SAMSUNG ELECTRONICS (UK) LIMITED



Participants agree to be bound by these terms and conditions (the “Terms and Conditions”). Any information or instructions published by the Promoter about the Promotion at www.samsungpromotions.claims/galaxy-z-time-to-fall-in-love/en-GB/terms form part of the Terms and Conditions.



The Promoter

1. The Promoter is Samsung Electronics (UK) Limited, Samsung House, 1000 Hillswood Drive, Chertsey, Surrey, KT16 0RS (the “Promoter”).

Purchase Period

2. The Promotion will commence at 00:01 (BST) on 24th March 2021 and shall close at 23:59 (BST) on 22nd June 2021 (the “Purchase Period”).

Eligibility

3. To be eligible to participate in the Promotion you must be a UK, Channel Islands, Isle of Man (“Territories”) resident aged 18+ with a valid bank account in local currency in the relevant Territory (“Participant”).
4. This Promotion is only available to end users (e.g. not to any reseller or business).
5. Claims may only be submitted directly by the end user Participant. Claims made on behalf of the end user Participant are specifically excluded.
6. This offer is available for purchases of a SIM free handset only from a Participating Retailer. “SIM free” means that the device is not provided as part of an airtime or data contract with a mobile network provider (or virtual network provider); these do not qualify for this Promotion.

7. Participants who purchase a new (i.e. not second hand, ex-display or refurbished) Samsung Z Flip 5G or Z Fold2 5G phone (in any colour) with 256GB memory variant as listed in Table 1 below (the “Promotion Product”) from a Participating Retailer listed in Table 2 below within the Purchase Period and are dissatisfied with their purchase may, within 60 days (“Trial Period”) and provided it meets the minimum criteria in Term 21 (“Criteria”) trade in their Promotion Product (“Trade-In Device”) in exchange for a cashback payment (subject to a discount for wear and tear) subject to full compliance with these Terms and Conditions (“Promotion”) which will be equal to the price paid for the Promotional Product but capped at the figures in Table 1 below. (“Payment”).

8. Participants may claim a maximum of one (1) Payment on the trading in of one (1) purchased Promotional Product with a maximum of one (1) Promotional Products per household.
9. This Promotion will run in conjunction with all other statutory warranties or returns policies, whether in-box, or otherwise, that are available to the Participant. The Participant is in no way obliged to trade in the device through the means set out in this Promotion but may utilize the standard manufacturer’s warranty.
10. To be eligible under the Promotion, purchases of Promotion Products must be made from the following retailers (“Participating Retailers”) set out in Table 2. Purchases from auction websites (e.g. eBay) or purchases from any 3rd party marketplace (e.g. Amazon Marketplace or Play Trade) are specifically excluded from this Promotion (“Excluded Retailers”).

Claims

11. To take part in the Promotion and make a claim for a Payment (“Claim”), Participants must first register on the website https://2021.samsungpromotions.claims/galaxy-z-time-to-fall-in-love and follow the onscreen instructions providing the required information including proof of purchase from the Participating Retailer and IMEI number of the Promotion Product within 14 days of their purchase.
12. Participants who wish to trade in their purchased Promotion Product for a Payment must then revisit the website https://2021.samsungpromotions.claims/galaxy-z-time-to-fall-in-love and click on the “Initiate Trade In” button to complete the request process (including by inputting their bank account details) within 60 days of their purchase (with the date of purchase being considered day 1) (“Trial Period”). The last day to submit a Claim is therefore 21st August 2021 (23:59 – BST) for Promotion Products purchased on 22nd June 2021 (the end of the Purchase Period).
13. Claims must be submitted within the Trial Period (“Claim Window”). Claims received after the end of the applicable Claim Window will not be eligible for the Promotion.
14. Participants will be sent an email and SMS to confirm that their Claim has been received by the Promoter and that it has been successful and provisionally validated pending receipt of the Promotion Product in Excellent Condition (as defined below). Participants whose Claims have been provisionally approved shall also receive instructions for the trade in of their Promotional Product along with a prepaid label.
15. If an email or SMS acknowledgement has not been received, it is the Participant’s responsibility to contact the Promoter’s customer service team at support@samsungpromotions.claims or call 0330 054 0223 within seven (7) days of a Claim being submitted.
16. If the Claim is deemed to have not been submitted correctly or the relevant IMEI number cannot be verified as valid, the Participant will be notified via email and SMS and offered the opportunity to provide the required information (including but not limited to a photograph of the Promotion product IMEI number) to validate their Claim within seven (7) days from notification. If no response is received, then the Claim shall be marked as invalid and the Participant will no longer be eligible to receive the Reward.
17. Participants must dispatch their Promotion Product using the label mentioned in clause 14 within 30 days of the Claim being provisionally approved. Promotion Products shipped outside of this date shall be deemed ineligible for a Payment.
18. Claims that are incomplete or damaged will be deemed invalid. No responsibility is accepted by the Promoter for lost, delayed or damaged data which occurs during any communication or transmission of Claims.
19. Proof of posting will not be accepted as proof of receipt. The Promoter cannot accept liability for any Claims or Trade-In Devices lost, damaged or destroyed in the post. Please note Trade-In Devices sent by hand will not be accepted.
20. Participants must ship their original Promotion Product purchased from the Participating Retailer and registered during the Claim process. The Promotion Product must be received in Good Condition under the Criteria as defined in Clause 21 below.
21. In order for the Participant to receive a Payment the Promotional Product must be sent in Good Condition which means it meets the following minimum criteria (“Criteria”):
a. Complete with its original box and all accessories including charging cable;
b. Undamaged (subject to minor scratches reasonably expected from fair wear and tear over 60 days’ use);
c. Not permanently marked (subject to minor scratches reasonably expected from fair wear and tear over 60 days’ use); and
d. Unlocked, with any passwords and personal data removed.

Minor scratches that would be reasonably expected from fair wear and tear over 60 days’ use are acceptable.

22. Deletion of all data and information stored in any Trade-In Devices submitted by a Participant and/or other storage media received is the Participant's absolute responsibility. The Promoter accepts no responsibility for Participants' data and software or for any loss or damage to that data and software. Upon receipt of a Trade-In Device from a Participant all data will be permanently and irretrievably destroyed. Please note the Promoter is unable to retrieve any Participant data once a Trade-In Device has been received.
23. Reasonable deductions from the Payment amount may be made for wear and tear to the Promotion Product.
24. Where the Promotion Product is received and does not meet the Criteria, the Promoter reserves the right at its absolute discretion to refuse the Claim and return the Promotion Product at no cost to the Participant. The Promoter shall notify the Participant of any such rejection within 10 days of receipt of the Promotion Product.
25. Providing that the Participant has complied fully with the Promotion Terms, the Administrator shall pay the Participant the Payment amount via bank transfer to their Participant’s bank as nominated during the Claim process within 30 days of receipt of the Promotion Product.
26. Claims where the Promotion Product has suffered a widespread mechanical breakdown, catastrophic failure, endemic or epidemic failure or other damage as generally known or reported, are not eligible to take part under this Promotion. Any Claim in respect of a Promotion Product that is subject to media reports of endemic failure and which is not based on an actual defect in the specific Promotion Product purchased will be rejected as excluded from this Promotion. In these instances, the Participant should seek to rely on the Samsung standard warranty process for relief.
27. Payments are non-transferable, non-modifiable and non-exchangeable. Only the purchaser and legal owner of a Promotion Product is eligible to take part in the Promotion.
28. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid Claims including, without limitation, to generate or require further verification as to proof of purchase, as well as the identity, age, and other relevant details of a Participant. This process may involve the Promoter sharing information with third parties.

Privacy and Data Protection

29. Other than as set out in these Terms and Conditions or for the purposes of operating the Promotion, the details and information provided by the Participant when entering the Promotion or claiming the Payment will not be used for any promotional purpose, nor shall they be passed to any third party.
30. The Participant may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the Promoter’s privacy policy, available at www.samsung.com/uk/info/privacy.

General

31. The Promoter shall not be liable for any interruption to the Promotion whether due to force majeure or other factors beyond the Promoter’s control.
32. The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the Terms and Conditions of the Promotion.
33. Payments are non-transferable and not redeemable for cash by Participants.
34. The Promoter will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or claims; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Promotion.
35. Participants will be solely responsible for any and all applicable taxes and any other relevant costs or expenses which are not stated in the Terms and Conditions as included in the Payment.
36. By participating in this Promotion, you agree, to the maximum extent permitted by applicable laws, to release and hold the Promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Promotion, including without limitation, awarding, acceptance or receipt of the Payment. The above limitation of liability shall not apply to death or personal injury caused as a result of Promoter’s negligence.
37. The Promotion is governed by English law.
