SAMSUNG COMPETITION TERMS AND CONDITIONS
These terms and conditions (“General Competition Ts &Cs”) apply to every competition ("Samsung Competition") initiated and promoted by Samsung Electronics South Africa Proprietary Limited (registration number 1994/003872/07) ("Samsung") or its authorised agents, on the Samsung.com Online Store (“Samsung Online Store”) and/or on the Samsung shop application (“Samsung Shop App”) unless stated otherwise in the specific terms and conditions (“Competition Specific Ts & Cs”) or promotional material of a specific competition which includes, without limitation announcements published on the Samsung Online Store, Samsung Shop App, official Samsung Social Media accounts (including reels, stories, posts, and comments), as well as website banners, prompts, pop‑ups, newsletters, posters, and flyers ("Competition Specific Marketing").
Each person who enters a Samsung Competition ("Entrant" or "You") agrees to be bound by the General Competition Ts & Cs as set out below, in addition to any terms and conditions set out in the Competition Specific Marketing and Competition Specific Ts & Cs.
By entering into a Samsung Competition, You acknowledge that You have read, understood and agree to the following General Competition T&C’s along with any Competition Specific Marketing and Competition Specific Ts & Cs:
1 ENTRY INTO A SAMSUNG COMPETITION
1.1 Entrants agree that certain information and associated terms and conditions regarding a Samsung Competition appear in the Competition Specific Marketing and the Competition Specific Ts & Cs but that the General Competition Ts & Cs set out in this document will also apply to the Samsung Competition.
1.2 The relevant information which will appear in Competition Specific Marketing that is published on www.samsung.com/za includes but is not limited to –
1.2.1 the Samsung Competition name and website link
1.2.2 the nature of the Samsung Competition
1.2.3 the prize which Entrants stand a chance to win by entering into a specific Samsung Competition (“Prize”)
1.3 The relevant information which will appear in the Competition Specific Ts & Cs includes but is not limited to –
1.3.1 the duration of the Competition including the start date ("Competition Commencement Date"), the deadline for entry and the projected dates on which the Winner (as defined below) will be chosen and announced;
1.3.2 specific entry criteria, either in addition to or in substitution of the general entry criteria as set out in clause 1.6 below;
1.3.3 the manner in which a Prize may be redeemed by the Entrant or Entrants (as the case may be) who win(s) the Prize ("Winner"); and
1.3.4 the way the random draw to determine the Winner will be conducted ("Draw") and the date of such Draw and the announcement of the Winner;
1.4 In the event of any inconsistency or conflict between the Competition Specific Ts & Cs, Competition Specific Marketing and the General Competition Ts & Cs the order of precedence as stated in clause 11.2 shall apply.
1.5 Entering a Samsung Competition does not guarantee, imply or suggest that You will be the Winner or that You will receive the Prize or any other compensation for Your entry.
1.6 General Entry Criteria - In order to enter a Samsung Competition, You must be –
1.6.1 a natural person and at least 18 (eighteen) years old, as at the Competition Commencement Date;
1.6.2 a citizen or legal resident of the Republic of South Africa ("South Africa") and residing in South Africa at the Competition Commencement Date;
1.6.3 in possession of a valid Identity Document or residency permit as the case may be; and
1.6.4 In the event that the Prize of the Samsung Competition is a Television, the Entrant must be in possession of a valid South African TV License issued by the SABC, which TV license must be registered in the name of the Entrant.
1.7 Samsung, its directors, members, partners, employees, agents, consultants, any other related person or any supplier of goods and services in connection with the Samsung Competition and their spouses, life partners, parents, children, siblings, business partners or associates are prohibited from entering into a Samsung Competition.
1.8 Each Entrant is responsible for ensuring that any information provided in the Entrant's entry into a Samsung Competition is true, accurate and correct at the time of entry.
1.9 Samsung accepts no responsibility for entries with incorrect information, or lost, misdirected, illegible, late or damaged entries. Entries that do not comply with the General Competition Ts & Cs or any specific requirements set out in the Competition Specific Ts & Cs or the Competition Specific Marketing will be disqualified, subject to clause 1.10 below.
1.10 Errors and/or omissions may be accepted at Samsung's discretion. The failure by Samsung to enforce any of its rights at any stage does not constitute a waiver of those rights.
1.11 Persons purchasing Samsung products from (1) any physical Samsung branded store, (2) Samsung employee purchasing programs (“EPP”) or (3) any affiliate store or website which sell Samsung products are specifically excluded and are not eligible to participate in a Samsung Competition.
1.12 Entries will be invalid –
1.12.1 if they are submitted by a third party on behalf of an Entrant;
1.12.2 if they are illegible, have been altered, reconstructed, forged or tampered with; and/or
1.12.3 if they are incomplete.
2 PLATFORMS THROUGH WHICH SAMSUNG COMPETITION ARE CONDUCTED
2.1 Social Media Platforms
2.1.1 Where a Samsung Competition is conducted through Social Media Platforms, the following will apply:
2.1.1.1 “Social Media/ Social Media Platforms” means social media platforms which include but are not limited to, Facebook, X, TikTok, YouTube, and Instagram.
2.1.1.2 “Feeds” shall mean continuously updating, scrollable stream of content—including text, images, videos, and links—that appears on a homepage or app screen which includes without limitation Newsfeed on Facebook, Home timeline on X, and For You Page on TikTok.
2.1.1.3 “Official Samsung Account” refers exclusively to all verified Social Media accounts operated by Samsung which includes without limitation the following –

2.1.2 To participate in a Samsung Competition conducted through Social Media, You must comply with the following:
2.1.2.1 all engagements/interactions on Social Media and entry into the Samsung Competition must be in English;
2.1.2.2 hold a Social Media account that is active, valid, and in good standing (not suspended, restricted, or otherwise limited);
2.1.2.3 refrain from using automated tools, bots, or any deceptive means to generate an entry;
2.1.2.4 Your entry may not contain any foul or offensive language, obscenities, defamation, hate speech or any otherwise inappropriate content;
2.1.2.5 you may not submit content that may infringe on the intellectual property, privacy, or other rights of any third party;
2.1.2.6 submit original content created by You, and not content copied or reproduced from another source; and
2.1.2.7 not create or use fake, duplicate, or multiple Social Media accounts for the purpose of entering the Samsung Competition.
2.1.3 Should You fail to comply with any or all of the aforementioned requirements You will automatically be disqualified from the Samsung Competition
2.1.4 Where a Samsung Competition is conducted through Social Media, the Entrant must comply with the requirements as set out in the Competition Specific Marketing and the Competition Specific Ts & Cs which may include any of the following mechanisms:
2.1.4.1 “Like” and “Comment” on a Samsung related post using a specific hashtag as provided by Samsung and share the post and tag the Official Samsung Account;
2.1.4.2 “Share” a Samsung related post on Your Social Media stories, reels and/or Feed by tagging the Official Samsung Account using a specific hashtag as provided by Samsung.
2.1.4.3 “Choose an option below and add a specific hashtag” as provided by Samsung and tag the Official Samsung Account.
2.1.5 A specific hashtag to be utilised in a Samsung Competition will always be provided by Samsung in a Social Media post from an Official Samsung Account.
2.1.6 Where a Samsung Competition requires You to tag Samsung in a Social Media post, only the official and authorized Official Samsung Accounts may be used.
2.1.7 Entrants that tag accounts from other Samsung subsidiaries or countries will not be considered valid and shall not qualify.
2.1.8 Samsung shall not be liable or responsible for any loss, damage, or injury suffered by any Entrant who participates in a competition that purports to be organised by Samsung but is not run through an Official Samsung Account.
2.1.9 Unless specifically stated otherwise, a Samsung Competition is in no way sponsored, endorsed or administered by, or associated with, any Social Media platform.
2.2 Samsung Live Shopping
2.2.1 Samsung Live Shopping is an interactive online shopping experience brought to You by Samsung Online Store or Samsung Shop App, where customers can view live‑streamed product demonstrations, presentations, and promotions hosted by Samsung or its partners on an Official Samsung Account on Social Media Platforms and/or Samsung Online Store or Samsung Shop App. During these demonstrations, presentations, and promotions, viewers may purchase featured Samsung products through the Samsung Online Store or Samsung Shop App.
2.2.2 Samsung Competitions may be conducted during Samsung Live Shopping.
2.2.3 When a Samsung Competition is conducted during Samsung Live Shopping, the Competition Specific Ts & Cs may be communicated by the host of the Samsung Live Shopping and will also be communicated through the comments and chatbox on the Social Media Platform, Samsung Online Store or Samsung Shop App in addition to being published on www.samsung.com/za
2.2.4 To participate in a Samsung Competition conducted through Samsung Live Shopping, You must comply with the following:
2.2.4.1 Your entry into the Samsung Competition as well as all engagements and/or comments made by You during Samsung Live Shopping must be in English and must not contain foul or offensive language, obscenities, defamatory statements, hate speech, or any other inappropriate content;
2.2.4.2 submit an entry only during the “live stream” and within the time period specified by Samsung, as entries received outside of this period will not be considered valid;
2.2.4.3 hold a Social Media account that is active, valid, and in good standing (not suspended, restricted, or otherwise limited);
2.2.4.4 not create or use fake, duplicate, or multiple Social Media accounts for the purpose of entering the Samsung Competition.
2.2.4.5 refrain from using automated tools, bots, or any deceptive means to generate an entry
2.2.4.6 you may not submit content that may infringe on the intellectual property, privacy, or other rights of any third party;
2.2.4.7 submit original content created by You, and not content copied or reproduced from another source;
2.2.4.8 You consent to Samsung recording, reproducing, or redistributing Samsung Live Shopping content, including any comments You post, without requiring further permission, provided such use is consistent with applicable laws; and
2.2.4.9 acknowledge and agree that Your participation in Samsung Live Shopping, including any comments or interactions, will be visible to the public.
2.2.5 Should You fail to comply with any or all of the aforementioned requirements You will automatically be disqualified from the Samsung Competition.
2.2.6 Where a Samsung Competition is conducted through Samsung Live Shopping, the Entrant must comply with the requirements as set out in the Competition Specific Ts & Cs which may include any of the following mechanisms:
2.2.6.1 “Like” and “Comment” – A Entrant must like and comment in the comment section of Samsung Live Shopping using a specific hashtag as provided by Samsung during the live stream;
2.2.6.2 “Answer Correctly” – Samsung may provide a question, either in the comment section or verbally, during Samsung Live Shopping and Entrants should provide the correct answer to the question in the comments section;
2.2.6.3 “Polls” - Samsung may present one or more poll questions or “chose one” polls during the live stream and Entrants must submit their vote through the designated poll function provided on the Samsung Live Shopping platform.
2.2.7 Samsung reserves the right to correct any and all errors or inaccuracies in relation to the following, at any time during the “live stream”:
2.2.7.1 Prize
2.2.7.2 product descriptions,
2.2.7.3 Samsung Competition entry mechanisms,
2.2.7.4 pricing, or
2.2.7.2 availability of products
2.2.8 Streaming services may be interrupted, delayed, or unavailable due to technical issues and Samsung shall not be liable for Your inability to participate in the Samsung Competition as a result of such connectivity issues or failures.
2.2.9 Recordings of prior Samsung Live Shopping as well as previously published Social Media posts and other archived promotional content, may remain accessible after the conclusion of a Samsung Competition. Entrants are therefore responsible for ensuring that they refer only to the Competition Specific Material that appears prior to or during the Samsung Competition. Samsung shall not be liable for any confusion, misinterpretation, or reliance on post-dated or outdated published promotional content.
2.3 Samsung Members Application
2.3.1 Samsung Members Application is an official Samsung customer engagement platform, available as a mobile application and online community. It provides Samsung Galaxy device users with access to product support, exclusive content, community discussions, and special offers.
2.3.2 For any Samsung Competition conducted through Samsung Members Application, the Entrant must:
2.3.2.1 have downloaded the Samsung Members Application from the Samsung Galaxy Store or Google Play Store on a Samsung device and be a registered subscriber of the Samsung Members Application managed by Samsung;
2.3.2.2 respond to the call to action for the Samsung Competition as set out in the Competition Specific Marketing posted on the Samsung Members Application and Samsung Members community and then click and follow the prompts provided;
2.3.2.3 participate using a genuine, active, and valid Samsung Members Application account in good standing, and not create or use fake, duplicate, or multiple accounts for the purpose of entering the Samsung Competition.
2.3.3 The Entrant is bound by the Samsung Members Application terms and conditions, where more specifically, only one (1) account per device is permitted to be registered for use of the Samsung Members Application. Should there be any dispute in this regard, Samsung shall be sole adjudicator of the dispute and Samsung’s decision shall be final.
2.3.4 To the extent that these General Competition Ts and Cs conflict with the terms and conditions of Samsung Members Application, these General Competition T&Cs will take precedence.
3 RATE & REVIEW SAMSUNG COMPETITION
3.1 Rate and Review Samsung Competitions are promotional competitions conducted by Samsung where Entrants are invited to submit ratings and written reviews of Samsung products or services on the Samsung Online Store or Samsung Shop App.
3.2 For any Rate & Review Samsung Competition, You must:
3.2.1 Participate using a genuine, active and valid email account and not create or use fake, duplicate or multiple email accounts for the purposes of entering the Samsung Competition;
3.2.2 ensure that any review submitted is in English and does not contain foul or offensive language, obscenities, defamatory statements, hate speech, or any other inappropriate content including but not limited to service complaints or general queries not relating to the Samsung Product’s quality or functionality, competitor comparisons (such as pricing and availability), or links to external sites;
3.2.3 ensure that Your review does not infringe upon the intellectual property, privacy, or other rights of Samsung, its associated companies, or any third party;
3.2.4 ensure Your review is unique and not a duplicate of the same product reviewed by either Yourself or any other individual;
3.2.5 provide satisfactory proof of ownership of the Samsung product reviewed by You, if ownership of a Samsung product is a prerequisite for participation in the Samsung Competition, upon request by Samsung.
3.2.6 review Your Samsung product, as owned and/or used by You, on the Samsung Online Store or Samsung Shop App during the competition period in the review section (located at the bottom of the corresponding product page).
3.2.7 ensure that Your review passes Samsung’s review process during the competition period, which requires that Your review complies with provisions of clauses 3.2.2 – 3.2.4 above.
3.3 Should Your review contravene the General Competition Ts & Cs, Competition Specific Ts & Cs and/or the terms stated in the Competition Specific Marketing, Samsung may, in its sole discretion, remove or reject Your review from the Samsung Online Store or Samsung Shop App and withdraw Your entry from the Competition.
3.4 You will be limited to one entry for each Rate & Review Samsung Competition, irrespective of the number of products reviewed by You.
3.5 Reviews submitted may take up to 48 hours to be vetted and approved by Samsung. Samsung does not guarantee that any review will be vetted and approved before the closing date of a Samsung Competition, and any review not vetted and published by the closing date shall be deemed invalid, and the Entrant will be excluded from the Samsung Competition.
4 SUBMISSION OF PHOTOGRAPHS/ VIDEOS / IMAGES / COMMENTS
4.1 Samsung Competitions may require Entrants to upload or submit photographs, videos, images, or comments (“Material”) on Samsung‑ platforms (including, without limitation, Samsung Members, Samsung Online Store or Samsung Shop App, and Samsung Social Media accounts). These Materials form part of the Entrant’s participation in the Samsung Competition and are subject to the following terms:
4.1.1 Upon submission and upload of any Material, the Entrant assigns and transfers all rights, title and interest in such Material to Samsung.
4.1.2 The Entrant agrees that any and all intellectual property rights arising out of the creation of the Material will become the property of Samsung, without exception, and the Entrant unconditionally and irrevocably assigns all such intellectual property rights to Samsung in exchange for his/ her participation in the Samsung Competition.
4.1.3 The Entrant grants to Samsung the right to use the Material which includes, but is not limited to, reposting, publishing, editing, and distributing the Material across any media platforms (including without limitation Social Media platforms).
4.1.4 The Entrant agrees that Samsung shall not be responsible for or be held liable for any privacy breach, any of the Material that may be duplicated or unlawfully used by persons unauthorised by Samsung or any losses suffered as a result thereof.
4.1.5 Entrants are advised to avoid submitting Material containing minors; however, if included, the Entrant must ensure that all necessary permissions have been obtained in compliance with the Protection of Personal Information Act (POPIA). Samsung, its affiliates and service providers shall not be liable or responsible for any inappropriate Material posted by any Entrant or by the public.
5 PRIZE
5.1 A Prize won in a Samsung Competition –
5.1.1 is not transferable from the Winner to any other person;
5.1.2 cannot be substituted or redeemed for cash;
5.1.3 may differ in colour and specifications from the advertised Prize in the Competition Specific Marketing;
5.1.4 may be changed to a prize of similar economic value by Samsung in its sole discretion if it deems it necessary; and
5.1.5 is subject to stock availability and where no stock of the Prize is available, Samsung may in its sole discretion determine a suitable replacement prize.
5.2 The Winner shall be liable for any and all tax implications and liabilities arising out of winning and receiving the Prize.
5.3 Samsung reserves the right to withhold the Prize until Samsung is entirely satisfied that the claimant of the Prize is the bona fide Winner, and to call for any such proof as Samsung may deem necessary.
6 THE DRAW
6.1 The Draw will be supervised by an independent auditor or a registered accountant, or an attorney or an advocate.
6.2 The result of the Draw is final and no correspondence will be entered into.
6.3 If for any unforeseen reason, the Draw cannot take place on the date specified in the Competition Specific Marketing, Samsung will endeavour to conduct the Draw within a reasonable period thereafter and shall provide details of the new date for the Draw on the Samsung Online Store or Samsung Shop App website.
6.4 Samsung shall not be obligated to announce any winner(s) publicly.
7 PERSONAL DATA
7.1 The Entrant consents to any necessary processing of their personal information voluntarily provided by the Entrant for the specific purpose of entering the Samsung Competition.
7.2 In accordance with the confidentiality policies and practices of Samsung, none of the entry details of any Entrant will be disclosed or used by Samsung for any purposes other than for entry into the Competition and in accordance with clause 7.4 below.
7.3 The Entrant acknowledges and consents to Samsung utilising a third party (“Samsung's Authorised Agent(s)”) and providing the Entrant's information to Samsung's Authorised Agent(s) to contact the Entrant in relation to the Samsung Competition.
7.4 By participating in the Samsung Competition, the Entrant agrees and consents that Samsung and its affiliates may contact the Entrant via email and through social media platforms to deliver marketing communications regarding Samsung's products and promotional activities, provided that the Entrant is given the opportunity to opt-out of receiving marketing communication at any time via the appropriate opt-out mechanisms provided by Samsung for such purpose. Samsung may also use the personal information collected from the Entrants as described in the Privacy Policy accessible on the Samsung Online Store or Samsung Shop App website and that such use may include the transfer of such personal information to Samsung's Authorised Agents and affiliates in any country. Details of Entrants will not be used by Samsung for Samsung related communications should the Entrant opt-out at any time from receiving further communication from Samsung.
8 LIMITATION OF LIABILITY
8.1 TO THE EXTENT PERMITTED BY THE CONSUMER PROTECTION ACT, NO. 68 OF 2008 ("CONSUMER PROTECTION ACT") AND ANY OTHER APPLICABLE LAW:
8.1.1 THE ENTRANT AND/OR WINNER(S) HEREBY INDEMNIFIES SAMSUNG ITS RESPECTIVE AGENTS, AFFILIATES, ASSIGNS, DIRECTORS, OFFICERS, SUBSIDIARIES, HOLDING COMPANIES, SERVICE PROVIDERS, SUPPLIERS, EMPLOYEES OR REPRESENTATIVES AGAINST ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OR LOSS OF ANY KIND REGARDLESS OF HOW IT WAS CAUSED, AND WHETHER IT AROSE UNDER THE LAW OF CONTRACT OR DELICT OR OTHERWISE, ARISING OUT OF THE ENTRANT'S ENTRY INTO THE SAMSUNG COMPETITION INCLUDING WITHOUT LIMITATION AS A RESULT OF TECHNICAL FAILURES AFFECTING THE PARTICIPATION AND PRIZE, INCORRECT WINNER ANNOUNCEMENTS, ERROR, MISTAKES, OMISSION, INTERRUPTION, DEFECTS, DELETION, DELAY IN OPERATION OR TRANSMISSION, VIRUSES, COMMUNICATION LINE OR TELEPHONE, MOBILE OR SATELLITE NETWORK FAILURE, TECHNICAL PROBLEMS OR TRAFFIC CONGESTION ON THE INTERNET OR WEBSITE, SOFTWARE FAILURE WHETHER RESULTING OR NOT FROM ANY FORCE MAJEURE OR FROM THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO OUR SYSTEM;
8.1.2 SAVE AS CLEARLY SET OUT IN THE COMPETITION SPECIFIC MARKETING, THE ENTRANT ACKNOWLEDGES THAT NO WARRANTIES (EXPRESS OR IMPLIED) OR REPRESENTATIONS HAVE BEEN MADE BY SAMSUNG IN RELATION TO A SAMSUNG COMPETITION AND NO LIABILITY SHALL ARISE AGAINST SAMSUNG AS A RESULT OF ANY ALLEGED BREACH OF WARRANTY OR MISREPRESENTATION.
8.2 THE SUB-PARAGRAPHS ABOVE HAS IMPORTANT LEGAL CONSEQUENCES FOR YOU. IT LIMITS SAMSUNG’S RISK AND LIABILITY, AND YOU UNDERTAKE TO HOLD SAMSUNG HARMLESS IN THE EVENT THAT YOU HAVE ANY CLAIM AGAINST SAMSUNG. IF FOR ANY REASON SAMSUNG MAKES A MISTAKE, THERE IS A TECHNICAL ERROR, OR ANY CIRCUMSTANCES LISTED ABOVE ARISE, YOU WILL NOT BE ABLE TO PURSUE ANY ACTION OR CLAIM AGAINST SAMSUNG FOR ANY LOSS OR DAMAGE SUFFERED. YOU ALSO INDEMNIFY US FOR ANY CLAIMS WHICH MAY BE MADE BY THIRD PARTIES.
9 TERMS OF DELIVERY:
9.1 Samsung does not accept any responsibility for late or delayed delivery of the Prize from any cause whatsoever, including but not limited to, stock being unavailable, strike, lock out, destruction of or damage to the Prize, any civil commotion or disorder, riot, threat of war, any action taken by governmental authority or public authority of any kind, fire, explosion, storm, flood, earth quake or other acts of God.
9.2 Delivery of the Prize may occur by way of courier and Samsung does not accept any responsibility for late/non arrivals and/or any damage to the Prize that may arise during its delivery to the Winner.
9.3 The Winner will be contacted by telephone, email or direct messaging using the contact details of the participant provided at the time of entry. Samsung, or its authorised agent, will make reasonable efforts to contact the winner, including no fewer than two (2) attempts, within a period of ten (10) working days following the draw. Should the Winner remain unreachable during this period, the Prize shall be forfeited.
9.4 If the winner is unreachable as described in clause 7.3; is found to be ineligible, or fails to claim or accept delivery of the Prize within the prescribed time frame, the Prize will be forfeited. In such circumstances, Samsung may award the Prize to an alternative winner in accordance with these General Competition Ts & Cs. Samsung retains sole discretion to determine the time frame for claiming or accepting delivery of any reallocated Prize.
9.5 The Winner must at the time of delivery present a valid identity document or valid residency permit.
9.6 Deliveries will only be made within the borders of the Republic of South Africa.
9.7 Deliveries will occur from Monday to Friday during regular office hours (08h00 to 17h00) and no deliveries will be made on public holidays or over the weekends.
10 SAMSUNG ONLINE STORE OR SAMSUNG SHOP APP PROMOTION CODE AND/OR VOUCHER TERMS AND CONDITIONS:
10.1 In the event that You are issued with a Samsung Online Store or Samsung Shop App Promotion Code and/or Voucher (“Promotion Code and/or Voucher”) as a Prize for a Samsung Competition the following terms and conditions shall apply, every Promotion Code and/or Voucher:
10.1.1 has a unique voucher code which has been assigned to You (in the event of a Voucher). The intended recipient will be determined differently based on the type of Samsung Competition (the "Intended Recipient" or "You").;
10.1.2 is for the amount specified on the digital communication provided to You by way of either electronic mail, SMS or on the Competition Specific Material, to be redeemed only on the Samsung Online Store or Samsung Shop App and not in any physical Samsung branded stores or any affiliate stores or websites which sell Samsung products;
10.1.3 may only be redeemed by the Intended Recipient upon reasonable evidence of their identity being confirmed through the creation of a user account on the Samsung Online Store or Samsung Shop App or such other valid form of identity document as may be requested by Samsung and/or the Samsung Online Store or Samsung Shop App;
10.1.4 cannot be used after expiration of the Promotion Code and/or Voucher;
10.1.5 shall be limited to a one-voucher-per-purchase basis. This means that the Promotion Code and/or Voucher may not be aggregated in respect of the purchase of any item. For example, if the stated price of an item exceeds the amount of the Promotion Code and/or Voucher, then You must pay the balance in order to purchase that item and may not use other Promotion Codes and/or Vouchers in respect of that item;
10.1.6 may be used towards purchases of more than the value of the Promotion Code and/or Voucher where the Intended Recipient pays the balance using one of the accepted methods of payment on the Samsung Online Store or Samsung Shop App;
10.1.7 CANNOT BE TRANSFERRED OR ASSIGNED IN ANY MANNER TO ANY PERSON BY THE INTENDED RECIPIENT;
10.1.8 is not redeemable for cash; and
10.1.9 is valid and may only be redeemed within a period of 3 (three) months from the date of issuing of the Promotion Code and/or Voucher to the Intended Recipient (the "Promotion Code and/or Voucher Date"). Should there be any dispute, Samsung shall determine the Promotion Code and/or Voucher Date according to its records and this date will be final and binding on You. Once the 3 (three) month period has elapsed, the Voucher will have expired automatically and the Promotion Code and/or Voucher code will no longer be valid on the Samsung Online Store or Samsung Shop App;
10.2 ONCE-OFF PURCHASE AND FORFEITURE: THE SAMSUNG PROMOTION CODE AND/OR VOUCHER WILL BE VALID FOR A ONCE-OFF PURCHASE ONLY. THE PARTICIPANT MUST USE THE FULL VALUE OF THE SAMSUNG PROMOTION CODE AND/OR VOUCHER WHEN MAKING THE ONCE OFF PURCHASE. ANY BALANCE REMAINING AFTER THE ONCE-OFF PURCHASE, WILL BE FORFEITED;
10.3 Samsung shall endeavour to replace any damaged or defective goods purchased using the Promotion Code and/or Voucher in accordance with the provisions of the Consumer Protection Act. Other than in respect of damaged, defective or unsafe goods or for any other lawful reasons provided in the Consumer Protection Act, no refunds are permissible for any item(s) purchased with the Promotion Code and/or Voucher; provided that to the extent that a refund is permissible, You will be issued with a replacement Promotion Code and/or Voucher (with the same Promotion Code and/or Voucher Date) and a refund of any cash amount contributed by You;
10.4 By making use of the Promotion Code and/or Voucher, You acknowledge that –
10.4.1 You have read, understood and agree to the terms and conditions set out herein relating to Promotion Code and/or Voucher, the General Competition Ts & Cs, and the terms and conditions of the Samsung Online Store and Samsung Shop App;
10.4.2 You will be required to create an account on the Samsung Online Store / Samsung Shop App in order to redeem the Promotion Code and/or Voucher;
10.4.3 The Promotion Code and/or Voucher is for the exclusive use of the Intended Recipient;
10.4.4 You are 18 (eighteen) years or older to redeem this Promotion Code and/or Voucher on the Samsung Online Store.
10.5 The Promotion Code and/or Voucher is for the exclusive use of the Intended Recipient;
10.6 You will not attempt to transfer or permit any other person to use the Promotion Code and/or Voucher;
10.7 THE PROMOTION CODE AND/OR VOUCHER MAY ONLY BE REDEEMED WITHIN 3 (THREE) MONTHS FROM DATE OF ISSUE
11 GENERAL
11.1 By entering into a Samsung Competition, You confirm that you are aware of, have read and accept the general terms and conditions applicable to use of the Samsung Online Store or Samsung Shop App.
11.2 A Competition shall be governed by these terms and condition, Competition Specific Marketing and any Competition Specific Ts and Cs. To the extent that there is any conflict between the Competition Specific Ts and Cs, Competition Specific Marketing, these terms and conditions and the standard terms and conditions of any Social Media platform or partners of Samsung, the order of precedence will be the following:

11.2.3 these General Competition Ts & Cs
11.2.4 Samsung Members terms and conditions
11.2.5 the standard terms and conditions of any Social Media platform or partners of Samsung.
11.3 Samsung reserves the right, at any time, to verify the validity of entries and information provided by an Entrant (including but not limited to an Entrant's identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these terms and conditions, Competition Specific Marketing and/or the Competition Specific Ts and Cs, or who tampers with the entry process.
11.4 Samsung may, in its sole discretion, amend these terms and conditions, Competition Specific Marketing and/or the Competition Specific Ts and Cs, at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised terms and conditions on the Samsung Online Store or Samsung Shop App’s website. The Entrant is responsible for ensuring that the Entrant is familiar with any updates to the terms and conditions.
11.5 If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Samsung, including but not limited to technical difficulties, unauthorised intervention or fraud, Samsung reserve the right, in its sole discretion, to the fullest extent permitted by law to –
11.5.1 disqualify any Entrant; or
11.5.2 modify, suspend, terminate or cancel the Samsung Competition as appropriate, subject to the approval of relevant regulatory authorities (if required).
11.6 Save as prohibited by Law, Samsung reserves the right to cancel, suspend or terminate this Samsung Competition, without notice at any time, and such cancellation, suspension or termination shall be deemed to have taken effect from the date of publication of such cancellation, suspension or termination on Samsung Online Store or Samsung Shop App’s website. Samsung shall have no liability whatsoever arising out of or in connection with such cancellation, suspension or termination. IN THIS REGARD, TO THE EXTENT PERMISSIBLE IN LAW, THE ENTRANT WAIVES ANY RIGHT WHICH THEY MAY HAVE AGAINST SAMSUNG AND HEREBY ACKNOWLEDGES THAT THEY WILL HAVE NO RIGHT OF RECOURSE OR CLAIM OF ANY NATURE WHATSOEVER AGAINST SAMSUNG ARISING OUT OF OR IN CONNECTION WITH THE SAMSUNG COMPETITION AND/OR THE CANCELLATION, SUSPENSION OR TERMINATION THEREOF.
11.7 Any dispute or claim arising out of or in connection with the Samsung Competition shall be governed by and construed in accordance with the laws of South Africa.
11.8 Samsung will not be responsible for any costs, expenses or data charges (network rates will apply) that an Entrant may incur during and for purposes of an Entrant’s participation in any Samsung Competition and a winner’s acceptance and/or use of a Prize.
11.9 To the extent that these terms and conditions, the Competition Specific Ts and Cs or any goods or services provided hereunder are governed by the Consumer Protection Act, no provision of these terms and conditions and the Competition Specific Ts and Cs is intended to contravene the applicable provisions of the Consumer Protection Act, and all provisions of the terms and conditions must be treated as being qualified, to the extent necessary, to ensure compliance with the applicable provisions of the Consumer Protection Act.
11.10 All provisions of these terms and conditions and/or the Competition Specific Ts and Cs are, notwithstanding the manner in which they have been grouped together or linked grammatically, severable from each other. Any provision which is or becomes unenforceable, whether due to voidness, invalidity, illegality, unlawfulness or for any other reason whatever, shall, only to the extent that it is so unenforceable, be treated as pro non scripto and the remaining provisions of these terms and conditions and/or the Competition Specific Ts and Cs (as applicable) shall remain of full force and effect. Samsung records that it is Samsung's intention that these terms and conditions and/or the Competition Specific Ts and Cs (as applicable) would be executed without such unenforceable provision if Samsung was aware of such unenforceability at the time these terms and conditions and/or the Competition Specific Ts and Cs (as applicable) were published.
11.11 In accordance with the confidentiality policies and practices of Samsung, none of the entry details of any Entrant in a Samsung Competition will be disclosed or used by Samsung for any purposes other than for entry into the Competition and in accordance with these General Terms and Conditions.
11.12 Details of Entrants will not be used by Samsung for Samsung related communication should the Entrant opt-out to receive further communication from Samsung.
11.13 Entrants acknowledge and accept that Samsung shall utilize a third party (“Authorized Agent/s”) to contact the Entrant, in the event that the Entrant is a Winner, and to arrange delivery of the Prize. In order to affect the contacting and delivery process, Samsung shall provide the Entrant’s information to such Authorized Agent/s.
11.14 Samsung may require the Winner and the Winner agrees by entering the Samsung Competition to be identified, photographed, filmed and the aforegoing to be published in any media including on www.samsung.com/za without compensation. Such publishing and processing of the Winner's personal information will be undertaken strictly in accordance with the Protection of Personal Information Act, 4 of 2013 (“POPIA”). The Winner’s name and image may be published, provided that the Winner retains the right, at any time, to object to or decline the further use of their name, likeness, or image by Samsung. Should the Winner exercise this right,
Samsung will cease such use, subject to any legal or regulatory obligations requiring continued retention or disclosure.
