Terms of Service

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THE SERVICES OF <SAMSUNG MEMBERS>.
SAMSUNG MEMBERS is a membership service that offers additional service benefits for Samsung smartphone users. It also provides answers to user questions and the opportunity to synchronize data (Collectively, The Service). These terms of service for SAMSUNG MEMBERS (TDS) are those that govern and regulate the legal relationship between Samsung Electronics Argentina SA Sucursal Paraguay (Samsung or We) and you as a user of these services, as well as the supplements to the Terms of Service, which you accepted (or will accept with these TOS) when you open an account with Samsung (Samsung Account). For those who do not have a Samsung Account, read the Terms and Conditions of Service which can be found at: [ https://account.samsung.com] and open a Samsung account before using the SERVICE. Although the most critical and important terms of service are discussed here in these TOS, you acknowledge and agree to the general and detailed terms of service that are applicable to SAMSUNG Members and which are incorporated by reference into these TOS.
1. Acceptance of these TOS
You agree that you will use this SERVICE in accordance with applicable law and that you will not use this SERVICE for any illegal, fraudulent activity or purposes that are prohibited by these TOS. Minors should not use this service unless their parents or legal guardian have reviewed and agree to these TOS. If you are a father / mother or legal guardian and you decide to allow the use of these services to the minor, who in no case may be under 14 years of age, agree to: (i) supervise the minor when using this SERVICE; (ii) Assume all risks associated with the use of this SERVICE by the minor, including the transmission of materials, content and other information from / to third parties over the internet; (iii) assumes all responsibilities that may arise from the minor using this SERVICE; and (iv) ensure the accuracy and veracity of all the information provided by the minor.
2. Definitions
1. “Member” means the person who has registered as a member of SAMSUNG MEMBERS
2. “Registration” Refers to the process that the member goes through to use the SERVICE application. From registration to the process of Login to the account and the Service.
3. “SAMSUNG MEMBERS” Refers to membership of different levels based on the membership policies specified by Samsung and offers various benefits depending on the levels.
4. "Coupons" are used as tools to provide the benefits of the SERVICE and are classified according to levels. These coupons are issued manually or automatically and are registered on the page "My coupon" under the SERVICE. Members can receive various benefits when they present their coupons at SAMSUNG Product Stores or Samsung Service Center.
3. License
3.1. Granting of the License. Subject to the terms and conditions of these TOS, Samsung grants you if you accept: a limited, personal, non-exclusive, non-transferable and revocable License to use this SERVICE, only authorized in this agreement. You can access this SERVICE that is licensed and not for sale. All references to the SERVICE include everything related to content such as: texts, graphics, use of user interfaces, scripts and software used to implement and give access to this SERVICE and its updates, improvements, modifications, revisions or additions to the SERVICE , available to Samsung users. Furthermore, Samsung is under no obligation to provide any updates, improvements, modifications, revisions or additions to the SERVICE.
3.2. Restrictions
(i) You may not undo, manage, copy, decompile, disassemble the source of the code, modify, adapt, capture, reproduce, publicly display, publicly perform, transfer, sell, license, create derivative works of or based on it, republish , upload to the internet, edit, post, transmit, distribute, broadcast in the media, exploit, avoid motivating another person to do any of the things mentioned above about the SERVICE or its partial or total content.
(ii) You may not use the SERVICE for any purpose that is illegal or prohibited by this agreement. It is specifically prohibited to use this service to share, publish or include content that violates the rights of third parties, including privacy and intellectual property rights; (b) obscenities, abuse, threats, defamations, violence, illegal, discriminatory, racist, sexist activities or any type of questionable activity (determined at our discretion) or not aligned with SAMSUNG content or its regulations; or (c) contains viruses or any means that is harmful to software, code, or something that may impact the SERVICE or the devices on which the service is used.
(iii) You may not interfere or attempt to interfere with the operation of the use of the SERVICE of others in any way, including, but not limited to spam (spam), hacking, uploading any type of computer virus or time bombs, or anything similar. You may not use the SERVICE to collect and use information, including, but not limited to, accounts and contacts. You may not impersonate or pretend to be someone other than you, including without limits: creating false and fraudulent accounts or using someone's image without consent
(iv) You may not use any kind of robot, spiders, scripts, any manual, automatic program or any means to extract, download, index, create multiple accounts, formulate, attach, mine, reproduce, dodge, presentation, operation or the real purpose of the application, its functions or any part of the SERVICE.
(v) You may not use the SERVICE to make unsolicited offers, orders, advertising or spam.
(vi) If the SERVICE allows the issuance of any evaluation, it cannot issue any false or fabricated evaluation. Each review must be genuine and represent your actual experience. You must ensure that you have not received any payment or incentive to review, criticize or evaluate.
(vii) The possibility of downloading or transmitting content from the SERVICE will be available to you in your country of residence and not available in another location. The service is subject to territorial restrictions, imposed by Samsung or another content provider. You cannot use, access or attempt to access this SERVICE from a country other than your country of residence. Samsung may use technologies to verify compliance with this clause.
3.3. Upload Material to the Samsung Members Community.
(i) Any material that you upload to the Samsung Members community will be considered public and without owner, We have the right (without remuneration in between) to use, copy, distribute, sub-license, and disclose to third parties, said material for any purpose. We also have the right to disclose your identity to third parties if they hold you responsible for any wrongdoing as long as it is reasonable. Demands for any material uploaded or uploaded by you to the website constitutes a violation of intellectual rights, property rights and the right to privacy.
(ii) Samsung reserves the right to remove any material or publication of yours on the website if such material is not in alignment with Samsung content standards. You guarantee that any material you upload will not infringe any third party intellectual rights.
(iii) Any material that you upload must align with content standards to the letter. We will determine at our discretion if the contribution is not aligned with the content standards. The contribution must be precise (factual), genuine (real opinions), aligned with the laws in force in the country where it originates and be relevant. The contribution must not:
• Be defamatory
• Obscene, offensive, aggressive or infuriating
• Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
• Reveal the name, address, telephone, cell phone or fax number or any other personal data concerning any individual.
• Infringe any intellectual, database or trademark right of another person • Violate any law owed
to a third party, such as clauses of a contract or any confidential clause
• Be in contempt of court
• The contribution cannot have character of harassment, aggression, intention to embarrass, alarm or
annoy another person • Usurp someone else's identity, misrepresent their identity or affiliation with another person
• Give the impression that the contribution originates from Samsung if that is not the case.
• Advocate, promote, or incite a third party to commit or assist any illegal activity or criminal act.
• Contain a statement that you know, believe or have reason to believe, content by which members of the public to whom such content is directed is probably understood as direct or indirect motivation, induce for the commission, preparation or instigation of acts of terrorism .
• Contain advertisements or promote services or links from other sites.
(iv) Samsung is under no obligation to monitor or moderate the forums and services that Samsung itself provides on the website. Samsung reserves the right to close the forums at any time. Samsung reserves the right to remove any contribution that Samsung considers potentially defamatory, inappropriate, illegal, or violate the rights of third parties also to disable access to it.
4. Updating the Service
Samsung may at any time provide or make available updates and improvements to the SERVICE ("Updates") including but not limited to: corrections, improvements to the service, new features, removal of existing features, or modification of the service. Updates will be governed by these TOS unless new / separate terms and conditions are provided with modifications, in which case these new terms and services would govern Updates. Updates for software security or critical fixes or other updates can be automatically downloaded and installed. According to the level of importance, said downloads will be provided in a timely manner.
5. Right to monitoring
Samsung may, but has no obligation, to monitor use of the SERVICE. Samsung may determine at its discretion whether accounts, content and communications violate the TOS. Samsung reserves the right to collect data on the use of the SERVICE including license key numbers and other information deemed relevant to ensure that the SERVICE is used in accordance with the TOS. Any unauthorized use will be considered by Samsung as a violation of the TOS. You agree not to block, electronically or otherwise, the transmission of data that is required for compliance with the TOS that may result in the immediate assignment of your right to use this service. Samsung reserves the right, but has no obligation, to monitor or become involved in disputes between You and other users.
6. Join Samsung Members / Registration
6.1. A customer who wants to become a member needs to apply for a membership after accepting this agreement and logging into their Samsung Account.
6.2. Even after applying for the membership described in the previous paragraph, the application will not be accepted in these cases:
(i) When the applicant cannot be identified
(ii) When the applicant is already a member of the SERVICE
(iii) When the applicant fails to provide correct, complete, truthful and accurate information as requested in the registration and agreement form.
7. Resign Samsung Members or loss of membership
7.1. When a Member requests to cancel their membership in the following ways, Samsung will take the necessary actions to cancel the membership
-Cancel their Samsung Account
-Click “Cancel Membership” on the Member Information page of the SAMSUNG MEMBERS application.
7.2. Membership can be suspended or canceled in the following cases. In all cases, Samsung will inform the Member of the suspension or cancellation of membership in writing, by phone, email or text message within three business days from the date of suspension or cancellation of membership. In the case of point (iii) your membership will be canceled without notice.
(i) Yes The information that the Member provides at the time of application is not true;
(ii) If the member dies; in this case, the membership, rights and responsibilities related to its services cannot be inherited;
(iii) If a member turns out to be a threat to the order of information and the use of telecommunications. Behaving in an inappropriate manner including, but not limited to: becoming an obstacle to other members, using the SERVICE or using another member's name illegally
(iv) Acting illegally by law or this agreement.
7.3. In the case of suspension or cancellation of membership for any of the reasons specified in each point under Article 7.2, the Member is allowed to provide evidence showing that the infringement was not its fault in those cases Samsung will review the evidence and If the Member's claim turns out to be true, their membership may be restored.
7.4. The following items specify the date on which the membership is canceled or removed.
(i) In the case of disqualification due to death, the date of death;
(ii) For cases other than death, the date of application or the date of notification of cancellation sent to the member
7.5. All coupons and benefits that were not used will be removed once the membership is canceled or removed
7.6. When you cancel your Samsung Account, the SERVICE you receive as a member will be canceled as well.
7.7. When you return your Smartphone for a refund, all membership data will be removed and cannot be restored.
8. Rejoining SAMSUNG MEMBERS
After leaving SERVICE You can rejoin with the same ID and you can also restore your same membership level, but benefits including coupons cannot be restored as they are impossible to recover once the service is terminated.
9. Register Teams or Block accounts
The membership service will be available after your team is registered (your team is automatically registered when you join the SERVICE from it). With a Samsung Account, you can register up to ten computers.
10. Cancellation and New Registration of equipment
10.1. If you want to add another team after registering the maximum number of teams allowed (10), you must cancel one of the existing teams under your account.
(i) To cancel a team registered under your account (Member Information> Registered Teams)
(ii) To restore a canceled team, just log in from the team and automatically register again
10.2. Re-register a canceled team
(i) When restoring a canceled account for the same team, the coupons and its membership class are kept
(ii) If you restore a canceled account on a different team that was registered with another account, the coupons from the previous team cannot be keep

11. Bloquear cuentas
Si tiene registrado un equipo que fue obtenido ilegalmente sin ser comprado, y recibe injustamente los beneficios, la cuenta será bloqueada de este servicio. La cuenta bloqueada no podrá acceder al servicio desde ningún tipo de equipo incluyendo el equipo original donde la cuenta fue creada. Para desbloquear la cuenta contacte a http://www.samsung.com/ca/support/ para probar su legitima propiedad de la cuenta presentando un recibo de la compra del equipo.
12. Beneficios de los diferentes niveles
12.1. Diferentes beneficios son ofrecidos (Para más información puede encontrarlo en el menú “Detalle del nivel” y “Acerca del nivel”)
12.2. Algunos beneficios no están disponibles inmediatamente después de la registración como miembro. Deje que transcurra un tiempo para procesarlos
13. Ganar cupones
13.1. Los cupones son divididos en dos tipos: cupones automáticos y descargables
(i) Se le entrega un cupón automático al momento del registro después de la compra de su equipo, y puede acceder al mismo en el menú: Mi cupón
(ii)  Los Cupones descargables pueden ser encontrados en los boletines de beneficios que son expuestos en el menú: Mi cupón
14. Cancelación y Vencimiento de cupones
14.1. Tenga en cuenta que cuando usted cancela un producto o servicio comprado, o pierde las condiciones necesarias para conservar el cupón. También serán cancelados los cupones que acompañaban dicha compra o las condiciones. En el caso de que haya utilizado el cupón, pero luego cancele la compra (la compra gracias a la cual se obtuvo el cupón en primer lugar). Tendrá que pagar la suma correspondiente al costo o compensarlo con otro cupón.
14.2. Los cupones son válidos por un periodo especifico de tiempo. Todos los cupones que ya no sean válidos son eliminados automáticamente. Cuando el cupón es obtenido bajo circunstancias especiales, la validez del mismo podría ser menor a dos años. En estos casos, el Miembro será informado con antelación en cuanto a la validez del cupón
15. Uso de Cupones
Usted puede usar Cupones en la Tienda Samsung o el Centro de Servicio Samsung u otras tiendas afiliadas que están especificadas en los cupones con sus enlaces pertinentes.
16. Archivo e Historial de Cupones ganados o utilizados.
16.1. Samsung archivará y mantendrá el historial de cupones ganados y utilizados por un periodo de cinco años
16.2. Si es solicitado por un Miembro, Samsung proporcionará el historial relevante sobre el historial de cupones ganados y utilizados.
17. Promociones y Premios
En ocasiones Samsung pondrá a disposición productos seleccionados y premios. Ud. Entiende y acepta lo siguiente:
17.1. Promociones y premios serán ofrecidos y provistos por terceras partes. En esos casos Samsung no es responsable por la promoción o premio ofertados
17.2. Todas las promociones y premios están sujetos a disponibilidad y puede que no esté disponible a discreción de Samsung o algún socio involucrado, incluyendo, pero no limitado a: (a) restricciones geográficas, (b) límites de tiempo, (c) restricciones del dispositivo, disponibilidad limitada y/o (d) resultado de ciertas Operadoras de Telefonía Móvil
17.3. La elegibilidad de las promociones y premios estará sujeto a términos y condiciones de la promoción o el premio en cuestión
17.4. Samsung se reserva el derecho de hacer cambios a las promociones y premios ofertados en cualquier momento sin obligación de informar el cambio.
18. Políticas de Privacidad
Toda la información personal obtenida de Miembros en conexión con los servicios de Membrecía y cupones no serán revelados a terceros para sus propios fines comerciales sin autorización del miembro. Sin embargo, podríamos divulgar su información a ciertas entidades que se encuentran en países que provean niveles de protección de información distintos a los estipulados en el país de su residencia.
• Afiliados- Compañías de la Familia Samsung
• Socios Comerciales- Compañías confiables que puedan proveer información sobre productos que en los que Ud. Podría estar interesado.
• Proveedores de Servicios- Compañías que proveen servicios para o en beneficio de Samsung
• Cumplimiento de la ley- cuando sea necesario para proteger a Samsung y sus usuarios

19. Recopilación y uso de Información Personal
19.1. Cuando Ud. crea una cuenta nosotros obtendremos la siguiente información de usted: Nombre, fecha de nacimiento, correo electrónico, número de teléfono. La información recopilada será utilizada, proporcionada o delegada entre los mencionados en el apartado de Política de privacidad que puede ser encontrado aquí: Consulte nuestra Política de Privacidad en el Menú Ajustes/Acerca de Samsung Members
19.2. Su cuenta. Si la información de registración es requerida, Ud. está de acuerdo con proveer información completa, precisa y actual requerida para registrarse al SERVICIO y/o podría ser requerida en el curso de uso del servicio. Usted también está de acuerdo con mantener y actualizar la información de su registro completa, precisa y actual. Sin ningún límite o anulación de la Política de Privacidad, Usted está de acuerdo con que Samsung podría conservar y utilizar la información de su registro que Ud. proporcione para su uso en el mantenimiento del SERVICIO. Usted. es el único responsable de todas las actividades que se realizan en su cuenta de proporcionar y mantener su información de registro correcta y de mantener la confidencialidad de su contraseña. Si existiera un uso no autorizado de su contraseña o cuenta, favor notificarnos inmediatamente.
19.3. Es importante que usted lea las Políticas de Privacidad cuidadosamente en cualquier momento que utilice el SERVICIO, Ud. da su consentimiento a las prácticas que se describen en las Políticas de Privacidad y sus suplementos. El suministro de información es voluntario, si Ud. no desea dar información o no acepta dichas prácticas descritas en las Políticas de privacidad no puede acceder al SERVICIO.
19.4. Es importante también que Ud. verifique constantemente si hay actualizaciones de las Políticas de Privacidad. Si actualizamos las Políticas de Privacidad le haremos saber de los cambios que consideramos relevantes. Accediendo a nuestro SERVICIO o utilizándolo después de ser notificados, Usted da su consentimiento a las nuevas prácticas identificadas en la actualización. La versión más actual de las Políticas de Privacidad está siempre disponible aquí: “https://account.samsung.com/membership/pp”. Puede verificar la fecha en la que las actualizaciones se vuelven efectivas ya que se puede ver en la parte superior cuando fueron actualizadas por última vez y cuando entran en vigencia las Políticas de Privacidad.
19.5. No conservaremos su información por un periodo más largo de lo necesario para el propósito que fue recolectado en primer lugar. Lo que significa que la información será destruida o suprimida de nuestros sistemas cuando ya no sea necesaria.
Tomamos las medidas necesarias para asegurarle que nosotros procesamos y retenemos su información con la siguiente lógica.
1. Solamente durante el tiempo en que la información es usada para prestarle el servicio
2. Como se requiere por Ley, contrato o por obligaciones establecidas.
3. Solamente el tiempo que sea necesario por el propósito por el que fue recopilado, se procesa o bien por más tiempo a ser necesario bajo contrato, aplicable por la ley, a fines estadísticos, pero sujeto a métodos apropiados para su seguridad.
19.6. Usted puede solicitar que le proporcionemos los detalles de los datos recolectados, pueden también solicitar que suprimamos o corrijamos inexactitudes. Sin embargo, si solicita la supresión de su información personal podría resultar en la pérdida de acceso al SERVICIO. No suprimiremos datos que no sean requeridos por ley.
El control de la base de datos en donde almacenamos su Información es Samsung Electronics Co. Ltd., una compañía de responsabilidad limitada constituida y válidamente existente de acuerdo con las leyes de la República de Corea, con domicilio social en 29 Samsung Ro, Yeongtong-gu, Suwon-si, Gyeonggi-do, 443-742, Corea.

20. Cambio o Suspensión del SERVICIO
20.1. Si Samsung tiene que cambiar o suspender el SERVICIO (De ahora en adelante denominado cambio) debido a enmiendas o promulgaciones de leyes relevantes o por alguna otra razón Samsung debe notificar los cambios a los miembros un mes antes de que sean efectivos/aplicados con los métodos especificados en el punto 22 de este acuerdo
20.2. Samsung puede cambiar sus servicios en cada uno de los siguientes casos: cambios unilaterales en servicios de organizaciones afiliadas, bancarrota, desastres naturales, crisis financieras, crisis de gerencia debido a cambios veloces del ecosistema financiero o razones equivalentes. En esos casos, Samsung deberá notificar a sus miembros los cambios ya sea por escrito, por teléfono, correo electrónico o mensaje de texto en 7 días hábiles desde la fecha de los cambios.
21.  Responsabilidad en el incumplimiento este Acuerdo
Miembros que incumplieran este acuerdo deben tomar todas las responsabilidades por cualquier pérdida o daño de cualquier tipo que pueda surgir debido al incumplimiento.
22. Aviso para los Miembros
22.1. En que Samsung necesite o deba realizar alguna notificación a los Miembros, Samsung puede hacerlo vía las direcciones de correo electrónico proporcionadas durante la registración de los miembros
22.2. Cuando se notifica a una cantidad/clase de miembros no especifico Samsung puede reemplazar las notificaciones individuales para los miembros por un aviso en el tablero de anuncios por una semana. Sin embargo, asuntos que puedan afectar significativamente a los miembros serán notificados de manera individual.
23. Ley aplicable
Estos TDS se rigen por las leyes de la jurisdicción donde usted es residente, sin tener en cuenta sus disposiciones legales sobre conflictos. Estos TDS no se regirán por la Convención de las Naciones Unidas sobre contratos para la venta internacional de productos, cuya aplicación se excluye expresamente.
24. Resolución de conflictos
Si usted es un consumidor (y si este término no está definido de otro modo en su legislación local, esto significa “no usar el Servicio como parte de un negocio, oficio o profesión"), los tribunales del territorio en que reside tienen jurisdicción no exclusiva para escuchar y resolver cualquier disputa, controversia o diferencia que surja de estos TDS o del Servicio. Cuando la ley local permita una elección de corte, la corte será la corte en la ciudad capital de su país. Si usted no es un consumidor, si una disputa, controversia o diferencia surja de cualquier forma de estos TDS o su uso del Servicio y no se resuelvan de manera amistosa, serán aplicables procedimientos de arbitraje sujetos a las reglas de arbitraje de la Cámara de Comercio Internacional del lugar del demandado. No obstante lo anterior, Samsung puede solicitar recursos judiciales (o un tipo equivalente de reparación legal urgente) en cualquier tribunal de jurisdicción competente. Las audiencias de arbitraje se llevarán a cabo en inglés.
25. Acuerdo completo
Estos TDS son el acuerdo completo entre usted y Samsung en relación con el Servicio y sustituyen todas las comunicaciones, propuestas y representaciones anteriores o contemporáneas orales o escritas con respecto al Servicio o cualquier otra materia cubierta por estos TDS. Si alguna disposición de estos TDS se considera nula, inválida, inejecutable o ilegal, las demás disposiciones continuarán en pleno vigor y efecto.
26.  Cupones Premium
Los modelos de smartphones citados a continuación podrán contar con unos cupones exclusivos que estarán bajo el nombre de “Cupones Premium”.
