the relevant requirements to be a Participant and otherwise in accordance with the Promotion Terms).
15. Upon the Friend receiving the Referral Code, they must purchase a Promotion Product in accordance with Condition 8, for the avoidance of doubt to qualify such purchase must be within ninety (90) days of the purchase by the referring Participant of their Promotion Product in accordance with Condition 12 and also from the same Participating Retailer that the Participant purchased their Promotion Product from (as per the Referral).
16. After the Friend purchases a Promotion Product in accordance with Condition 14, they must visit https://20201.samsungpromotions.claims/referafriend (also within ninety (90) days of the referring Participant’s purchase as per Condition 12) and complete the presented referral form with their name, contact information, other requested information including but not limited to the Promotion Product serial number, delivery address and submit it together with a scanned copy of their proof of purchase (a “Claim”).
17. Friends will be sent an email to confirm their Claim has been received by the Promoter instantly upon entry of a Claim. Please note that Claims received may take up to seven (7) days from the date of receipt of a Claim and Friends will be sent an email to confirm whether their Claim has been successful and validated (“Claim Validation”), at which point the original Participant shall also receive confirmation that their Referral has been successful.
18. If an email acknowledgement has not been received, it is the Friend’s responsibility to contact the Promoter’s customer service team by email at firstname.lastname@example.org within seven (7) days of a Claim being submitted. If a Participant has not received their Referral Code, they must contact the Promoter within seven (7) days of submission of their Referral.
19. If a Referral or Claim is deemed to have been submitted incorrectly, the Participant or Friend (as appropriate) will be notified via email and SMS and offered the opportunity to provide the required information within seven (7) days. If no response is received within seven (7) days of the email and SMS, then the Referral and/or Claim shall be marked as invalid and neither Participant or Friend will be eligible to receive a Reward.
20. Referrals or Claims that are incomplete or damaged will be deemed invalid. No responsibility is accepted by the Promoter for lost, delayed or damaged data which occurs during any communication or transmission of Claims.
21. Rewards will be paid within thirty (30) days of Claim Validation to both the Participant and Friend using the bank details supplied during the Referral or Claim (respectively) process.
22. The Promoter reserves the right at its absolute discretion to disqualify Claims which it considers do not comply with these Terms and Conditions.
23. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid Claims including, without limitation, to require further verification as to proof of purchase, as well as the identity, age and other relevant details of a Participant.
24. If a Participant or Friend returns a Promotion Product at any point before the Reward is paid to both the Participant and Friend, both the Referral and Claim shall be deemed invalid and where applicable the Referral Code voided. If either the Friend or Participant returns or cancels delivery of a Promotion Product after submitting a Claim or Referral, the applicable Claim or Referral will be invalid, and the respective party must inform the Promoter by calling 0330 054 2406 (UK) / 01223 2299 (ROI). The Promoter reserves the right to check with Participating Retailers whether a Promotion Product has been returned and by submitting a Claim or Referral the Participant and/or Friend provides consent to the Promoter to do so.
Privacy and Data Protection
26. Other than as set out in these Terms and Conditions, the details and information provided by the Participant or Friend when entering the Promotion or claiming the Reward will not be used for any other purpose, nor shall they be passed to any third party.
27. The Promoter shall not be liable for any interruption to the Promotion whether due to force majeure or other factors beyond the Promoter’s control.
28. The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the Terms and Conditions of the Promotion.
29. The Promoter will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or Claims; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Promotion.
30. Participants will be solely responsible for any and all applicable taxes and any other relevant costs or expenses which are not stated in the Terms and Conditions as being included.
31. By participating in this Promotion, you agree, to the maximum extent permitted by applicable laws, to release and hold the Promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Promotion, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the Reward. The above limitation of liability shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of Promoter’s negligence.
32. The Promotion is governed by the law of England and Wales.
