SAMSUNG LIVESTREAM PRIVACY NOTICE

SCOPE

Samsung Electronics Nordic AB (“Samsung”, “we”, “our” or “us”) respects the privacy of its customers and visitors and strives to be transparent about how we collect, use and disclose your personal data.

This Privacy Notice applies to the livestreaming event that will be held during DreamHack Winter 2019 between the dates November 28th to December 1st 2019 (the “Event”) where Samsung’s e-sports collaboration partner (the “Gamer”) will use a web-camera to livestream a video-feed of himself with Samsung’s booth as background, while playing a computer game online. Samsung will be the controller for the processing of personal data.

The web-camera is pointed at the Gamer, but it may also capture footage of fans and other visitors of the Samsung booth. This means that if you enter the area where the Gamer is livestreaming, you may become subject to Samsung’s processing of personal data (if a person can be identified from the footage, it means that the footage constitutes personal data). This Privacy Notice does not apply to third parties, such as Twitch, and their processing of personal data – therefore, please see their respective privacy notices.

INFORMATION WE COLLECT

The livestream will capture sound and moving images of natural persons which might lead to the person in question becoming directly or indirectly identifiable, thus making the captured material personal data (“Footage”). We handle all Footage as personal data.

USING THE FOOTAGE

The purpose for processing the personal data is to draw attention to Samsung’s products and brand, which is achieved by allowing the Gamer to interact with his fans at DreamHack Winter 2019 and online on the streaming platform.

The livestreaming session is not intended for monitoring Samsung’s visitors and customers, or for any other purpose than the above.

LEGAL BASIS

Our legal basis for the processing of personal data is that the processing is necessary due to the legitimate interest pursued by Samsung (which is to create awareness of the Samsung brand and Samsung products).

In this case, the awareness of the Samsung brand and products is made possible through the livestreaming session which might capture sound and footage of visitors to the Samsung booth. Considering that the footage is only captured in real-time and not retained afterwards, that the fans and visitors are made aware of the livestreaming session and that the camera will be pointed at the Gamer and only capture Footage from inside Samsung’s booth, Samsung’s assessment is that the potential intrusion of privacy of persons entering the booth is minimized. Thus, Samsung has concluded that its legitimate interests may be pursued without being overridden by the interests or fundamental rights and freedoms of the data subjects affected by the processing.

SHARING OF INFORMATION

During the Event, we will make use of the streaming platform Twitch and as such the Footage will be available for public access and viewing on their website. However, records of the livestream will not be stored nor retained after the livestream has ended.

Please note that we do not have any influence over Twitch and how personal data is processed by them (other than instructing them to not store a record of the livestream). For more information on this, please see Twitch’s privacy notice.

DATA RETENTION

The Footage will not be stored nor retained after the Event. The Footage in the livestream will only be processed in real-time during the livestream.

YOUR RIGHTS

You have the right to request access to the personal data we process about you. You also have the right to request us to correct inaccuracies in that data, to object to or request restriction of the processing, and to request erasure of your personal data.

If you have any complaints regarding how we process your personal data, you have the right to lodge a complaint with the relevant Data Protection Authority which can be found here: https://edpb.europa.eu/about-edpb/board/members_en.

Please note that we will not be able to identify you after the livestream has ended, since it will not be recorded.
