Offer period

Offer shall be valid from 1st April to 30th 2019. Samsung reserves the right to extend or annul the offer period at its discretion.

IV.

Place & Outlet Coverage

> The Offer shall be valid Pan India.

> Available on purchases from select Samsung Stores (“Offline Outlet”)

Eligibility Criteria

> This Offer shall not be available for the customers who pre-booked, purchased and activated the Product.

> In case the customer uses different mobile numbers for activating the Product and for first sign-in to Samsung Shop App, he/she shall not be eligible for the offer and no claims shall be entertained in this regard.

VII.

Offer: Galaxy Buds at Rs. 4999/- or Gear S3 Frontier Smart watch @ Rs. 9999/-

Every customer purchasing and activating the Product during the Offer period shall be eligible to purchase Galaxy Buds at Rs. 4999/- or Gear S3 Frontier Smart watch at Rs 9999/- subject to the condition that the mobile number used for Product activation and first sign in to Samsung Shop App should be the same.

VIII.

Redemption of the Galaxy Buds at Rs. 4999/- or Gear S3 Frontier Smart watch @ Rs. 9999/-

> Once the customer receives/collects and activates the Product (whether purchased from Online Outlets or Offline Outlets), he/she will have to follow the process given hereunder to redeem the “offer”:
(i) Fresh enrolment/sign in to the Samsung Shop App must be completed by 31st May 2019 failing which the customer will not be eligible for the offer.
(ii) Registration & sign in to Samsung Shop to be done with same mobile number used for activating the Product. In case any other mobile number is used, the customer will not be eligible to avail the offer.
(iii) In case customer is already a Samsung Shop App user, it is advisable that he/she activates the Product with the same mobile number with which he is registered in the Samsung Shop App or else creates a new account with the number he/she has used for activating the Product.
(iv) After completion of the above steps, open the App and visit “For You” tab to check your eligibility
(v) Allow permission to read IMEI number & Mobile number (when asked for)
(vi) Samsung Shop App will show the Offer banner, you need to select the same and add to cart
(vii) Redemption of the “offer” can be done on or before 31st May 2019, failing which the Offer shall stand forfeited.
(viii) The shipping of Galaxy Buds or Gear S3 Frontier Smart Watch will happen within 60 (thirty) days from the day of placing order for the same.

> In case of booking of the Product through an e-Commerce website or Samsung Shop i.e. Samsung India e-store, it shall be delivered to the Customer through the respective logistics partners of the Online Outlets and Samsung India Electronics Pvt Limited will not be responsible or liable for supply of the Product including but not limited to the following:
(i) Any wrong submission of required details including but not limited to shipping details;
(ii) Any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control;
(iii) Any late transmissions or entries;
(iv) Any computer or communications related malfunctions or failures;
(v) Any delay, damage, non receipt, lost, misrouted delivery of Product.
(vi) Any delay due to non-availability of stocks or for any other reason beyond its control.
(vii) Any delay or loss or damage due to Act of God, Governmental actions, and any other force majeure circumstances.

IX.

Forfeiture clause

(i) If the eligible customer fails to activate the Product and/or fails to register in / sign in to Samsung Shop App and redeem the “offer” within the stipulated timelines as stated above respectively, the Offer shall stand forfeited and no claims shall be entertained in this regard.
(ii) Offer shall also stand forfeited in case the customer uses different mobile number for activating the Product and signing in to Samsung Shop App and no claims shall be entertained in this regard.

X.

Conditions related to Galaxy Buds at Rs. 4999/- or Gear S3 Frontier Smart watch @ Rs. 9999/-

> The “offer” shall be on “As Is” basis & as per stock availability. Samsung shall not be responsible for its non-availability due to various reasons like climatic conditions, labour unrest, insolvency, business exigencies, Government decisions, operational & technical issues or any other force majeure conditions etc.

> Offers cannot be exchanged with any other product or item, are non-transferable & cannot be en-cashed under any circumstances.

XI.

General Conditions

> Customer agrees that Samsung shall not be liable for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Offer or with the acceptance, possession or use of Galaxy Buds or Gear S3 Frontier Smart watch.

> Samsung reserves the right to change/alter & modify the terms & conditions of this Offer or extend or annul any part or whole offer at any given point at its sole discretion without giving any reason whatsoever.

> Samsung reserves the right to substitute the “Offer” with some other offer of equivalent value under this Offer at its sole discretion without giving any reasons. The choice as to the color, make & model of the Galaxy Buds or Gear S3 Frontier Smart watch shall be completely at Samsung’s discretion.

> Samsung shall not be liable for any technical, physical delay in transmission or submission of the entries by the customer or any disruptions, losses, damages, computer related malfunctions/ failures which affect the participation of the customer or any force majeure conditions or damages caused by Act of God, Governmental actions.

> Failure by Samsung to enforce any of its right at any stage does not constitute a waiver of those rights.

> In no event shall Samsung be liable for losses or any incidental or consequential damages arising out of or in connection with the Offer, its services these Terms(however arising, including negligence). Samsung shall not be responsible for any product or service liability of any kind.

> In the event of any conflict or inconsistency regarding any instructions, rules and conditions on any advertising or promotional material relating to the Offer, these Terms shall prevail over all such other instructions, rules and conditions.

XII.

Intellectual Property Rights

All rights, title and interest including but not limited to the Intellectual Property Rights in the promotional material(s) and any/all registrations received shall vest solely and exclusively with Samsung at all times and Samsung shall be entitled to use the database of the entries received or any information in any media for future promotional, marketing and publicity purpose without any further reference or payment or compensation to Participant. Participant shall be solely responsible for any consequences which may arise due to any kind of infringement of copyrights or any kind of intellectual property rights belonging to any other person/ entity etc. and also undertake to indemnify Samsung and its officers, directors, employees etc on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis.

XIII.

Jurisdiction

Decision of Samsung in relation to the Offer and matter incidental thereto shall be final and binding on the customer. All disputes shall be governed by the laws of India. These Terms shall be governed by exclusive laws of India and the courts located at Delhi and shall have the exclusive jurisdiction in respect of all the subject matter with relation to the Offer.

  1. Samsung India Electronics Pvt. Ltd. introduces a pre-book offer (“Pre-book Offer”) on Galaxy S10e (128GB), S10 (128GB and 512GB) S10+ (128GB, 512GB & 1TB) (“Device”).
  2. The pre-book offer shall be available from 22nd February 10am to 5th March 2019.
  3. You can pre-book the Device both Online and Offline. The online booking can be done on Samsung Shop i.e. https://samsung.com/in, Flipkart, Amazon, PayTM, Snapdeal, and tatacliq (hereinafter referred to as “Online Outlet”), whereas the offline booking can be done at the select Samsung stores (hereinafter referred to as “Offline Outlet”).   4. Only one Product can be pre-booked against one mobile number. For activating the Device, the Customer has to use the same mobile number with which the pre-booking was done. All customers should have registered with the same mobile number for a minimum period of 03 (three) days from the date of inserting the SIM in first SIM slot for the first time.
    1. If one has purchased the Galaxy S10 device via Samsung Shop, then he/she has to use the same primary shipping mobile number for activating the device as was used at the time of pre-booking the Galaxy S10 mobile device
  5. Pre –booking Device on Samsung Shop, Flipkart, Amazon, PayTM, Snapdeal & tatacliq:
    1. If you are pre-booking the Device on Samsung Shop i.e. Samsung e-store or Flipkart or Amazon or PayTM or Snapdeal or tatacliq, you will have to make a full payment of the amount as declared on the respective Outlet during the period 22nd February 10am to 5th March 2019.
    2. The price of the Device as listed on the Online Outlets shall be inclusive of all taxes.
    3. While pre-booking you will have to fill in the required details as mentioned on the respective portals such as your name, mobile number (please read clause 4 above), email id, model number and color of the Device, without which your booking will be incomplete.
    4. Once you pre-book the Device you will receive a notification vide SMS / email from the portal confirming your registration.
    5. Your Device will be dispatched by the portal and you will be notified for the same via SMS or email.
    6. Deliveries would start 6th March onwards and can take 3-5 business days , depending upon your geographical location, where the device has to be delivered
    7. The shipping of the Device will be subject to availability of stocks.
    8. In order to be eligible to avail the Samsung Galaxy Watch at the discounted price of Rs. 9999/- or the Samsung Buds at the discounted price of Rs. 2,999/-, you will be required to activate the Device between 6th March to 31st March 2019 and register on the Samsung Shop App (to be downloaded from the Google Play Store) on or before 31st March 2019 with the same mobile number which has been used for pre-booking & activating the Device.
      a. If one has purchased the Galaxy S10 device via Samsung Shop, then he/she has to use the same primary shipping mobile number for activating the device as was used at the time of pre-booking the Galaxy S10 mobile device
    9. Redemption of the Galaxy Watch or Samsung buds at the discounted prices shall have to be completed by 30th April 2019.
    10. In case you do not comply with the above mentioned timelines you will not be eligible for the Offer and no claims shall be entertained either against Samsung or its authorized partners.
  6. In case of pre-booking through Online Outlets, Samsung India Electronics Pvt. Limited will not be responsible or liable for supply of the Device as the same is being sold by Savex Computers Limited (“Savex”), Flipkart, Amazon, PayTM, tatacliq and Snapdeal respectively:
    1. Any wrong submission of required details including but not limited to shipping details;
    2. Any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control;
    3. Any late transmissions or entries;
    4. Any computer or communications related malfunctions or failures;
    5. Any delay, damage, non-receipt, lost, misrouted delivery of Device.
    6. Any delay due to non-availability of stocks or for any other reason beyond its control.
    7. Any delay or loss or damage due to Act of God, Governmental actions, and any other force majeure circumstances.
  7. Pre-booking Device at select Samsung Stores (“Outlet”):
    1. To pre-book the Device at the select Samsung stores (“Outlet”) you have to do the registration via the Pre-book app available with the Samsung promoters at the respective Outlets during 22nd February to 5th March 2019 and deposit a pre-book amount of Rs. 2000/-.
    2. While pre-booking you will have to enter some of your details such as your name, mobile number (please read clause 4 above), email id, model number and color of the Device, without which your booking will be incomplete.
    3. Once you pre-book the Device you will receive notification from Samsung on your mobile number registered in the pre-book app, confirming your registration.
    4. In order to be eligible to avail the Samsung Galaxy Watch at the discounted price of Rs. 9999/- or the Samsung Buds at the discounted price of Rs. 2,999/-, you will be required to purchase and activate the Device between 6th March to 31st March 2019 and register on Samsung Shop App on or before 31st March 2019 with the same mobile number which has been used for pre-booking & activating the Device.
    5. Redemption of the Galaxy Watch or Samsung buds at the discounted prices shall have to be completed by 30th April 2019.
    6. In case you do not comply with the above mentioned timelines you will not be eligible for the Offer and no claims shall be entertained either against Samsung or its authorized partners. Also the pre-book amount deposited by you may stand forfeited. Refund of the said amount will be at dealer’s sole discretion and Samsung shall not be responsible for the same. Any claim regarding the pre-book amount shall lie solely against the dealer.
  8. Once the customer receives/collects and activates the Device he/she will have to follow the process given hereunder to redeem the discounted Samsung Galaxy Watch at the discounted price of Rs. 9999/- or the Samsung Buds at the discounted price of Rs. 2999/-. The Process for redemption is as under:
    1. Fresh enrolment/sign in to the Samsung Shop App (to be downloaded from the Google Play Store) must be completed by 31st March 2019 failing which the customer will not be eligible for the offer.
    2. Registration & sign in to Samsung Shop App to be done with same mobile number used for pre-booking & activating the Product. In case any other mobile number is used, the customer will not be eligible to avail the offer.
    3. In case customer is already a Samsung Shop user, then he/she should pre-book & activate the Product with the same mobile number with which he is registered in the Samsung Shop application or else the customer should create a new Samsung Shop app account with the number he/she has used for pre-booking & activating the Product.
    4. Open Samsung Shop & Visit “For You” Tab to check eligibility
    5. Allow Permission to read IMEI number & Mobile Number (when asked for)
    6. Samsung Shop App will show list of available Offers. Please select the Samsung Buds or Galaxy Watch and add to cart.
    7. Redemption of Samsung Galaxy Watch at the discounted price of Rs. 9999/- or the Samsung Buds at the discounted price of Rs. 2,999/- can only be done only once for every phone number on or before 30th Apr 2019
    8. The shipping of Samsung Galaxy Watch at the discounted price of Rs. 9999/- or the Samsung Buds at the discounted price of Rs. 2999/- will happen within 30 (thirty) days from the day of placing order for the same at Samsung Shop (i.e. Samsung e-store).
  9. If the customer has pre-booked the device from Samsung Shop (i.e Samsung e-store https://samsung.com/in) during pre-book period (22nd Feb – 5th Mar), the redemption process would be as follows
    1. Customer would receive a redemption offer information via email
    2. Click on the SKU link in the e-mail to initiate redemption
    3. Customer would receive an order confirmation e-mail with bundle offer information
    4. Consumer would land on Samsung.com cart with product added for checkout at promotional pricing where the consumer pays and confirms the order.
    5. Customer has to enter the same primary shipping mobile number and shipping address used at the time of pre-booking the S10 mobile device
    6. Shipping of the Galaxy S10 and redeemed product would start from 6th March, 2019 onwards
  10. The Samsung Galaxy Watch and Samsung Buds shall be on As Is basis and will be delivered subject to the stock availability.
  11. By doing the pre booking and availing the Pre-book Offer, it would be deemed that the customers have given their consent to contact them through call, SMS or email on the details provided by them for the purpose of this Offer or for any future communications from Samsung.
