Terms and Conditions




1. Introduction
a. The 2020 Samsung Merry Gifting (“Promotion”) will run from 1st November 2020 to 31st December 2020 or while promotional stocks last, whichever is earlier (“Promotion Period”). Samsung Malaysia Electronics (SME) Sdn Bhd (“Samsung”) reserves the right to shorten, extend or cancel the Promotion Period at its sole discretion without prior notice.
b. The sales transaction in this Promotion is between the Participating Outlets (defined below) and Customer. Samsung only provides the recommended retail price (“RRP”) and /or guidance on the redemption on this Promotion.
c. The scope of these terms and conditions is limited to Samsung’s role of hosting this site and organizing this Promotion only.

2. Participating Outlets
This Promotion is available at participating Samsung authorized retail outlets only.

3. TV Promotion Products
a. With every purchase of the following Samsung Consumer Electronic Products (“Promotional Products”), the Customer is entitled for one (1) Free Gift as mentioned below.
b. All Promotion/ Free Gift is on a first come first served basis, while stock last and also subject to stock availability in each participating Samsung authorized retail outlets.

4. Bezel and Studio Stand Promotion Products
Purchase of one (1) unit of the The Frame TV, customer may Purchase with Purchase (PWP) on to the respective promotion item, details of the PWP as below:

a. The Promotion is valid for the following Samsung Consumer Electronic Products (“Promotional Products”) only:
b. Customer will be entitled to redeem one (1) of the Free Gift with purchase of any Promotional Products and/or Purchase with Purchase (PWP) in the schedule below.

8. Redemption Period and details
i. Customer is required to redeem Free Gift through Samsung Promotion Page only at https://www.samsung.com/my/merrygifting2020/tv/.
ii. Redemption of Free Gift is only valid for purchases of any Promotional Products as shown in the table above. Redemption period as below:
• Redemption period starting from 1st November 2020 to 15th January 2021.
• Notification will be sent to you once delivery started
iii. To redeem Free Gift, customer is required to complete the online redemption form and submit to Reward Management System 2.0 (“RMS”) personally with receipt issued under the purchaser’s name.
iv. The submission of redemption form has to be done starting from 1st November 2020 to 15th January 2021 (“Redemption Period”). The redemption is limited to genuine purchasers only.
v. Failure of submission to Reward Management System 2.0 (“RMS”) may result in Free Gift delivery being delayed or the redemption of Free Gift being rejected.
vi. All eligible entries must reach Reward Management System 2.0 (“RMS”) before the expiry of Redemption Period. Any entry received by Reward Management System 2.0 (“RMS”) after 15th January 2021 will be disqualified and considered null and void.
vii. If there is any resubmission case, customer is required to provide necessary information by 20th January 2021; otherwise you will no longer be able to redeem your free gift.
viii. No extension of redemption period will be allowed.
ix. Samsung shall not be liable for any failure on the part of the customer who fails to submit the redemption within the stipulated timeline and/or required documents within the stipulated timeline and/or delivery cannot be performed due to wrong or inadequate details provided.
x. Samsung reversed the right to request serial number photo for verification purpose.
xi. The submission of redemption form is considered as eligible entries if the following three (3) requirements have been fulfilled:
(a) Purchaser’s personal details stated in the Redemption Form are complete, genuine and accurate;
(b) A scanned copy of the original invoice / receipt with Samsung TV model code and serial number attached therewith;
(c) The receipt issued under the name of the purchaser.
xii. Free Gift shall be delivered to customer within 4 weeks upon receipt of the validation notification email from Samsung.
xiii. Samsung reserves the right to reject incomplete forms and/or reject the purchaser’s right of redemption without prior notice if Samsung suspects the redemption form or any redemption documents appear to be fraudulent or if Samsung believes that the redemption is not in accordance with these terms and conditions.

9. General Terms and Conditions
a. The Promotion is available during the Promotion Period only.
b. The free gifts and/or PWP items are on first come first served basis and while stocks last.
c. Free gift(s) are only applicable for the purchase made under the participating Samsung authorized dealers during the Promotion Period.
d. The free gift is not redeemable for cash, not exchangeable or transferable, and cannot be used in conjunction with other promotional offers.
e. Samsung reserves the right to change the colour of the Free Gift item subject to stock availability.
f. Product display sets purchases, B2B purchases and staff purchases are not entitled to the Free Gift.
g. Samsung reserves the rights to change the free gifts and/or promotion items with products of similar value without any prior notice.
h. By participating in this Promotion, consumer fully and unconditionally agrees to and accepts the Terms and Conditions stated herein and the decisions of Samsung on every aspect of this Promotion shall be final and binding.
i. All pictures and/or images of the promotional products found in any advertising and marketing materials are for illustration purposes only and may be different from the actual products.
j. Samsung reserves the right to amend these Terms and Conditions without prior notice to the extent permitted by law.
k. Samsung shall not be liable in any way for any costs, expenses, damages, liability or injury arising out of or in any way connected with the Promotion.
l. By participating in this Promotion, each consumer agrees to release and hold Samsung and its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, licensees, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Promotion or resulting from acceptance, possession, use or misuse of the free gifts, or travel to or from any gift-related activity, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
m. In case of any dispute, Samsung reserves the right to make the final decision. Samsung’s decision is final and no further correspondence or appeal will be entertained.
n. During the Promotion Period, Samsung may collect consumers information including personal information in the form of, among others, survey forms, (whether on our own or by appointed service provided) taken during the Promotion. By participating in the Promotion, you agree that the collection of such information will be processed, handled and use in accordance with the Samsung Privacy Policy at http://www.samsung.com/my/info/privacy.html.
o. These Terms and Condition herein shall be governed by and interpreted in accordance with Malaysian law and the parties submit to the exclusive jurisdiction of the Malaysian courts.

Samsung Malaysia Electronics Year End Promotion


TERMS AND CONDITIONS


1.Introduction: Year End Promotion (“Campaign”) is organised by Samsung Malaysia Electronics (SME) Sdn. Bhd. (“Samsung”).

2.Campaign Period: The Campaign will take place from 4th December 2020 (Friday) to 3rd January 2021 (Sunday) (“Campaign Period”). Samsung reserves the right to amend the Campaign Period at any time as they deem fit without prior notice.

2. Promotions
There are two (2) types of promotions. By participating in the Promotions, Customer will be entitled to the following:-
a. Promotion A: Gift Redemption
The selected Eligible Model for the Gift Redemption Promotions are set out in the table below. Model not in this list below, are not entitled to any Gift Redemption gift(s).

The Free Gift with the purchase of selected Eligible Model mentioned above is on a first-come, first-served basis and also subject to stock availability in each Participating Outlets. Samsung reserves the right to modify the quantity or the colour of the said Free Gift at its sole discretion, without any prior notice.

The following are the three (3) steps for the Gift Redemption Promotions redemptions

The breakdown of the Free Gift is as below. The Free Gift allocated are for Participants nationwide throughout the Campaign Period.

Samsung shall not be liable if the Customer fails to submit or complete the redemption. Samsung reserves the right to modify the quantity, extend or shorten the redemption period at its sole discretion without any prior notice.

b. Promotion B: Galaxy Life Bundle
i. Fixed Bundle
This promotion is only applicable to the following purchase of Participating Model:-

• Samsung Galaxy Tab S7+ (RRP: RM4,599);
• Samsung Galaxy Tab S7 (RRP: RM3,299);
• Samsung Galaxy Watch3 Bluetooth, 45mm (RRP: RM1,799); and
• Galaxy Watch3 Bluetooth, 41mm (RRP: RM1,699).

Customer is entitled to the following:-
• One (1) Galaxy Buds Live (RRP: RM699) with every purchase of Samsung Galaxy Tab S7+ or Samsung Galaxy Tab S7; or
• One (1) Galaxy Buds+ (RRP: RM599) with every purchase of Samsung Galaxy Watch3 Bluetooth, 45mm or Galaxy Watch3 Bluetooth, 41mm.
The following are the two (2) steps for Samsung Galaxy Buds Live and Samsung Galaxy Buds+ redemption:

The Free Gifts of Galaxy Buds Live and Galaxy Buds+ are limited to the first 2,500 Customers nationwide for the Participating Model, at Participating Outlets on a first-come, first-served basis and also subject to stock availability in each Participating Outlets. Samsung reserves the right to modify the quantity or the colour of the said Free Gifts at its sole discretion, without any prior notice.

ii. Flexi Bundle
Customer will be entitled to enjoy the discounted price, for the purchase of minimum one (1) unit of Samsung Galaxy Note20 (RRP: RM3,899) or Samsung Galaxy Note20 5G (RRP: RM4,299) or Samsung Galaxy Note20 Ultra 5G (RRP: RM5,199) or Samsung Galaxy S20FE 5G (RRP: RM3,399) -

• Only Customer of Samsung Galaxy Note20 Series and Samsung Galaxy S20FE 5G are also entitled to current promotions.
Only Customer that purchased Galaxy Watch3 entitled to redeem the Samsung Wireless Charge via Samsung Redemption

5. Eligibility
The Promotion is open to all Malaysian and non-Malaysian of 18 years old and above (as of Promotion Period); except Samsung's employees (and their immediate families), its related agencies, retailers and dealers.

6. Payment
a) Customer acknowledges, understands and agrees that all transactions are between Customer and Participating Outlets only. Samsung only acts as the coordinating party and is not involved or a party of any monetary/sale and purchase of this transaction.
b) Customer is not allowed to cancel the purchase, change the selected device color or model, once Customer paid the full amount of the purchased unit.
c) Payment is strictly not refundable and/or not transferrable.

7. Limitation of Liability
a) To the extent permitted by applicable law, Samsung excludes all express or implied warranties, terms and conditions including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
b) Customer shall assume full responsibility in case of any accident, damage or claim resulting from participating in this Promotion.
c) Customer shall be deemed to be able to perform legally binding contract upon his/her submission of the purchase and there shall not be any refund or costs whatsoever arising from his/her violation of the minimum age stated herein.
d) Warranty of the purchased device is subject to standard product warranty coverage as per terms and conditions stated at http://www.samsung.com/my/support/warranty. Customer is advised to check the website from time to time and stay informed for any changes on the terms and conditions of the warranty.
e) All transportation, personal costs and/or any other costs, fees and/or related expenses arising out of or in connection with this Promotion are the Customer's sole responsibility.

8. Indemnity
Customer will fully indemnify and hold Samsung (and our affiliates and subsidiaries, and our and their respective officers, directors, employees, agents) harmless from any claim or demand, including reasonable legal fees, made by himself/herself or any third party due to or arising out of his/her breach of these Terms and Conditions, improper use of the site or breach of any law or the rights of a third party.

9. Privacy
By providing Customer's personal data, Customer is indicating that he/she has read, understood and agreed that his/her personal data will be recorded, stored or otherwise processed in accordance to Samsung's Privacy Policy available at http://www.samsung.com/my/info/privacy.html.

10. General
a) Samsung reserves the right to make amendments to the Terms and Conditions of the Promotion herein without prior notice.
b) Samsung reserves the rights to change the free gift(s)/promotion mentioned above (as maybe applicable) with product of similar value, without prior notice.
c) All pictures and/or images of the product(s) and free gift(s) found in any advertising and marketing materials are for illustration purposes only and may be different from the actual products.
d) Samsung reserves the right to disqualify or reject any submissions/redemptions for free gift(s)/promotional item(s) in our sole discretion, limit or cancel quantities purchased per person or per order. These restrictions may include orders placed by or under the same Customer’s account and/or orders that use the same billing or delivery address. For avoidance of doubt, any cancellation of purchase will not entitle the Customer to any compensation against Samsung for any losses or damages directly or indirectly that may be suffered or incurred by the Customer as a result of the cancellation.
e) In the event of an electronic, computer, operational and/or technical error affecting the details or pricing or quantity of the product or any promotion on the website, Samsung reserves the absolute rights to rectify such error and/or cancel any transaction which has been entered into in reliance of the said error.
f) In case of any dispute, Samsung reserves the right to make the final decision and shall have the right to cancel, disqualify the order, or forfeit the deposit (if applicable).
g) By participating in this Promotion, Customer fully and unconditionally agrees to and accepts the Terms and Conditions together with Samsung's Privacy Policy as stated above.
h) In the event of inconsistencies between the terms and conditions found elsewhere with regard to this Promotion (if any) and the Terms and Conditions herein, the latter shall prevail.
i) These Terms and Conditions herein shall be governed by the laws of Malaysia and the jurisdiction of the courts of Malaysia.
