2021 Stay Strong Malaysia Campaign (Campaign)

(A) Terms and Conditions – TV and Sound Device

1. Introduction: Stay Strong Malaysia Campaign (“Campaign”) is organised by Samsung Malaysia Electronics (SME) Sdn. Bhd. (“Samsung”). The sales transaction in this Campaign is between the Participating Stores (defined below) and customer. Samsung only provides the recommended retail price (“RRP”) and /or guidance on the redemption on this Campaign. The scope of these terms and conditions is limited to Samsung’s role of hosting this site and organizing this Promotion only.

2. Campaign Period: The Campaign will take place from 1^st August 2021 to 31^st October 2021 (“Promotion Period”). Samsung reserves the right to amend the Campaign Period at its sole discretion without prior notice.

3. Redemption Period: Redemption period starts from 1^st August 2021 to 15^th November 2021. No extension of redemption period will be allowed. Samsung reserves the right to amend the redemption terms and conditions and period at its sole discretion without prior notice.

4. Participating Stores: Samsung Online Store, Samsung Authorised Online Store and Samsung Authorised Retail Dealers.

5. Promotional Models: This Campaign is valid with the purchase of any of the following Samsung Consumer Electronic Products (“Promotional Models”) from the Participating Stores. Samsung reserves the right to amend the Promotional Models at its sole discretion without prior notice.

With every purchase of the following Promotional Models, the Customer is entitled to redeem Free Gift (as mentioned herein).

Note: Please refer to Free Gift details set out in Item 6 below.  For Free Gift under Dealer Shop Instant Gift, customer is required to redeem from the respective dealer upon purchase.

8. Redemption of Samsung Free Gift for Promotional Products

a. Following customer purchase in the respective Participating Stores, customer is required to register or sign in to Samsung Account to submit the redemption at Samsung Redemption Management System. Samsung Account is required.

b. Visit https://samsung-redemption.com/customer/#/sasso/MY-gwp-268 and click “redeem now” to complete the online redemption form and submit within Redemption Period. Customer will need to enter the following information:

i. Email

ii. Store of purchase

iii. Date of purchase

iv. Invoice number

v. Model purchased Serial Number

vi. Recipient Name

vii. Delivery Address

viii. Contact Number

ix. Identified Number

x. Upload a copy of Proof of Purchase (the Receipt with Model Code)

c. Uploaded document must be a PDF document or in an image format (jpg, jpeg or png format). Maximum size of each document is 5MB. Any documents with unclear details may delay the redemption process. Any submission after the Redemption Period will be void.

d. The redemption request will be processed by Samsung fulfilment partner within 10 business days from redemption submission date and the Free Gift will be delivered to Customer within 30 working days after the end of the Campaign/Promotion Period. Email notification will be send out with delivery tracking number.

e. Customer is not allowed to choose any colour on the Free Gift. The Free Gift will be delivered to Customer based on Free Gift colour availability. Any request to change colour of the Free Gift will not be entertained

f. Free gifts arrival time may differ subject to delivery area.

g. It is the responsibility of the purchaser to ensure all the details stated in the redemption form is accurate. Each email address/ recipients’ name/ recipients’ address/ mobile numbers/ invoice can only have a maximum of 5 times submission provided all the proof of purchase /receipt is valid. The information stated in the redemption form cannot be changed once is submitted.

h. Samsung reserves the right to reject any purchaser/customer redemption without any prior notice in the event of the following:

1. redemption form is incomplete;

2. redemption form exceed the maximum number of redemption;

3. receipt address is Samsung Partners outlet address;

4. delivery address is incomplete or wrong or non acceptance of the parcel;

5. redemption form or any redemption documents appear to be fraudulent ;

6. redemption form is not accordance with the terms and conditions;

7. if Samsung believes the redemption is fraud or any irregular transaction or being manipulated in any whatsoever manner.

i. If any of the redemption item(s) are return to Samsung or the Appointed Delivery Service Provider “unclaimed”, Samsung will email to the customer to arrange for re-delivery of the redemption item subject to customer reply to the said email within the stipulated timeline. Samsung may impose a delivery charges on the re-delivery.

j. Samsung shall not be liable for any failure on the part of the customer who fails to submit and/or resubmit the complete redemption form with all the supporting documents within the stipulated timeline and /or any delay or non delivery, lost or delivery cannot be performed due to wrong or inadequate details provided.

9. Redemption of Free Art Store Subscription (3 months)

a. Free 3 months Art Store Subscription (‘Art Store Trial Subscription”) upon purchase of promotional models limited to The Frame series.

b. Customer must have an active Samsung Account in order to redeem Art Store Trial Subscription e-coupon.

c. The e-coupon is available to download through the Samsung TV Promotion App.

d. If customers are not planning to utilise the Art Store e-coupon immediately, customer may download it beforehand and it will be stored in the Promotion App for 2 years.

e. E-coupon will be auto applied upon Customers completed the registration with their valid payment details.

f. No charges will be incurred during Art Store Trial Subscription period. Charges will only be incurred after the expiry of Art Store Trial Subscription service.

g. The Art Store Subscription transaction if accepted and subscribed by the customer is only between Art Store and customers. Samsung only acts as the coordinating party and is not involved in or a party of any transaction under this subscription. Customers are advised to read and understand the terms and conditions set by Art Store and agree to the same before you proceed with the subscription accordingly.

 
OTHER GENERAL TERMS AND CONDITIONS

1. The Campaign is valid during the Promotion Period only.

2. The Free Gifts are on first come first served basis and while stocks last.

3. The Free Gifts is not redeemable for cash, not exchangeable or transferable and cannot be used in conjunction with other promotional offers.

4. Free gift(s) are only applicable for the purchase made under the Participating Stores during the Promotion Period.

5. Samsung reserves the rights to change the promotion items or the Free Gift item with products of similar value without any prior notice.

6. Samsung reserves the right to change the colour of the Free Gift item without any prior notice.

7. Samsung reserves the right to disqualify or reject any submission/ redemptions for the Free Gifts redemption in its sole discretion, in the event of any violation of any of the Terms and Conditions.

8. Product display sets purchases, B2B purchases staff purchases, EPP purchases are not entitled to the Free Gift.

9. The indicated price is Recommended Retail Price (RRP). Both RRP and Promo RRP (if any) are subject to change without prior notice.

10. By participating in this Promotion, consumer fully and unconditionally agree and accept the Terms and Conditions stated herein and the decisions of Samsung on every aspect of this Promotion shall be final and binding.

11. All pictures and/or images of the promotional products found in any advertising and marketing materials are for illustration purposes only and may be different from the actual products.

12. Samsung reserves the right to amend these Terms and Conditions without prior notice to the extent permitted by law.

13. Samsung shall not be liable in any way for any costs, expenses, damages, liability or injury arising out of or in any way connected with the Promotion.

14. In the event of an electronic, computer, operational and/or technical error affecting the details or pricing or quantity of the product or any promotion on the website, Samsung reserves the absolute rights to rectify such error and/or cancel any transaction which has been entered into in reliance of the said error without any liability to any party.

15. By participating in this Promotion, each consumer agrees to release and hold Samsung and its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, licensees, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Promotion or resulting from acceptance, possession, use or misuse of the free gifts, or travel to or from any gift-related activity, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

16. In case of any dispute, Samsung reserves the right to make the final decision. Samsung’s decision is final and no further correspondence or appeal will be entertained.

17. During the Promotion Period and Redemption Period, Samsung may collect consumers information including personal information in the form of, among others, survey forms, (whether on our own or by appointed service provided) taken during the Promotion. By participating in the Promotion, you agree that the collection of such information will be processed, handled and use in accordance with the Samsung Privacy Policy at http://www.samsung.com/my/info/privacy.html.

18. These Terms and Condition herein shall be governed by and interpreted in accordance with laws of Malaysia and the parties submit to the exclusive jurisdiction of the Malaysian courts.

(B) Terms and Conditions – Digital Appliances

1. Introduction: Stay Strong Malaysia Campaign (“Campaign”) is organized by Samsung Malaysia Electronics (SME) Sdn. Bhd. (“Samsung”). The sales transaction in this Campaign is between the Participating Stores (defined below) and customer. Samsung only provides the recommended retail price (“RRP”) and /or guidance on the redemption on this Campaign. The scope of these terms and conditions is limited to Samsung’s role of hosting this site and organizing this Campaign only.

2. Campaign Period: The Campaign will take place from 1^st August 2021 to 31^st October 2021 (“Promotion Period”). Samsung reserves the right to amend the Campaign Period at any time as they deem fit without prior notice.

3. Redemption Period: Redemption period starts from 1^st August 2021 to 15^th November 2021. No extension of redemption period will be allowed. Samsung reserves the right to amend the period at any time as they deem fit without prior notice.

6. Redemption Process

1. Following your purchase, you can submit your redemption to Samsung Redemption Management System visit https://samsung-redemption.com/customer/#/sasso/MY-gwp-273 and click “redeem now” to complete the online redemption form and submit within redemption period.

8. If any of the redemption item(s) are return to Samsung or the Appointed Delivery Service Provider “unclaimed”, Samsung will email to the customer to arrange for re-delivery of the redemption item subject to customer reply to the said email within the stipulated timeline. Samsung may impose a delivery charges on the re-delivery.

9. Samsung shall not be liable for any failure on the part of the customer who fails to submit and/or resubmit the complete redemption form with all the supporting documents within the stipulated timeline and /or any delay or non delivery, lost or delivery cannot be performed due to wrong or inadequate details provided.

10. For Touch ‘n Go eWallet credit, Customer will receive notification by e-mail from the appointed fulfilment party THINKINGIFTS SDN BHD (“Thinkingifts”). By providing your personal information including name, contact numbers, email address and other information to Samsung, Samsung can use and/or disclose to Thinkingifts for the purposes of fulfilment.

11. Touch ‘n Go eWallet Credit will be delivered to customer in the form of a unique code that can be redeemed in Touch ‘n Go eWallet app. The redemption must be completed within 21 working days upon receiving of unique code from Thinkingifts. First reminder will be sent by Thinkingifts if no utilization of Touch ‘n Go eWallet credit within 14 working days upon receiving unique code via email. Failing which the redemption submission will be considered as null and void. Samsung shall not be liable if customer fails to submit the redemption within the stipulated time.

Illustration on Free Gift redemption

Customer is allowed to submit one (1) entry per unit of purchase of a Promotional Model. Customer who purchase more than one (1) unit of Promotional Model, under the same consumer tax invoice, is also entitled to submit one (1) entry for each unit purchased, but limited up to 5 submission per invoice number. For the avoidance of doubt, the submission is based on the purchase of Promotional Model with different Product Serial Number.  Please refer to the illustration below.

Other General Terms and Conditions

1. The Campaign is valid during the Promotion Period only.

2. The free gifts and/or PWP items are on first come first served basis and while stocks last.

3. The free gift is not redeemable for cash, not exchangeable or transferable, and cannot be used in conjunction with other promotional offers.

4. Free gift(s) are only applicable for the purchase made under the Participating Stores during the Promotion Period.

5. The redemption of Touch 'n Go eWallet credit is not applicable to those purchases made/combined with other online redemption/voucher codes under E-Store.

6. Samsung reserves the rights to change the free gifts and/or promotion items with products of similar value without any prior notice.

2. Promotion Period

This Promotion will run from 1^st August 2021 to 31th October 2021 or while promotional stocks last, whichever is earlier. Samsung reserves the right to shorten, extend or cancel the Promotion Period at its sole discretion without any prior notice.

3. Participating Store

This Promotion is only available at Samsung Online Store operated by Samsung SDS Malaysia Sdn Bhd only.

Terms and Conditions

Samsung Malaysia Electronics 2021 Merdeka Campaign (“Campaign”)

1. Introduction

a. The aforesaid Campaign is organized by Samsung Malaysia Electronics (SME) Sdn. Bhd. ("Samsung"). The terms and conditions and the Privacy Policy (as mentioned below) will be construed as the terms and conditions ("Terms and Conditions") of this Campaign on which Samsung offers you ("Customer") access to and use of this site for the purposes of this Campaign.

b. The sale transaction in this Campaign is between the Participating Outlet(s) (as defined below) and Customer. Samsung only provides the recommended retail price ("RRP") and guidance on this site.

c. Customer agrees to comply with all the above when accessing or using this site. The scope of these Terms and Conditions is limited to Samsung's role of hosting this site and organizing this Campaign only.

2. Campaign

By participating in the Campaign, Customer who purchased the Participating Models as set out below during the campaign period will be entitled to redeem the eligible Free Gift(s), on top of on-going promotion for each Participating Models on a first-come, first-served basis, while stocks last. The details of Participating Models and Free Gift(s) as below:

3. Campaign Mechanics

a. Gift 1

The following are the eight (8) steps for Free Gift(s) redemption:

i. Customer to go to any Participating Outlets and purchase the Participating Models in Gift 1 during the campaign period.

ii. Following the purchase, Customer to visit Samsung Redemption Management System at https://samsung-redemption.com/customer/#/sasso/MY-evoucher-71 to register or sign in to Samsung Account. After registering or signing in to Samsung Account, Customer will need to enter the following information:

- Email

- Store of purchase

- Date of purchase

- Invoice number

- Model purchased IMEI/Serial Number

- Recipient Name

- Email Address

- Contact Number

- Identified Number

- Upload a copy of Proof of Purchase (the Receipt with Model Code and IMEI/Serial Number)

- Letter of authorization (if necessary)

iii. All redemptions must be submitted via Samsung Redemption Management System between 16^th August 2021, 10:00 a.m. and 30^th September 2021, 11:59 p.m. (“Redemption Period”).

iv. Uploaded document must be a PDF document or in an image format (jpg, jpeg or png format). Maximum size of each document is 5MB. Any documents with unclear details may delay the redemption process. Any submission after the Redemption Period will be void.

v. The redemption request will be processed by Samsung fulfilment partner within 10 business days from redemption submission date and the RM64 Touch ’n Go eWallet Credit Code will be sent to Customer’s registered email/ Samsung Account after the claims have been approved. Customer will not be allowed to change email address after redemption submission.

vi. It is the responsibility of the Customer to ensure all the details stated in the redemption form are accurate. The information stated in the redemption form cannot be changed once submitted. Each email address or invoice can only be used to submit up to a maximum of five (5) redemptions. Each redemption submission must be based on a valid invoice or receipt and a valid Product IMEI/Serial Number. Any duplicate redemption submission based on the same Product IMEI/Serial Number shall be rejected.

vii. Samsung reserves the right to reject any Customer redemption without any prior notice in the event of the following:

- redemption form is incomplete;

- redemption form exceed the maximum number of redemption;

- receipt address is Samsung Partners outlet address;

- redemption form or any redemption documents appear to be fraudulent;

- redemption form is not accordance with the terms and conditions;

- if Samsung believes the redemption is fraud or any irregular transaction or being manipulated in any whatsoever manner.

viii. Samsung shall not be liable for any failure on the part of the Customer who fails to submit and/or resubmit the complete redemption form with all the supporting documents within the stipulated timeline and/or any delay or non-delivery, lost or delivery cannot be performed due to wrong or inadequate details provided.

b. Gift 2 and Gift 3

The following are the three (3) steps for Free Gift(s) redemption:

i. Customer to go to any Participating Outlets and purchase the Participating Models in Gift 2 and/or Gift 3 during the campaign period.

ii. Customer to collect the Free Gift(s) immediately upon purchase of the Participating Models.

iii. Customer is not allowed to choose any colour on the Free Gift(s). Any request to change colour of the Free Gift(s) will not be entertained.

Gift 1 is limited to the first 4,365 Customers; Gift 2 is limited to the first 4,300 Customers and Gift 3 is limited to the first 2,477 Customers nationwide for the Participating Models, on a first-come, first-served basis, while stocks last. Samsung reserves the right to modify the quantity or the colour of the said Free Gift(s) at its sole discretion, without any prior notice.

Samsung Experience Stores (“SES”), Samsung Authorised Retailers, Samsung Online Store @ https://www.samsung.com/my, and Operator.

5. Campaign Period

16^th August 2021 (Monday), 10:00 a.m. – 19^th September 2021 (Sunday), 11:59 p.m.

Samsung reserves the right to shorten, extend or change the Campaign Period at its sole discretion without any prior notice.

6. Eligibility

This Campaign is only applicable for Eligible Customer (who is Malaysian citizen or resident of Malaysia of 18 years old and above as of 16^th August 2021) and NOT applicable to:

i. Dealers and their immediate family members;

ii. Resellers and their immediate family members; and

iii. Samsung's employees (and their immediate families).

7. Customer's Covenants

In connection to this Campaign, Customer will not use this site:

c. To export the unit purchased except in compliance with the export control laws of relevant jurisdictions and in accordance with posted rules and restrictions;

d. In the event if Samsung suspects or discovers that the Customer is abusing this Campaign and/or Samsung in any of the ways mentioned above or otherwise, Samsung may, at our sole discretion, take necessary steps to prevent and mitigate such abuse such as limiting, suspending, or terminating the Customer's user account(s) and access to this site, delaying or removing hosted content, removing any special status associated with Customer account(s), reducing or eliminating any discounts, and taking technical and/or legal steps to prevent Customer from using this site.

8.Limitation of Liability

a. Samsung uses its reasonable effort to keep its site safe, secure, and functioning properly, but Samsung does not guarantee the continuous operation of or access to this site.

b. Customer agrees that he/she is making use of this site at his/her own risk, and that it is being provided to Customer on an "AS IS" and "AS AVAILABLE" basis.

c. To the extent permitted by applicable law, Samsung excludes all express or implied warranties, terms and conditions including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

d. Customer shall assume full responsibility in case of any accident, damage or claim resulting from participating in this Campaign.

e. Customer shall be deemed to be able to perform legally binding contract and there shall not be any refund or costs whatsoever arising from his/her violation of the minimum age stated herein.

f. Warranty of the Participating Models are subject to standard product warranty coverage as per terms and conditions stated in the official corporate website at http://www.samsung.com/my/support/warranty. Customer is advised to check the website from time to time and stay informed for any changes on the terms and conditions of the warranty.

g. All transportation, personal costs and/or any other costs, fees and/or related expenses arising out of the collection of the phone are the Customer's sole responsibility.

9.Indemnity

Customer will fully indemnify and hold Samsung (and our affiliates and subsidiaries, and our and their respective officers, directors, employees, agents) harmless from any claim or demand, including reasonable legal fees, made by himself/herself or any third party due to or arising out of his/her breach of these Terms and Conditions, improper use of the site or breach of any law or the rights of a third party.

10. Privacy

By providing Customer's personal data, Customer is indicating that he/she has read, understood and agreed that his/her personal data will be recorded, stored or otherwise processed in accordance to Samsung's Privacy Policy available at http://www.samsung.com/my/info/privacy.html.

11. General

a. In the event Customer have queries with regard to the Campaign; please call Samsung helpline at 1-800-22-8899 for clarification.

b. Samsung reserves the right to make amendments to the Terms and Conditions of the Campaign herein without prior notice.

c. The Free Gift(s) in this Campaign is not redeemable for cash, not exchangeable, transferable, or refundable, and cannot be used in conjunction with other promotional offers at the Campaign.

d. Samsung reserves the rights to change or replace the Free Gift(s)/promotion item(s) with products of similar value without prior notice.

e. All pictures and/or images of the Free Gift(s) found in any advertising and marketing materials are for illustration purposes only and may be different from the actual products.

l. In the event of inconsistencies between the terms and conditions found elsewhere with regard to this Campaign (if any) and the Terms and Conditions herein, the latter shall prevail.

m. These Terms and Conditions herein shall be governed by the laws of Malaysia and the jurisdiction of the courts of Malaysia.
