Terms and Conditions

- The Z Mansion Causeway Bay Exclusive Privilege (this “Promotion”) is organized by Samsung Electronics H. K. Company, Limited (“Samsung”) and will be held between Sep 2, 2022 and Oct 4, 2022 (the “Promotion Period”).

-This Promotion is available to each customer who buys a brand new genuine Galaxy Z Flip4 or Galaxy Z Fold4 (“Designated Product”) from any designated authorized resellers or authorized distributors in Causeway Bay^ (“Selected Stores”) during the Promotion Period (each an “Eligible Customer”).

-By participating in this Promotion, each Eligible Customer agrees to be bound by these Terms and Conditions. Samsung reserves the right to amend these Terms and Conditions, please check for updates on the Promotion page, the latest version shall prevail. If there is any inconsistency between these Terms and Conditions and any advertising, publicity and other materials relating to or in connection with this Promotion, these Terms and Conditions shall prevail.

-Each Eligible Customer who purchases a brand new genuine Galaxy Z Flip4 in Selected Stores get a Free LOUSY X Galaxy Z Series Limited Edition Starry Bag and a 15W Wireless Charger Pad P2400 with TA (Recommended Retail Price: HK$468) (“Z Flip4 Gift”); while who purchases a brand new genuine Galaxy Z Fold4 in Selected Stores get Now TV H1 & Soccer Combo (6 Months) with installation * (original price: $2,582), which includes 6-months subscription of the designated Soccer Combo and One Now TV Starter Pack on Now TV service (original price: $2,064),  a waiver of the monthly HD Connection Service fee  for Now TV and a one-off installation fee for the Now H1 Smart Box (original price: $518) (“Z Fold4 Gift”) (“Z Flip4 Gift” and “Z Fold4 Gift”, collectively known as “Gift”). The Now TV service and Now H1 Smart Box, respectively, are only available in designated areas in Hong Kong.

- Customers who pre-order and purchase the Designated Product during the pre-order period (Aug 18, 2022 - Sep 1, 2022), are not eligible to get the Gift under this Promotion.

- Each Eligible Customer, who buys the Designated Product during the Promotion Period, can redeem the corresponding Gift at the below Redemption Location by presenting the new purchased Designated Product with valid Selected Stores purchase invoice to staff, and complete the redemption form. Product and Gift availability may vary depending on the respective Selected Stores — please check with the sales for details.

- *Special terms for redemption of Z Fold4 Gift: The Z Fold4 Gift  is only available to new Now TV customers. After collecting the redemption letter from above Redemption Location, eligible Customers need to contact Now TV by themselves on or before Oct 31, 2022 to arrange for installation, the Gift will be forfeited if Eligible Customer fails to contact Now TV on or before Oct 31, 2022 for further arrangement. The Now TV service and Now H1 Smart Box, respectively, are only applicable to designated areas in Hong Kong, and customers whose addresses are outside such designated areas will not be able to enjoy the Z Fold4 Gift, and no refund or compensation will be offered in lieu in such cases. . Requires network connections and compatible device(s). Subject to Google Terms of Service. Now H1 Smart Box is provided by PCCW Media Limited. Please contact Now TV for more details. The use of Z Fold4 Gift and the Now TV Service, respectively, are subject to Now TV Terms and Conditions; for more details please refer to the redemption letter and contact Now TV’s dedicated hotline at 2888 1613 on Monday to Sunday, 09:00 - 24:00 (include public holiday).

- This Promotion cannot be redeemed in conjunction with Galaxy Z Fold4 X Now TV Exclusive Privilege.

-Each Eligible Customer is only entitled to receive one Gift, each Designated Product can only redeem the Gift once and the Gift is not exchangeable for cash.

-The Gift are on a first-come-first-served basis while stocks last.

-Eligible Customers must follow the redemption flow listed above in the promotion details to redeem the Gift.

-The Gift will be forfeited if Eligible Customer fails to redeem the Gift during the designated redemption period. Eligible Customer shall not make any claim against Samsung whatsoever, and Samsung shall not bear any liability whatsoever.

-Samsung reserves the right to disqualify any Eligible Customer from the Gift where it has reasonable grounds to believe that Eligible Customer has violated these Terms and Conditions or any instructions and/or requirements of this Promotion, or that Eligible Customer may have gained an unfair advantage by participating in this Promotion or redeemed Gift using fraudulent means.

- The Gift cannot be transferred or sold, cannot be exchanged for cash or other offers/gifts, and cannot be redeemed in conjunction with other promotion offers/gifts. Samsung reserves the right to change or substitute the Gift with other offers/gifts of a comparable or equivalent value as it deems fit.

- The Gift is only available to an Eligible Customer who purchased the Designated Product for private and domestic use.

-Non-end users (including but not limited to, distributors and resellers) are not eligible to participate in this Promotion.

Each Eligible Customer acknowledges and agrees that Samsung is not the supplier of the Gift. Samsung shall not be held liable for the Gift, including but not limited to, the quality, supply, description or warranty service of the Gift.-Except where expressly provided herein, each Eligible Customer shall bear any costs, expenses and relevant tax payments incurred resulting from participating in this Promotion and no reimbursement may be sought from Samsung.

-By participating in this Promotion, Eligible Customer agrees to exempt and exclude Samsung from all claims or liabilities of any nature arising from participating in this Promotion or otherwise related to this Promotion, including but not limited to, any damage or loss caused by the acquisition, receipt, possession, use or misuse of  the Gift or other reasons, and any claim or ground for litigation of any type or nature which the Eligible Customer may potentially possess based on such damage or loss. The above disclaimer is not applicable to damage or loss caused by fraud (including misrepresentation), or death or personal injury caused by negligence.

-Terms with the effect of disclaiming liabilities in these Terms and Conditions shall be applied to the fullest extent permitted by applicable laws.

-Each Eligible Customer agrees to indemnify and hold Samsung harmless from and against any and all claims, damages, liabilities, costs and expenses (including legal costs on an indemnity basis) arising from any misconduct or negligence, as well as breach of these Terms and Conditions for which such Eligible Customer is liable.

-If this Promotion is interfered with in any way or is not capable of being conducted due to any reason beyond Samsung's reasonable control, including but not limited to computer system defects, breakdown of web services, virus infection, hacking, technical failure and/or any force majeure events, Samsung reserves the right in its sole discretion to modify, suspend, terminate or cancel this Promotion, in whole or in part, as appropriate. Samsung shall not bear any liability therefrom.

-In the event of any dispute arising from or in connection with this Promotion or relating to the interpretation of these Terms and Conditions, Samsung reserves the right of final decision.

-By participating in this Promotion, each Eligible Customer agrees that any personal data provided in connection with this Promotion will be collected, used and retained by Samsung, its affiliates and its third party service providers (whether in Hong Kong or abroad) (collectively “Data Users”) for the purposes of (i) verifying eligibility and identity of Eligible Customer, and (ii) fulfillment of Gift redemption and other purposes directly related to this Promotion. Such personal data will be kept in strict confidence and not be disclosed to other third party or used for any other purposes without Eligible Customer’s consent. Data Users will collect and use the personal data in compliance with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong) and Samsung Privacy Policy. Please refer to Samsung website (//www.samsung.com/hk_en/info/privacy/) for details of Samsung Privacy Policy, and request for access to or correction of any personal data.

-No person other than the Eligible Customer and Samsung will have any right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong) to enforce these Terms and Conditions or enjoy any benefits therein.

-A Chinese version of these Terms and Conditions is provided for reference only. If there is any inconsistency between the English and Chinese versions, the English version shall prevail.

-These Terms and Conditions and /or any claim or dispute arising from or in connection with this Promotion shall be governed by and construed in accordance with the Laws of Hong Kong, without regard to its conflict or choice of law provisions. The parties agree to the exclusive jurisdiction of the courts of the Hong Kong SAR.

-If any terms in these Terms and Conditions is judged to be illegal, invalid or unenforceable, it shall be replaced by a term which achieves Samsung’s intention to the greatest extent possible, and the validity and enforceability of the rest of the Terms and Conditions shall not be affected.
