Terms and Conditions
A. Introduction
1. The Samsung Galaxy Z Buy & Try Program (“Program”) is organised by Samsung Malaysia Electronics (SME) Sdn Bhd (“Organiser”).
2. The terms and conditions stated herein and Samsung privacy policy at http://www.samsung.com/my/info/privacy.html will be construed as the terms and conditions ("Terms and Conditions") of this Promotion on which Organiser offers you ("Customer") access to and use of this site for the purposes of this Promotion.
3. The sale transaction in this Promotion is between the Participating Outlets (as defined below) and Customer. Organiser only provides the recommended retail price ("RRP") and/or guidance on this site.
B. Eligibility
1. The Promotion is open to all Malaysians above age 21 years old, except the Organiser’s distributors, retailers, resellers and their employees, who have successfully received the Galaxy Z Buy & Try Exclusive invite QR code from Samsung.
2. The QR code is sent to the first 400 Customers nationwide who successfully registered for the Program. The redemption of the QR Code is conducted on a first-come, first-served basis and while stocks last. Samsung reserves the right to modify the quantities at its sole discretion.
C. Program details
1. The Program allows you sign up for a trial period of fourteen calendar (14) days (“Trial Period”) to use and experience a Galaxy Z Fold2 or Galaxy Z Flip, whereby you must either purchase or return the device within the Trial period. You are only allowed to sign up one (1) device at a time under this Program.

2. To participate in the Program, you are required to pay the upfront Deposit Sum in full, for the device. Payment by instalments will not be allowed for Deposit Sum.
3. If you wish to own the device, you are required to pay the Balance Sum within the Trial Period.
4. If you wish to return the device within the Trial Period, you will receive a full refund of your Deposit Sum, subject to a complete return of the device with its original sales packaging and contents.
5. By participating in this Program, you will be required to:-
(a) complete the sign up process, make payment of the Deposit Sum or Balance Sum, or return the device within the same Participating Outlet; and
(b) provide your personal details as required in the declaration form and provide a copy of your identification card.
6. All devices in the Program will be pre-installed with Knox Guard software, which will be removed if you choose to own / purchase the device within the Trial Period.
7. By participating in this Program, Customer agrees to be solely liable to Samsung for the damage or loss caused on the device during the Trial Period.
D. Mechanics
1. The following is the consumer journey to participate in the Program:

Customer registers for the Program online, and receives an exclusive invite via QR code. |

Customer walks in to the Participating Outlet to sign up for a trial of one (1) Galaxy Z Fold2 or Galaxy Z Flip, and produces their exclusive invite QR code for verification by Dealer. |

Step 3 |
Customer signs the declaration form and pays the Deposit Sum for the selected device. |
|
Step 4 |
Customer will have a trial period of fourteen (14) calendar days to use the device, and must return to the store within the trial period to either complete the purchase or return the device. |
Purchase device within Trial Period
2. If you wish to keep the device, you are required to return to the Participating Outlet at which you paid the Deposit Sum, within the Trial Period to pay the Balance Sum for the device.
3. Upon completion of the purchase, you will be entitled to receive one (1) e-voucher as follows:-

Key in the e-voucher code at checkout to apply the voucher amount to your transaction.
Note: if the purchased item is lesser than the voucher value, a minimum amount of RM1 will be charged. E.g., you purchase an item at RM250, and checkout with e-voucher value at RM500. You will be required to pay RM1 for this transaction. |

4. Below are the steps to redeem your e-voucher:-

Login to the RMS portal. |

Fill in required information and upload a scanned copy of the signed declaration form, invoice for deposit payment and invoice for payment of the balance amount. |

Once has been approved, the e-voucher will be sent to you via email. |
5. Terms of usage of the eVoucher as below,
a. Maximum 1 (ONE) item can be purchase with the given eVoucher.
b. No change or credit given in the event that the voucher value exceeds the total cost of the purchased item
c. If the purchased item is below the voucher value, a minimum amount RM1 will charge. (eg, purchase item price at RM250, customer checkout with eVoucher value at RM350. Customer will be required to pay RM1 in this transaction.)
Return device within Trial Period
6. If you do not wish to purchase the device, you must return the device within the Trial Period. You are required to return the device, complete in its original sales packaging and contents, to the Participating Outlet at which you paid the Deposit Sum.
7. You will receive a full refund of your Deposit Sum, which will be return / process via the same payment method which the deposit was made and within same business days. (For credit card refund, actual refund day subject to respective bank processing period)
8. The returned device must be in sellable condition, i.e. functioning and free from signs of physical damage. You shall be liable to purchase the device in the event that you return a faulty or damaged device.
9. In the event that you did not return the device within the Trial Period, the Participating Outlet will make three (3) attempts to contact you via phone call within the next seven (7) days. If you are still uncontactable, Samsung reserves the right to lock the device and take further recovery action against you.
10. You are solely responsible to inform the Participating Outlet of any difficulty in completing the payment or returning the device.
E. Promotion Period
1. 5 May 2021 (Saturday) – 15 June 2021 (Tuesday) or while stocks last, whichever is earlier.
2. Samsung reserves the right to shorten, extend or cancel the Promotion Period without prior notice.

G. Liability and Responsibility
1. All transportation, personal costs and/or any other costs, fees and/or related expenses that are incurred for this Promotion are the sole responsibility of Customers.
2. By participating in this Promotion, each Customer agrees to release and hold the Organiser and its employees, officers, directors, shareholders, agents, representatives, parent companies, affiliates, subsidiaries, licensees, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Promotion or resulting from acceptance, possession, use or misuse of the promotion items including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
H. Rights of the Organiser
1. In case of any dispute, the Organiser reserves the right to make the final decision. The Organiser’s decision is final and no further correspondence or appeal will be entertained.
I. General
1. By participating in this Promotion, Customer fully and unconditionally agrees to and accepts the Terms and Conditions stated herein and decisions of the Organiser. Customer further agrees that the Promotion is subject to the terms and conditions set by the relevant participating dealer (be it online or physical outlet).
2. By participating in this Promotion, Customers agree to grant the Organiser and their respective parent companies, subsidiaries, affiliates, licensees, directors, officers, agents, independent contractors and advertising/promotion agencies the use of his/her name, details submitted, pictures and videos for all communication materials, without further compensation, unless prohibited by law.
3. The Organiser reserves the right to amend these Terms and Conditions without prior notice.
4. During the Promotion Period, Organiser may collect consumer’s information (whether on our own or by appointed service provided) for the purposes relating to this Promotion. By participating in the Promotion, you have read and agreed with the Samsung Privacy Policy at http://www.samsung.com/my/info/privacy.html.
5. Organiser shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) and/or for personal injury which is suffered or sustained arising from or in connection with the Promotion.
6. In the event of an electronic, computer, operational and/or technical error affecting the details or pricing or quantity of the product or any promotion on the website, Organiser reserves the absolute rights to rectify such error and/or cancel any transaction which has been entered into in reliance of the said error.
7. In the event of inconsistencies between the terms and conditions found elsewhere with regard to this Promotion (if any) and the Terms and Conditions herein, the latter shall prevail.
8. These Terms and Conditions herein shall be governed by the laws of Malaysia and the jurisdiction of the courts of Malaysia.
