1. This promotion is organized by Samsung Electronics H. K. Company, Limited (“Samsung”) 2. By participating in this promotion, each participant agrees to be bound by these Terms and Conditions. If there is any inconsistency between these Terms and Conditions and any advertising, publicity and other materials relating to or in connection with this promotion, these Terms and Conditions shall prevail. 5. After registering for the promotion through Samsung Wallet, and completing one credit card transaction (not applicable to transportation transaction payments) via Samsung Pay, participants will be entitled to one lucky draw chance. To receive a second lucky draw chance, a subsequent credit card transaction must be completed via Samsung Pay in the next day, and so on. How to Register: (i) The lucky draw activity is starting from 00:00 to 23:59 daily. (ii) The promotion is only applicable in the Hong Kong Special Administrative Region. Result announcement: (i) The Prizes will be randomly drawn by computer. All prizes of this promotion are instant win prizes. The participant will be notified of the lucky draw prize instantly upon completing the lucky draw entry. (ii) The announcement will be published in the Sing Tao Daily and The Standard on 24 April 2025. 11. Winning notification: (i) Grand/ 2nd/3rd/4thPrize: The winning notification will be sent to the winners individually by email within 7 working days after the draw. If the winner does not respond within 10 working days, the winner will be disqualified and late enquiries would not be accepted. 12. Prize redemption: (i) Grand/ 2nd/3rd/4th/5th Prize: The winners must redeem their Prizes in person at the designated location within the specified date and cannot authorize others to redeem on their behalf. At the time of Prize redemption, winners must present the Samsung handset used to participate in this promotion for the staff to check the IMEI code for verification, and provide their original eligible identification document (HKID or passport) as well as the prize notification email for verifying their redemption eligibility and completing the Prize registration process. If the winner is under 18 years of age, a parent (father/mother or legal guardian) must accompany the winner to collect the Prize. The parent must agree to assume all risks and responsibilities associated with the winner's use of the Prize. (ii) Grand prize winners: Winners should provide their eligible Cathay membership account information (including full name, day-time contact number, email and the Cathay membership account number). All eligible winners agree that Samsung will pass your eligible Cathay membership account information to Cathay Pacific Airways Limited for completing the redemption process. The Asia miles rewards will be credited to the winners’ Cathay membership account within 4-6 weeks after the announcement. (iii) 5th prize winners: a. Prizes will be distributed in e-voucher format. b. Winners should visit the designated Samsung Experience Store in person (https://www.samsung.com/hk/samsung-experience-store/locations/) within the specified date to redeem the prize. To redeem the prize, the winner must present the eligible e-voucher stored in Samsung Wallet. Once completed, the voucher will be deleted by the shopfront staff. Each e-voucher can only be used to redeem a gift once. c. Prizes are subject to the supplies in Samsung Experience Stores. Please check the stock availability with the stores before redemption. (iv) 6th Prize winners: a. Prizes will be distributed in e-coupon format. a. Winners must redeem the prize according to the instructions indicated on the e-coupon. (v) Prizes must be collected/ redeemed on or before the specified date on the e-coupon/e-voucher and become invalid after the specified date. No re-issuance of e-coupon/e-voucher. Winners must follow the Terms and conditions on the e-coupon/e-voucher. (vi) If a winner fails to claim the Prize according to the above requirements by the specified date, Samsung reserves the right to disqualify such a winner and the Prize will be forfeited. Samsung will not accept any claim or bear any liability whatsoever. (vii) Prizes cannot be returned, exchanged, resold, or transferred, nor can they be exchanged for cash or other prizes/discounts/services. (viii) All information is based on the registered records in the Samsung account or as provided by participants at the time of prize redemption. Any incorrect, inaccurate or incomplete information will be deemed invalid. If any participant cannot receive the Prize redemption notification or redemption details, or cannot redeem the Prize due to any incorrect, incomplete or inaccurate information provided for this promotion, Samsung shall bear no responsibility. 13. Samsung is not the supplier of the Grand/2nd /6th Prizes in this promotion, and the winners are subject to further terms and conditions as prescribed by the relevant merchants. Samsung shall not be liable for any products and services provided by other Prize suppliers or for any consequences arising from the use of their products or services (including but not limited to their validity, accuracy, or product quality) under any circumstances. 14. Samsung reserves the right to disqualify any participants from the Prize where it has reasonable grounds to believe that participant has violated these Terms and Conditions or any instructions and/or requirements of this promotion, or that participant may have gained an unfair advantage by participating in this promotion or redeemed Prize using fraudulent means. 15. Except where expressly provided herein, each participant shall bear any extra costs and expenses, and any relevant tax payments incurred resulting from participating in this promotion and no reimbursement may be sought from Samsung. 16. By participating in this promotion, each participant agrees to exempt and exclude Samsung from all claims or liabilities of any nature arising from participating in this promotion or otherwise related to this promotion, including but not limited to, any damage or loss caused by the acquisition, receipt, possession, use or misuse of the Prize or other reasons, and any claim or ground for litigation of any type or nature which the participant may potentially possess based on such damage or loss. The above disclaimer is not applicable to damage or loss caused by fraud (including misrepresentation), or death or personal injury caused by negligence. 17. Terms with the effect of disclaiming liabilities in these Terms and Conditions shall be applied to the fullest extent permitted by applicable laws. 18. Each participant agrees to indemnify and hold Samsung harmless from and against any and all claims, damages, liabilities, costs and expenses (including legal costs on an indemnity basis) arising from any misconduct or negligence, as well as breach of these Terms and Conditions for which such participant is liable. 19. Samsung shall not be liable for any delays, losses, errors, unidentifiable information, or damages to the registered information of participants or prize notifications issued by Samsung due to computer, network, telephone, technical issues, or other reasons not attributable to Samsung, which may render the information invalid. Participants or winners shall not dispute this. 20. In the event of any dispute arising from or in connection with this promotion or relating to the interpretation of these Terms and Conditions, Samsung reserves the right of final decision. 21. By participating in this promotion, each participant agrees that any personal data provided in connection with this promotion will be collected, used and retained by Samsung, its affiliates and its third party service providers (whether in Hong Kong or abroad) (collectively “Data Users”) for the purposes of (i) verifying eligibility and identity of Eligible Customer, and (ii) fulfilment of Prize redemption and other purposes directly related to this Promotion. Such personal data will be kept in strict confidence and not be disclosed to other third party or used for any other purposes without participant’s consent. Data Users will collect and use the personal data in compliance with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong) and Samsung Privacy Policy. No person other than the participants and Samsung will have any right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong) to enforce these Terms and Conditions or enjoy any benefits therein. 23. An English version of these Terms and Conditions is provided for reference only. If there is any inconsistency between the English and Chinese versions, the Chinese version shall prevail. 24. These Terms and Conditions and /or any claim or dispute arising from or in connection with this promotion shall be governed by and construed in accordance with the Laws of Hong Kong, without regard to its conflict or choice of law provisions. The parties agree to the exclusive jurisdiction of the courts of the Hong Kong SAR. 25. If any terms in these Terms and Conditions is judged to be illegal, invalid or unenforceable, it shall be replaced by a term which achieves Samsung’s intention to the greatest extent possible, and the validity and enforceability of the rest of the Terms and Conditions shall not be affected.
