Samsung Applicant Privacy Notice

PURPOSE

This Job Applicant Privacy Notice (“Notice”) describes how Samsung Electronics America, Inc., and its subsidiaries and affiliates (collectively, “Samsung” “we,” “our,” or “us”) collects, uses, discloses, or otherwise processes Personal Information (defined below) of individuals that apply for employment with us in the U.S. (“Applicant(s)”).  When you apply for a job at Samsung, you agree to the collection, use, and disclosure of your Personal Information as set forth in this Notice.

 

SCOPE

This Notice governs the processing of Personal Information solely as part of Applicants’ professional relationship with Samsung.  For purposes of this Notice, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a Samsung Applicant.

INFORMATION WE COLLECT ABOUT YOU

We collect the following categories of Personal Information from Applicants:

  • Identifiers/Contact Information, such as name, address, phone number, email address, applicant or employee ID number, government-issued identification numbers (e.g., social security number, passport number, driver’s license number), visa information, and online identifiers such as Internet Protocol (IP) address or device identifier;
  • Characteristics of Protected Classifications under Federal or California Law, such as your gender, age, date of birth, citizenship or immigration status, marital status, race/ethnicity, disability, or military/veteran status;
  • Professional or Employment-Related Information, including compensation, benefits and payroll information (e.g., salary-related information, tax-related information, benefits elections), information relating to your previous employment positions (e.g., job title and job description), performance-related information (e.g., evaluations and training), talent management information (e.g., resumé information, previous occupation details, education details, certifications and professional associations, historical compensation details, and pre-employment screening and background check information, including criminal records information), and emergency contact information;
  • Education Information, such as education history, certificates, and accomplishments;
  • Internet or Other Electronic Network Activity Information, such as your device identifiers, IP address, log information, device model, hardware model, IMEI number, serial number, device settings, connections to other devices, mobile network operator, web browser characteristics, app usage information, current software version, randomized, non-persistent and resettable device identifiers, and other information about your interaction with our online jobs portal;
  • Visual or Audio Information, such as information we may collect from our closed-circuit television (CCTV) monitoring systems or recordings of phone calls;
  • Personal Information Described in California Civil Code Section 1798.80(e), which includes categories of Personal Information listed elsewhere in this Notice;
  • Inferences derived from the above categories of Personal Information to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes; and
  • Sensitive Personal Information, including government-issued identification numbers (e.g., Social Security, driver’s license, or state ID card number), information about race/ethnicity or citizenship/immigration status, financial account information, trade union membership, and medical/health-related information.

 

HOW WE USE PERSONAL INFORMATION

We use the Personal Information that we collect from and about you for our recruitment activities and as otherwise necessary or appropriate in connection with the fulfillment of other legitimate business purposes. The specific purposes for which we use your Personal Information are described below.

  • To facilitate and improve the recruiting and interview process. We use your Personal Information in connection with our general recruitment activities, which may include identifying you as a potential candidate, reviewing and processing your application for a position with us, verifying the information provided to us in connection with your application or received from other sources, determining your eligibility and suitability for a potential position or other opportunities with us, calculating compensation, securing immigration status, reimbursing expenses, performing background checks, and communicating with you about the status of your application or other opportunities with us that may be of interest to you. We may also use your Personal Information to evaluate and improve our job application and recruitment activities.

    We may use artificial intelligence (“AI”) and machine learning (“ML”) technologies to improve our recruiting and hiring practices, to provide Applicant support (including through chat bots), analyze the use and functionality of our jobs portal, and to review resumes and applications for employment. When you apply for employment or interact with us, we may use the Personal Information you provide, including text prompts, uploaded documents, account profile indicators, and system metadata, to respond to your requests and to train our AI models. We may transmit this information to our vendors who are contractually required to maintain the security and confidentiality of this information. We do not use automated decision-making technology without human review. In rare instances where algorithmic profiling is deployed, a human operator reviews the output before final executions.
  • Maintain security and prevent fraud. We use your Personal Information to help monitor and maintain the security and integrity of the jobs portal as well as our business, network, and systems. We also use your Personal Information to detect, prevent, investigate, and protect you, our business, and others from fraud and other unlawful or unsafe activity.
  • To satisfy our legal obligations. We use your Personal Information to comply with applicable law including: tax, record-keeping and reporting obligations; conducting audits; management and resolution of health and safety matters; complying with requests from government or other public authorities; responding to legal process such as subpoenas and court orders; pursuing legal rights and remedies; defending litigation and managing complaints or claims; conducting investigations; and complying with internal policies and procedures.
  • As otherwise necessary or appropriate. We use your Personal Information to fulfill any other purpose for which you provide your Personal Information or as otherwise explained to you at the point of information collection. We also use your Personal Information for other purposes at your direction or with your consent. Finally, we use your Personal Information as we believe necessary or appropriate to protect our rights, privacy, safety, property, and/or those of others.  We do not “sell” or “share” the Personal Information of Applicants, or use the Personal Information of Applicants for “targeted advertising” as such terms are defined in applicable privacy law.

Sensitive Personal Information: When we collect, process and use “sensitive Personal Information” we only do so for permissible “business purposes” (as such terms are defined in applicable law), including to process your application for employment.  We do not use or disclose sensitive Personal Information for the purpose of inferring characteristics about you.

 

RETENTION OF YOUR PERSONAL INFORMATION

When you apply for a position with Samsung, we retain your Personal Information to consider you for the position you applied for or other positions with Samsung for a period of six years.  If you are hired as an employee, we retain Personal Information for the length of your employment relationship with Samsung as well as for an additional six years after the termination of your employment relationship in accordance with our Employee Privacy Policy.  We may retain certain Personal Information for a longer period to address a legal, health and safety, or tax-related obligation or to resolve a potential or actual dispute or investigation.

 

HOW YOUR PERSONAL INFORMATION IS COLLECTED

We collect your Personal Information in a number of ways:

  • Directly from you. We or our service providers generally collect your Personal Information directly from you when you provide information related to your application for employment or communicate with us directly.
  • Automatically when you visit the online jobs portal. When you visit our jobs portal, we or our service providers may collect browsing history, site usage data, and other information regarding your online activity automatically through a variety of technologies, such as cookies, tags, SDKs or scripts.
  • From third parties. We may collect certain Personal Information from third parties, such as your previous employer, your professional references, employment and background check agencies, government entities, public data bases, and online profiles.

We may combine Personal Information that we collect from and about you, including from each of these sources.

 

HOW WE DISCLOSE YOUR INFORMATION

Within Samsung, your information will be available to staff and human resources personnel on a need-to-know basis.

We may also disclose each category of your Personal Information that we collect to the following categories of recipients:

  • Our Affiliates and Subsidiaries.  We may disclose your Personal Information with our affiliates and subsidiaries for purposes set forth in this Notice.
  • Our Service Providers. We disclose your Personal Information to our service providers that provide business, professional, human resources, benefits, or technical support services to us, help us operate our business and facilitate the application/hiring process (including providing background checks or performing credit reporting services), or administer activities on our behalf. These service providers may include contact management tools, recruiting and human resources platforms, payment processors, background check providers, etc.

In some circumstances, we may disclose your Personal Information to:

  • Governmental, Regulatory, and Public Authorities. We may disclose your Personal Information to government and law enforcement authorities, in each case to comply with legal or regulatory obligations or requests.
  • Relevant Third Parties as Part of a Corporate Transaction. In the event of a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with a bankruptcy or similar proceeding), we may disclose or transfer your Personal Information to certain third parties, such as the acquiring entity and its advisers.
  • Other Third Parties. We will disclose your Personal Information to other third parties at your direction or with your consent, including former employers or those whom you have listed as job references or who referred you to Samsung. Additionally, we will disclose your Personal Information as we believe necessary or appropriate to: (a) comply with applicable law; (b) enforce our terms and conditions; (c) protect our operations; (d) protect our rights, privacy, safety, or property, and/or those of you or others; and (e) allow us to pursue available remedies or limit damages that we may sustain.

We may disclose your Personal Information for other reasons that we will describe at the time of information collection or prior to disclosing your information.

De-identified data:  We may de-identify or aggregate Personal Information so that it will no longer be considered Personal Information and disclose such information to other parties. When we de-identify information, we will not “re-identify” or re-link it to an identifiable individual.

 

YOUR PRIVACY RIGHTS

California Privacy Rights.  If you reside in California, you are entitled to the following privacy rights, subject to applicable exceptions:

  • Right to Know: You have the right to know what Personal Information we have collected about you, including the categories of sources from which the Personal Information is collected, the business or commercial purpose for collecting, processing, or sharing Personal Information, the categories of recipients to whom we disclose Personal Information, the categories of Personal Information disclosed to recipients, and the specific pieces of Personal Information we have collected about you. You also have the right to access this information in a portable format. Please note that we may not be required to respond to your requests “to know” or access specific pieces of Personal Information more than twice in any 12-month period.
  • Right to Delete: You may request that we delete the Personal Information that we have collected from or about you. There are some reasons when we will not be able to fully address your request, such as to perform a contract, to detect and protect against fraudulent and illegal activity, to maintain for internal purposes, to comply with a legal obligation or to exercise our rights, including our rights as an employer or prospective employer.
  • Right to Correct: You have the right to correct inaccurate Personal Information that we may maintain about you, subject to appropriate verification.

Submit a request to know, delete, or correct.  To take advantage of your right to know, delete, or correct under California law, please call 800-SAMSUNG or contact na.hrssc@samsung.com or visit:  Privacy Rights Portal | Samsung US.  If necessary, we may request certain information to verify your identity before we can respond to your privacy rights request.  When you exercise your privacy rights, you have the right not to receive discriminatory treatment by Samsung for the exercise of such privacy rights. You are not required to create an account in order to exercise these rights.

Authorized Agent Requests.  You may authorize someone to make a privacy rights request on your behalf (an “authorized agent”) using the mechanisms described in this section. Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf.  Samsung retains the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity.

 

INFORMATION SECURITY

We implement and maintain reasonable security procedures and practices appropriate to the nature of the information we maintain, including appropriate technical, administrative, and physical measures designed to protect information from unauthorized or illegal access, destruction, use, modification, or disclosure. You also play an important role in protecting your information. It is your responsibility to select a strong password, change it regularly, not reuse or share your password, and alert us if you have any concerns about unauthorized use of your account.

 

CHANGES TO THIS NOTICE

We reserve the right, in our sole discretion, to change, modify, add, remove, or otherwise revise portions of this Notice at any time. We will communicate any material revisions and post the revised Notice internally.
