Samsung Smart Switch T&Cs

By downloading or using Samsung Smart Switch, you agree to the following:

1. General Use

• Samsung Smart Switch is a tool for transferring your personal data to Samsung devices.

• It includes both a PC application and a mobile app.

• It may suggest Android apps based on those already on your old device.

• Your use is governed by these Terms and Samsung's Privacy Policy.

• You must accept all terms to use Smart Switch.

2. Eligibility

• You must be at least 13 years old.

• If you are under the legal age of majority, a parent or guardian must agree to these terms on your behalf.

• Parents/guardians agree to supervise minors and take full responsibility for their use.

3. License Grant

• You are granted a limited, revocable, non-exclusive, non-transferable license for personal, non-commercial use.

• The software is licensed, not sold.

• Use is limited to your own devices.

4. Permitted Use

• You may transfer content like contacts, messages, apps, and media from your old device to a Samsung device.

• You may only transfer content you own or have permission to use.

5. Restrictions

• You may NOT:

  • Reverse-engineer, modify, distribute, or make derivative works from Smart Switch.

  • Use it with high-risk systems (e.g., nuclear equipment, life support).

  • Attempt to bypass or tamper with its functionality.

• Doing so violates this agreement and is done at your own risk.

6. Network Usage

• Smart Switch may use Wi-Fi, Bluetooth, or mobile networks to transfer data.

• Use "Wi-Fi only" mode to avoid mobile data usage.

7. Intellectual Property

• Smart Switch and its trademarks are owned by Samsung.

• You have no ownership rights in the software.

• Third-party software used in Smart Switch may have its own license terms.

8. Data Collection

• Samsung and authorized partners may collect usage data (e.g., errors, usage patterns) to improve the service.

• Blocking data transmission required for compliance is a violation of this agreement.

9. Termination

• This agreement remains active until terminated by Samsung or you stop using Smart Switch.

• Samsung may suspend or terminate access without notice for violations.

• Samsung may modify or discontinue Smart Switch at any time.

10. Disclaimers

• Smart Switch is provided "as is" with no warranties.

• Samsung does not guarantee uninterrupted or error-free operation.

• Use is at your own risk; Samsung is not responsible for data loss or unauthorized access.

11. Indemnification

• You agree to hold Samsung harmless from any claims or damages resulting from your use (or misuse) of Smart Switch.

12. Limitation of Liability

• Samsung is not liable for indirect, special, incidental, or consequential damages.

• Maximum liability is limited to $100 USD.

• Some limitations may not apply in certain jurisdictions.

13. Compliance

• You agree to follow all applicable local and international laws, especially those related to data export/import.

14. Other Provisions

• This agreement is governed by the laws of your country of residence.

• It represents the full agreement regarding Smart Switch.

• If any part is unenforceable, the rest remains valid.

• Samsung’s failure to enforce any provision is not a waiver.

• Smart Switch is not affiliated with Apple, Inc. and some DRM-protected content may not be transferable.
