Samsung Pay Offer
Terms and Conditions
Offer is void where prohibited or restricted by law. Data rates may apply to participate in Offer.
1. Eligibility: Samsung Pay Offer (the "Offer") is open to individuals who are legal residents of the 50 United States including DC, Puerto Rico, and U.S. Virgin Islands, and eighteen (18) years old or older at the time of entry.
Additionally, to be eligible individuals must
(a) own a qualifying Samsung Galaxy device (a “Qualifying Device”). Current list of Qualifying Devices are listed on Samsung.com/pay that is compatible with the Samsung Pay application (the “App”);
(b) have a mobile plan with a U.S. carrier that is compatible with the App for a Qualifying Device; and
(c) have a valid Samsung Account ID (each, a “Participant”, collectively the “Participants”).
Employees of Sponsor, HelloWorld, Inc., and their parent and affiliate companies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, are not eligible. Void where prohibited.
2. Timing: The Offer begins on March 15, 2018 at 12:00 a.m. Eastern Time ("ET") and ends on July 31, 2018 at 8:00 p.m. ET (the "Offer Period"). Sponsor’s server is the official time-keeping device for the Offer.
3. How to Earn a Reward by Activating Samsung Pay & Completing 1 Transaction During the Offer Period:
(1) Participants must activate the Samsung Pay App using their Samsung Account ID. (Verizon customers may need to first download, at no cost, the App from the Google Play store. Data rates may apply.)
(2) Register a qualifying credit or debit card with the App (“Qualifying Card”). Not all cards are compatible; check the Samsung Pay Support page for a compatibility list: http://www.samsung.com/us/support/owners/app/samsung-pay. Private label (PLCC) cards and the Samsung Rewards Visa® Prepaid card are not eligible. Bank of America debit cards registered with the App prior to 3/31/16 and Bank of America U.S. Trust Visa debit cards registered with the App prior to 11/9/16 both need to be deleted and re-added to be eligible;
(3) Enter Code provided by Sponsor within the Promotions Tab of the Samsung Pay App no later than August 7, 2018.
(4) Complete a transaction with an eligible credit/debit card using Samsung Pay on their Qualifying Device (“Qualifying Transaction”) by July 31, 2018*
*A Qualifying Transaction can be completed by swiping up from the home button or selecting the App icon from the home screen or App tray. Then, authorize the payment by scanning your fingerprint or entering your pin. Hover Qualifying Device over the in-store card reader until the transaction is successfully completed.
4. How to Claim Reward: Participants who have earned a Reward will be advised through a push notification Participant must agree to these Offer Terms and “Privacy Notice for Samsung Pay” presented and confirm eligibility prior to receiving the Reward. Failure to accept the Offer Terms and “Privacy Notice for Samsung Pay” before the end of the Offer Period will result in forfeiture of the Reward. If Participant does not receive or closes out of the push notification, Participant may check the App to see the dollar amount of pending Rewards. Click on Claim Rewards and follow the on-screen instructions to agree to the Offer Terms and Privacy Notice for Samsung Pay. Reward must be claimed prior to the end of the Offer Period.
5. Reward: Reward is a $5 Samsung Rewards Visa® Prepaid reward card digitally added to participant's Samsung Pay Wallet. Reward is subject to its terms and conditions (which can be found by clicking on the card within the Samsung Pay Wallet). Reward cannot be returned, exchanged, transferred, replaced and is non-refundable. Limit: One (1) Reward per Samsung Account.

7. Release: By receipt of the Reward, participant agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and offer suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Offer or receipt or use or misuse of the Reward.
8. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Offer, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Offer, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the he operation of the Offer or to be acting in violation of these Terms and Conditions in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Offer may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
9. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Instant Win Game; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, or network hardware, or software; (3) unauthorized human intervention in any part of the entry process or the Instant Win Game; (4) technical or human error which may occur in the administration of the Instant Win Game or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Instant Win Game, or receipt, or use of any prize or while traveling to or from any prize-related activity. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Instant Win Game, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in the Offer; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the operation of the Offer; (4) technical or human error which may occur in the administration of processing the Reward or the processing of Qualified Transactions of participants; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the Offer or receipt or use or misuse of any Reward.
IN NO EVENT SHALL SPONSOR OR ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AGENTS, AFFILIATES, FRANCHISEES, SUCCESSORS, ASSIGNS, AND SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE DAMAGES OR LOST PROFITS, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS MEANS THAT PARTICIPANT HEREBY WAIVES ANY AND ALL RIGHTS TO ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE DAMAGES OR LOST PROFITS FROM SAMSUNG AND ITS LICENSORS. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, SPONSOR’S CUMULATIVE LIABILITY TO PARTICIPANT ARISING FROM ANY CAUSE OF ACTION WILL AT ALL TIMES BE LIMITED TO THE LESSER OF (A) YOUR ACTUAL LOSS; OR (B) $1,000. THE FOREGOING DISCLAIMERS, EXCLUSIONS AND LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.
10. Disputes: Except where prohibited, participant agrees that any and all disputes, claims and causes of action arising out of or connected with this Instant Win Game shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court in New York or an appropriate New York State Court. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the participant and Sponsor in connection with the Instant Win Game, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. Except where prohibited, participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Offer or any Offer awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court in New York or an appropriate New York State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Offer, but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the participant and Sponsor in connection with the Offer, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
11. Participant's Personal Information: Information collected from participation is subject to the Samsung Pay Privacy Notice.
